Book excerpt: "As muckrakers, feminists, pacifists, anarchists, socialists, and communists were arrested or censored for their outspoken views, many of them turned to a Manhattan lawyer named Gilbert Roe to keep them in business and out of jail. In articulating and upholding Americans' fundamental right to free expression against charges of obscenity, libel, espionage, sedition, or conspiracy during turbulent times, Roe was rarely successful in the courts. His greatest victory was the influential 1917 decision by Judge Learned Hand in 'The Masses Publishing Co. v. Patten'. Roe's battles illuminate the evolution of free speech doctrine and practice in an era when it was under heavy assault."--Back cover.

Available in PDF, EPUB and Kindle. Book excerpt: As Asia looms larger in Western, and particularly U.S., security calculations, interest in the People's Republic of China (PRC) as a potential Security concern has grown. As China attempts to modernize its forces, is it becoming a "threat" to Western security in the region, and, if so, does it constitute a direct military threat? How successful have the Chinese been in upgrading their armed forces? How capable is China of projecting its forces beyond its borders? In attempting to answer these questions, it would be useful to know where current Chinese strategic and military priorities lay, and whether the PRC is investing enough resources in these priorities to constitute a serious security concern for the West. Since defense budgets are often a critical indicator of national defense priorities and policies, Western interest in Chinese defense spending has also grown considerably. The size of its defense budget, the rate of growth (or decline) in its military expenditures, and what it spends its defense dollars on can reveal much about a country's national security intentions and military plans. Defense budgets are usually an indicator of a country's military modernization priorities, and what future military capabilities it might possess. They can also serve as a gauge of a country's defense commitment and resolve, or its potential to threaten others.

Available in PDF, EPUB and Kindle. Book excerpt: Written by nationally recognized insurance law practitioners and academics, Insurance Practices and Coverage in Liability Defense, Second Edition (formerly titled Defending the Insured) provides the first comprehensive and objective analysis of the various duties and potential pitfalls confronting each party in the three-way relationship between insurance carrier, insured, and the appointed counsel in insurance defense. Each chapter provides a detailed discussion of topics engendered by the duty to defend and the consequent obligations of each of the parties. Reference tables and appendices then survey the law in each state on those topics. The result is a book that provides both a national study and state-specific analysis, allowing practitioners, courts and researchers the ability to see the big picture as well as to focus on and compare how states actually deal with the particular issue. Topics covered include: The use of staff counsel Billing guidelines Audits of attorneysand’ fees Reservations of rights Communication privileges and issues, and cooperation duties Conflicts of interest, control of the defense including independent counsel Allocation of defense costs between insurer and insured Allocation of indemnity expense between insurer and insured Allocation and determination of deductibles and SIRs Coverage allocation in multi-year, continuing loss cases, including horizontal and vertical exhaustion, stacking, and and“all sumsand” Application and features of judicial remedies of declaratory relief and intervention Insurance Practices and Coverage in Liability Defense, Second Edition is the book that combines practice and theory, that serves both the insurer and insured, the national practitioner and the local counsel, and informs courts where concurrence and divergence exist on the sometimes thorny, interrelated issues.

Available in PDF, EPUB and Kindle. Book excerpt: Contrary to warnings about the dangers of populism, Donald F. Critchlow argues that grassroots activism is essential to party renewal within a democratic system. Grassroots activism, presenting a cacophony of voices calling for reform of various sorts without programmatic coherence, is often derided as populist and distrusted by both political parties and voters. But according to Donald T. Critchlow, grassroots movements are actually responsible for political party transformation, both Democratic and Republic, into instruments of reform that reflect the interests, concerns, and anxieties of the electorate. Contrary to popular discourse warning about the dangers of populism, Critchlow argues that grassroots activism is essential to party renewal within a democratic system. In Defense of Populism examines movements that influenced Republican, Democratic, and third-party politics—from the Progressives and their influence on Teddy Roosevelt, to New Dealers and FDR, to the civil rights, feminist, and environmental movements and their impact on the Democratic Party, to the Reagan Revolution and the Tea Party. In each case, Critchlow narrates representative biographies of activists, party leaders, and presidents to show how movements become viable calls for reform that get translated into policy positions. Social tensions and political polarization continue to be prevalent today. Increased social disorder and populist outcry are expected whenever political elites and distant bureaucratic government are challenged. In Defense of Populism shows how, as a result of grassroots activism and political-party reform, policy advances are made, a sense of national confidence is restored, and the belief that American democracy works in the midst of crisis is affirmed.
