Book excerpt: This book presents an attempt to empirically test the explanatory power of procedural models which were designed for European Union legislative decision-making. After outlining the research questions and presenting different existing models which have been put forward to enhance our understanding of how the EU works and how legislation is being negotiated by the political actors within this organization, I first introduced the European policy process by comparing it to the legislative process in the United States. I then compared the different procedural models in terms of the assumptions which they make regarding the sequence of play, actors’ decision weight, and the dimensionality of the policy space. Computer simulation techniques were employed to evaluate the effect changes of different model parameters, such as the number of players, the decision rule, and the dimensionality of decision making. The objective of this chapter was to assess how stable the models are against changes that affect parameters other than agenda-setting and amendment power.

Stability of decisions is analysed both in terms of a risk of decision cycles and in terms of the frequency of gridlock situations. The risk of such 'chaotic' decisions depends on three parameters, the applied decision rules, the dimensionality of the conflict space and the heterogeneity of actor preferences. Dietrich Drner uses the concepts of the core and the winset, which stem from spatial voting and veto players theory and which incorporate the three parameters. Testing these concepts against a data set about 70 legislative proposals, Dietrich Drner generates empirical findings about the impacts of enlargement and institutional reform on the EU's decision-making processes. Book excerpt: Studying the member states' constitutional choice of European decision rules most power index analyses concentrate on the relative decisiveness of member states in the Council of Minister. However, this emphasis has two shortcomings: First, it ignores the interaction between the Commission, the Council of Ministers and the European Parliament which provides multi-cameral decision making for European legislation. Second, although relative decisiveness is applied to the measurement of the member states' (expected) distribution of legislative gains, it does not take into account the member states' expectation of the extent of gains depending on their absolute inclusiveness. In this article we present a model of member states' constitutional choice of European decision rules with regard to the two notions of power: actors' relative decisiveness and their absolute inclusiveness in decision making. We present an index to measure inclusiveness and we apply our concept to European multi-cameral procedures. Hereby, we give an account for the member states' recent reforms of legislative procedures.
