Book excerpt: How have we thought “the body”? How can we think it anew? The body of mortal creatures, the body politic, the body of letters and of laws, the “mystical body of Christ”—all these (and others) are incorporated in the word Corpus, the title and topic of Jean-Luc Nancy’s masterwork. Corpus is a work of literary force at once phenomenological, sociological, theological, and philosophical in its multiple orientations and approaches. In thirty-six brief sections, Nancy offers us at once an encyclopedia and a polemical program—reviewing classical takes on the “corpus” from Plato, Aristotle, and Saint Paul to Descartes, Hegel, Husserl, and Freud, while demonstrating that the mutations (technological, biological, and political) of our own culture have given rise to the need for a new understanding of the body. He not only tells the story of this cultural change but also explores the promise and responsibilities that such a new understanding entails. The long-awaited English translation is a bold, bravura rendering. To the title essay are added five closely related recent pieces—including a commentary by Antonia Birnbaum—dedicated in large part to the legacy of the “mind-body problem” formulated by Descartes and the challenge it poses to rethinking the ancient problems of the corpus. The last and most poignant of these essays is “The Intruder,” Nancy’s philosophical meditation on his heart transplant. The book also serves as the opening move in Nancy’s larger project called “The deconstruction of Christianity.”

Available in PDF, EPUB and Kindle. Book excerpt: This book offers perspectives on the legal and intellectual developments of the twelfth century. Gratian's collection of Church law, the Decretum, was a key text in these developments. Compiled in around 1140, it remained a fundamental work throughout and beyond the Middle Ages. Until now, the many mysteries surrounding the creation of the Decretum have remained unsolved, thereby hampering exploration of the jurisprudential renaissance of the twelfth century. Professor Winroth has now discovered the original version of the Decretum, which has long lain unnoticed among medieval manuscripts, in a version about half as long as the final text. It is also different from the final version in many respects - for example, with regard to the use of of Roman law sources - enabling a reconsideration of the resurgence of law in the twelfth century.

Book excerpt: The Historical Foundations of Grotius’ Analysis of Delict explores the origins of a generalised model of liability for wrongdoing in the history of European private law. Using Grotius as its focal point, it analyses the extent to which earlier civilian and theological doctrine shaped his views. It divides Grotius’ approach into three elements – the infringement of a right, fault, and remediation – and traces the development of parallel concepts in earlier traditions. It argues that Grotius was influenced by the writings of Thomists to a far greater extent than has previously been acknowledged, virtually eclipsing any sign of civilian influence except where Romanist learning had already been incorporated into theological doctrine.

Book excerpt: Homosexuality continues to be a much debated subject in church and society. Many people use the Bible to form their opinions on gay marriage, gays in the church, etc. In Out of Order, Dr. Wold thoroughly examines the biblical references to homosexuality while at the same time explaining the nature of same-sex relations in the ancient Near East. The author states: "What is needed in the current debate regarding the Bible and homosexuality is a spirit of reconciliation rather than condemnation or confrontation on the part of all who address this issue."

Available in PDF, EPUB and Kindle. Book excerpt: This volume publishes the proceedings of the eleventh annual University of Chicago Oriental Institute Seminar. Its central goal is to present a cross-cultural study of the intersection between law and gender relations in the ancient world, with a focus on the ancient Near East. When reflecting upon the formation, perpetuation, and interactions of social structures that frequently come into conflict with each other, one discovers that gender constructs are used by mechanisms of social monitoring and control; structures of power. One such example is the realm of jurisdiction and legislation. This volume uses the sphere of legal institutions as a prism through which to consider gender relations in the ancient world, both in the Near East and beyond. The way in which similar issues were manifested in different cultural and historical contexts is examined, with the goal of identifying common denominators as well as particularities. The three themes discussed in this volume are examined through multiple historical-cultural examples.

Book excerpt: Karl Valentin once asked: "How can it be that only as much happens as fits into the newspaper the next day?" He focussed on the problem that information of the past has to be organised, arranged and above all: selected and put into form in order to be perceived as a whole. In this sense, the process of selection must be seen as the fundamental moment – the “Urszene” – of making History. This book shows selection as highly creative act. With the richness of early medieval material it can be demonstrated that creative selection was omnipresent and took place even in unexpected text genres. The book demonstrates the variety how premodern authors dealt with "unimportant", unpleasant or unwanted past. It provides a general overview for regions and text genres in early medieval Europe.
