Available in PDF, EPUB and Kindle. Book excerpt: Legal Pluralism and Governance in South Asia and the Diasporas contributes to the already heated debate about legal pluralism and the ontology of law by shifting the attention toward the relationship between what is treated as law and its impact on governance at the fora of dispute resolution. This book addresses sensitive issues such as gender rights and alternative dispute resolution in India, Hindu and Muslim personal laws in South Asia and in Europe, cross-border white violence, the change to Islamic legal traditions under Western domination, women’s inheritance in Pakistan and in the disputed territory of Gilgit Baltistan, indigenous rights and resistance at the India-Bangladesh border, and customary laws of nomadic groups in India. The authors deploy a variety of views that point at the pros and cons of legal pluralism and also integrates its opponents. They show how constructions of identity, religion, and power have historically informed the conceptualisation of secularism which may be an ideal, sometimes able to provide for perceptions of accountable governance, but also generating dividing worldviews. This book was published as a special issue of the Journal of Legal Pluralism and Official Law.

The book tries to cover these challenges in their different dimensions and presents options to grow more and better - creating jobs, with benefits for all, and without corruption and with civic participation. The design and implementation of all these options, simultaneously or in the short- and medium-term, is not feasible; and from here blooms options.

Available in PDF, EPUB and Kindle. Book excerpt: Stevens sees three crises in American judicial statesmanship. The first was the crisis of the founding. The well being of the country was subjected to grave danger, culminating in the crisis of the Civil War, and a refoundation was required. During the mid twentieth century, the United States faced the possibility of destruction, World War II and, the finding of malfeasance of the nation in the office of the president. The constant excitement of contest with antagonists makes it difficult to say whether the current crisis of the Supreme Court is merely a continuation or a whole new problem. The political leaders who resolved the first crisis and founded the Republic bequeathed as a part of that foundation the United States Supreme Court. During the subsequent history of the country, and with respect to its crises, the Court played a large part. Whether or not it does so well in the current period depends upon the quality of its judicial statesmanship. The judge is a person who acts. But it is considered action and considered action is based on prior understanding. The character of the Court's understanding, or direction, reveales itself in the course of its division over the application of the "due process" clause to state criminal proceedings.Frankfurter's view is problematic. If Western civilization is to be preserved, it must be because it is worth preserving. If it is worth preserving it must be because it is good. If so, can it be preserved by reliance upon and reference to itself, or must reliance not be placed upon that by virtue of which the thing to be preserved is worthy of preservation? This problem is not new to Western civilization. Much has been written about Frankfurter, and common descriptions of the terms "restraint" and "pragmatism" to characterize his doctrines. Previous treatments of these doctrines now available have not seemed adequate. The intention of "Reason and History in Judicial Judgment" is to treat them as ethical problems rather than as self-explaining conclusions.

Available in PDF, EPUB and Kindle. Book excerpt: This volume aims to balance the traditional literature available on medieval feuding with an exploration of other aspects of vengeance and culture in the Middle Ages. A diverse assortment of interdisciplinary essays from scholars in Europe and North America contest or enlarge traditional approaches to and interpretations of vengeance in the Middle Ages. Each essay attempts to clarify the multifaceted experience of vengeance within a specific medieval context”a particular region, a particular text, a particular social movement. By asking what relationship a distinct factor like authorship or religion has with the concept of vengeance, each author points towards the breadth of meanings of medieval vengeance, and to the heart of the deeper and broader questions that spur scholarly interest in the subject. Geographically, the essays in the volume highlight Western Europe (particularly the Anglo-Norman world), Scotland, Ireland, Spain, and Portugal. Thematically, the essays are concerned with heroic cultures of vengeance, vengeance as a legal and political tool, Christian justification and expression of vengeance, literature and the distinction between discourse and reality, and the emotions of vengeance. Methodologically, these interdisciplinary studies incorporate tools borrowed from anthropology, the study of emotion, and modern social and literary theories. This volume is aimed at professional scholars and graduate students within the broad field of medieval studies, including the subfields of history, literature, and religious studies, and is intended to inspire further research on medieval vengeance. However, this collection will also prove interesting to non-medievalists interested in the history of emotion, the justification of human conflict, and the concept of feud and its applicability to specific historical periods.

Available in PDF, EPUB and Kindle. Book excerpt: Defying the Odds examines the history of theTule River Tribe, a constituency of 1,500 members descended from the Southern Valley Yokuts Indians of California's Great Central Valley. This innovative book presents the first-ever study of a California tribe's political survival and transformation under American rule - from California statehood through the current Indian gaming era. The Tule River Tribe's struggle for sovereignty withstood challenges from political and legal institutions. Tribal members both reasserted and recast their traditions to preserve unity while competing for resources on their commonly owned reservation land base. The authors bring their remarkably rich knowledge of the Tribe's families and of federal Indian law to show how traditional leadership reemerged in the 1930s, under the Indian New Deal, through direct descendants of former chiefs. Vibrant portraits of men and women of the Tule River Tribe create a compelling narrative history, highlighting twentieth-century victories in land claims, government-to-government battles over Indian gaming, and use of Yokuts' traditional consensus - based negotiations over water rights with the Tribe's downstream neighbors. On every page of this groundbreaking book, the Tule River Tribe remains in frame as the protagonist of this exemplary story of indigenous struggle and triumph.
