Book excerpt: A nadie se le escapa que el Derecho de Consumo europeo se ha construido tomando como arquetipo de consumidor ideal al consumidor que ha sido bien informado y que es además medianamente perspicaz, o lo suficiente para tomar decisiones racionales y libres sobre la base de la información que se le transmite. Esta imagen del consumidor ha servido para construir todo un conjunto normativo edificado sobre la idea de que el mercado trabaja de forma correcta cuando al consumidor se le suministra información. Sin embargo, el Derecho de Consumo se enfrenta a un problema de ineficiencia del que las autoridades de la Unión Europea son conscientes. Quizá la normativa comunitaria se ha estado dirigiendo a un sujeto que no actúa como se pensaba. La preocupación –también manifestada por la doctrina– por encontrar al consumidor real para basar sobre éste y no sobre un modelo ideal las decisiones legislativas se ha convertido en una prioridad. La presente obra refleja toda esta evolución, que se inicia con el nacimiento jurisprudencial de la imagen del consumidor informado y llega a los recientes informes encargados por la Comisión Europea sobre los procesos de decisión de los consumidores vulnerables, que son los de la vida real. De los muy recientes documentos europeos se deduce que es llegado el momento de replantear los instrumentos tradicionales de protección y de reequilibrio contractual, y este trabajo tiene el mérito de apuntar las todavía incipientes soluciones y líneas de avance que podrían llegar en un futuro próximo. Profesora Titular de Derecho civil en la Universidad Pública de Navarra, Teresa Hualde Manso es una autora que en su larga trayectoria como investigadora se ha ocupado de las más diversas parcelas del Derecho civil, con publicaciones que no sólo destacan desde su condición de experta foralista navarra bien conocedora de su Derecho de familia y de sucesiones, sino que, solamente a título de ejemplo, abarcan las inmisiones medioambientales, el transporte de viajeros, el aprovechamiento por turnos, las cláusulas abusivas en los contratos, la adquisición de la nacionalidad, la protección de datos o los problemas de la doble inmatriculación.
