This book was released on 2008 with total page 443 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to explore the potential and actual value of parliamentary debates as a source of legislative justification. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

Available in PDF, EPUB and Kindle. Book excerpt: Democracy is on the run, and elected governments are suffering from a legitimacy crisis. Legislatures are increasingly seen as unrepresentative. To give legitimacy to democratic government, experts argue that we need more democracy and more opportunities for direct citizen participation. Representative democracy needs to be complemented by forms of direct engagement, such as referendums, popular votes, the recall, citizens’ juries, eDemocracy, etc. This is what we term Complementary Democracy. In this book experts from the worlds of practice and theory come together to explain – and occasionally critique – these complements to representative democracy. The volume provides an invaluable starting point for anyone who wants to know more about the new directions of democratic governance, and hopes to inspire those who seek to build stronger democracies.

Available in PDF, EPUB and Kindle. Book excerpt: Should citizens be allowed to propose legislation? Should they even be allowed to recall politicians if they do not live up to their expectations? These questions and many others form the subject of this timely book. In addition to presenting an up to date review of the empirical literature, Direct democracy provides a survey of the political philosophers who have theorised about this subject. It is the central tenet in the book that the demand for direct democracy is a consequence of the demand for more consumer choices. Like consumers want individualised products, so voters want individualised and bespoke policies. Described by the BBC as "The world’s leading expert on referendums", the author, Matt Qvortrup, draws on his experience as a political advisor to the US State Department, as well as his extensive academic knowledge of direct democracy.

Book excerpt: This collection of essays engages with a central theme in scholarship on EU citizenship – the emancipation of certain citizens, the alienation of others – and seeks to expand its horizons to interrogate whether similar debates and trends can be identified in other fields of European integration. The focus of the book is distinctly citizen focused. It delivers the potential for the opening out of analysis of the implications of European citizenship beyond the parameters of Articles 18-25 TFEU and beyond the disciplinary confines of legal analysis alone. The book construes 'EU citizenship' in its broadest sense, and explores the extent to which the European citizen is, or indeed is not, genuinely at the heart of EU law and policy-making. Within the broader theme of empowerment and disempowerment, the contributors reflect on a range of cross-cutting themes; for example, the extent to which channels of citizen participation (can) inform EU policy-making in a 'bottom-up' sense; or whether the EU is a catalyst for the construction of new spaces and new identities.

This book offers an overview of these regulations and presents research on their effects.

Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.

Book excerpt: This report considers the biological and behavioral mechanisms that may underlie the pathogenicity of tobacco smoke. Many Surgeon General's reports have considered research findings on mechanisms in assessing the biological plausibility of associations observed in epidemiologic studies. Mechanisms of disease are important because they may provide plausibility, which is one of the guideline criteria for assessing evidence on causation. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.

Available in PDF, EPUB and Kindle. Book excerpt: Direct democracy involves citizens in discussion and decisions about what the government is to do, rather than leaving this to officials or parliaments. It thus challenges the restrictions placed by representative democracies such as Britain and the United States on political consultation and popular participation. Why should responsible adults not take public decisions as well as making their own individual choices? One affects them just as much as the other. Can ordinary citizens make good public policy though? Many lack education and expertise and may not even be interested in politics. Even without these individual defects, mass debate may by its very nature lead to arbitrary or downright bad decisions. This book confronts these arguments in light of new communication developments which for the first time make direct democracy technically feasible in a mass society. The result is a highly original and innovative account of the possibility of the direct involvement of citizens in the governance of their own affairs.
