Book excerpt: Concerns "Thomas C. Browne who was born in Kentucky c. 1794, and practiced law prior to moving to Shawneetown, Illinois in 1824. In Illinois, he served as a member of the 2nd and 3rd territorial legislatures. After Illinois became a state in 1818, the state legislature appointed Browne as one of the Illinois Supreme Court's four justices. In 1841, the legislature divided Illinois into nine circuits, and each of the justices on the expanded supreme court held court in one of the circuits. Browne was responsible for the 6th Judicial Circuit. In 1843, four members of the bar from Galena, Illinois, petitioned the Illinois House of Representatives for the removal of Browne as judge of the 6th Judicial Circuit for incompetence, but Abraham Lincoln, as attorney for Browne, successfully argued to have the charges dropped. Browne held his seat on the bench until 1848, when a new state constitution reduced the number of justices from nine to three. Justice Browne died in San Francisco, c. 1858" -- from Supreme Court website.

Book excerpt: In the tradition of bestselling legal memoirs from Johnnie Cochran, F. Lee Bailey, Gerry Spence, and Alan Dershowitz, John Henry Browne's memoir, The Devil's Defender, recounts his tortuous education in what it means to be an advocate—and a human being. For the last four decades, Browne has defended the indefensible. From Facebook folk hero "the Barefoot Bandit" Colton Moore, to Benjamin Ng of the Wah Mee massacre, to Kandahar massacre culprit Sgt. Robert Bales, Browne's unceasing advocacy and the daring to take on some of the most unwinnable cases—and nearly win them all—has led 48 Hours' Peter Van Sant to call him "the most famous lawyer in America." But although the Browne that America has come to know cuts a dashing and confident figure, he has forever been haunted by his job as counsel to Ted Bundy, the most famous serial killer in American history. A drug- and alcohol-addicted (yet wildly successful) defense attorney who could never let go of the case that started it all, Browne here asks of himself the question others have asked him all along: does defending evil make you evil, too?

Available in PDF, EPUB and Kindle. Book excerpt: 2004 marks the fiftieth anniversary of the Supreme Court's unanimous decision to end segregation in public schools. Many people were elated when Supreme Court Chief Justice Earl Warren delivered Brown v. Board of Education of Topeka in May 1954, the ruling that struck down state-sponsored racial segregation in America's public schools. Thurgood Marshall, chief attorney for the black families that launched the litigation, exclaimed later, "I was so happy, I was numb." The novelist Ralph Ellison wrote, "another battle of the Civil War has been won. The rest is up to us and I'm very glad. What a wonderful world of possibilities are unfolded for the children!" Here, in a concise, moving narrative, Bancroft Prize-winning historian James T. Patterson takes readers through the dramatic case and its fifty-year aftermath. A wide range of characters animates the story, from the little-known African Americans who dared to challenge Jim Crow with lawsuits (at great personal cost); to Thurgood Marshall, who later became a Justice himself; to Earl Warren, who shepherded a fractured Court to a unanimous decision. Others include segregationist politicians like Governor Orval Faubus of Arkansas; Presidents Eisenhower, Johnson, and Nixon; and controversial Supreme Court justices such as William Rehnquist and Clarence Thomas. Most Americans still see Brown as a triumph--but was it? Patterson shrewdly explores the provocative questions that still swirl around the case. Could the Court--or President Eisenhower--have done more to ensure compliance with Brown? Did the decision touch off the modern civil rights movement? How useful are court-ordered busing and affirmative action against racial segregation? To what extent has racial mixing affected the academic achievement of black children? Where indeed do we go from here to realize the expectations of Marshall, Ellison, and others in 1954?

