Esta imagen del consumidor ha servido para construir todo un conjunto normativo edificado sobre la idea de que el mercado trabaja de forma correcta cuando al consumidor se le suministra información. Sin embargo, el Derecho de Consumo se enfrenta a un problema de ineficiencia del que las autoridades de la Unión Europea son conscientes. Quizá la normativa comunitaria se ha estado dirigiendo a un sujeto que no actúa como se pensaba. La preocupación –también manifestada por la doctrina– por encontrar al consumidor real para basar sobre éste y no sobre un modelo ideal las decisiones legislativas se ha convertido en una prioridad. La presente obra refleja toda esta evolución, que se inicia con el nacimiento jurisprudencial de la imagen del consumidor informado y llega a los recientes informes encargados por la Comisión Europea sobre los procesos de decisión de los consumidores vulnerables, que son los de la vida real. De los muy recientes documentos europeos se deduce que es llegado el momento de replantear los instrumentos tradicionales de protección y de reequilibrio contractual, y este trabajo tiene el mérito de apuntar las todavía incipientes soluciones y líneas de avance que podrían llegar en un futuro próximo.