Book excerpt: Winner, ISHS Superior Achievement Award for a Scholarly Publication, 2016 A concise legal history of Illinois through the end of the nineteenth century, Prairie Justice covers the region’s progression from French to British to early American legal systems, which culminated in a unique body of Illinois law that has influenced other jurisdictions. Written by Roger L. Severns in the 1950s and published in serial form in the 1960s, Prairie Justice is available now for the first time as a book, thanks to the work of editor John A. Lupton, an Illinois and legal historian who also contributed an introduction. Illinois’ legal development demonstrates the tension between two completely different European legal systems, between river communities and prairie towns, and between agrarian and urban interests. Severns uses several rulings—including a reconstitution of the Supreme Court in 1824, slavery-related cases, and the impeachment of a Supreme Court justice—to examine political movements in Illinois and their impact on the local judiciary. Through legal decisions, the Illinois judiciary became an independent, co-equal branch of state government. By the mid-nineteenth century, Illinois had established itself as a leading judicial authority, influencing not only the growing western frontier but also the industrialized and farming regions of the country. With a close eye for detail, Severns reviews the status of the legal profession during the 1850s by looking new members of the Court, the nostalgia of circuit riding, and how a young lawyer named Abraham Lincoln rose to prominence. Illinois has a rich judicial history, but that history has not been adequately documented until now. With the publication of Prairie Justice, those interested in Illinois legal history finally have a book that covers the development of the state’s judiciary in its formative years.

Available in PDF, EPUB and Kindle. Book excerpt: Winner, ISHS Superior Achievement Award, 2016 Although they inhabited different political, social, and cultural arenas, Abraham Lincoln and the pioneer generation of Latter-day Saints, or Mormons, shared the same nineteenth-century world. Bryon C. Andreasen’s Looking for Lincoln in Illinois: Lincoln and Mormon Country relates more than thirty fascinating and surprising stories that show how the lives of Lincoln and the Mormons intersected. This richly illustrated and carefully researched book expands on some of the storyboards found on the Looking for Lincoln Story Trail, from the Mormon capital of Nauvoo to the state capital of Springfield. Created by the Looking for Lincoln Heritage Coalition, this trail consists of wayside exhibits posted in sites of significance to Lincoln’s life and career across fifty-two communities in Illinois. The book’s keyed maps, historic photos, and descriptions of battles, Mormon expeditions, and events at inns, federal buildings, and even Lincoln’s first Illinois log cabin connect the stories to their physical locations. Exploring the intriguing question of whether Lincoln and Mormon founder Joseph Smith ever met, the book reveals that they traveled the same routes and likely stayed at the same inns. The book also includes colorful and engaging looks at key figures such as Brigham Young, various Mormon apostles, and more. Anyone inspired by Lincoln, as well as Mormon and Illinois history enthusiasts, will appreciate this look back at a long-past, but not forgotten, landscape.

Available in PDF, EPUB and Kindle. Book excerpt: What do Jon Stewart, Freddy Krueger, Patch Adams, and George W. Bush have in common? As Paul Lewis shows in Cracking Up, they are all among the ranks of joke tellers who aim to do much more than simply amuse. Exploring topics that range from the sadistic mockery of Abu Ghraib prison guards to New Age platitudes about the healing power of laughter, from jokes used to ridicule the possibility of global climate change to the heartwarming performances of hospital clowns, Lewis demonstrates that over the past thirty years American humor has become increasingly purposeful and embattled. Navigating this contentious world of controversial, manipulative, and disturbing laughter, Cracking Up argues that the good news about American humor in our time—that it is delightful, relaxing, and distracting—is also the bad news. In a culture that both enjoys and quarrels about jokes, humor expresses our most nurturing and hurtful impulses, informs and misinforms us, and exposes as well as covers up the shortcomings of our leaders. Wondering what’s so funny about a culture determined to laugh at problems it prefers not to face, Lewis reveals connections between such seemingly unrelated jokers as Norman Cousins, Hannibal Lecter, Rush Limbaugh, Garry Trudeau, Jay Leno, Ronald Reagan, Beavis and Butt-Head, and Bill Clinton. The result is a surprising, alarming, and at times hilarious argument that will appeal to anyone interested in the ways humor is changing our cultural and political landscapes.
