Available in PDF, EPUB and Kindle. Book excerpt: The goal of the present study unfolds in the following four ways. First, in analyzing Pauline writings (primarily Paul’s First Letter to the Corinthians) it can be demonstrated that the Apostle can be described as an ethicist. The hypothesis operative here is that in the sources, despite their occasional and situational character and their epistolary form, one can recognize a coherent system of grounds for behavior (i.e., ethics). I call this recognizable ethics “implicit ethics.” Secondly, this work pursues an explicit ethical interpretation of Paul’s writings. What does it mean to read these texts through an ethical lens? I here offer an approach with which one can decipher the ethical content of a historical text. This methodology for ethical analysis (so called ‘organon’) is not only applicable to Paul’s writings, but can also provide an impetus for the ethical interpretation of other NT texts and even for the literature of early Christianity and the Bible more generally. The variety of forms and the complexity of the reflection in Paul’s letters can, in a third point, enrich the discourse of theological ethics. It will be seen, that the rationale for his ethics is pluralistic and simply cannot be described in a one-sided manner as simply being a “deontological ethics of norms.” Along these lines, a fourth element is found in stimulating interdisciplinary debates concerning ethics. If one is able to examine and describe the norms and grounds of justification in Biblical ethics using the language and forms of description utilized in modern ethical theory, biblical ethics could once again gain a voice that can be taken seriously in the modern discussion of values. The point is not to have Scripture per se join the discussion but for these texts to function as a “laboratory” (Paul Ricoeur) in which ethical speech and thought relevant for contemporary concerns can be inspired and encouraged. In a concluding chapter this dialogue is already started by describing specific aspects of Pauline ethics against the background or moral philosophical debate, e.g. “bodily ethics – beyond hedonism”, “ethics of relinquishing – beyond contractual ethics” or “ethics of love beyond Eudaimonian ethics”.

Available in PDF, EPUB and Kindle. Book excerpt: This book critically examines the conception of legal science and the nature of law developed by Hans Kelsen. It provides a single, dedicated space for a range of established European scholars to engage with the influential work of this Austrian jurist, legal philosopher, and political philosopher. The introduction provides a thematization of the Kelsenian notion of law as a legal science. Divided into six parts, the chapter contributions feature distinct levels of analysis. Overall, the structure of the book provides a sustained reflection upon central aspects of Kelsenian legal science and the nature of law. Parts one and two examine the validity of the project of Kelsenian legal science with particular reference to the social fact thesis, the notion of a science of positive law and the specifically Kelsenian concept of the basic norm (Grundnorm). The next three parts engage in a critical analysis of the relationship of Kelsenian legal science to constitutionalism, practical reason, and human rights. The last part involves an examination of the continued pertinence of Kelsenian legal science as a theory of the nature of law with a particular focus upon contemporary non-positivist theories of law. The conclusion discusses the increasing distance of contemporary theories of legal positivism from a Kelsenian notion of legal science in its consideration of the nature of law.

Book excerpt: This book presents the theory of the validity of legal norms, aimed at the practice of law, in particular the jurisdiction of the constitutional courts. The postpositivist concept of the validity of statutory law, grounded on a critical analysis of the basic theories of legal validity elaborated up to now, is introduced. In the first part of the book a contemporary German nonpositivist conception of law developed by Ralf Dreier and Robert Alexy is analysed in order to answer the question whether the juristic concept of legal validity should include moral standards or criteria. In the second part, a postpositivist concept of legal validity and an innovative model of validity discourse, based on the juristic presumption of the validity of legal norms, are proposed. The book is a work on analytical legal theory, written from a postpositivist, detached point of view.

Available in PDF, EPUB and Kindle. Book excerpt: This book features essays that investigate the nature of legal validity from the point of view of different traditions and disciplines. Validity is a fascinating and elusive characteristic of law that in itself deserves to be explored, but further investigation is made more acute and necessary by the production, nowadays, of soft law products of regulation, such as declarations, self-regulatory codes, and standardization norms. These types of rules may not exhibit the characteristics of formal law, and may lack full formal validity but yet may have a very real impact on people's lives. The essays focus on the structural properties of hard and soft legal phenomena and the basis of their validity. Some propose to redefine validity: to allow for multiple concepts instead of one and/or to allow for a gradual concept of validity. Others seek to analyze the new situation by linking it to familiar historical debates and well-established theories of law. In addition, coverage looks at the functions of validity itself. The discussion considers both international law as well as domestic law arrangements. What does it mean to say that something is valid? Should we discard validity as the determining aspect of law? If so, what does this mean for our concept of law? Should we differentiate between kinds of validity? Or, can we say that rules can be "more" or "less" valid? After reading this book, practitioners, scholars and students will have a nuanced understanding of these questions and more. They contain contributions of several well-known authors, and their aim is to present a selective overview of a relevant field of study. This book has the same purpose. Its aim is to introduce students, scholars and all those interested in current problems of legal theory and legal philosophy to the work of the leading scholars in this field. The large number of publications, both books and articles, that have been produced over recent decades makes it quite difficult, however, for those who are making their first steps in this domain to find firm guidelines. The book is new in its genre because of its method. The choice was made not to reprint an example of contributors' earlier basic articles or a part of one of their books. This would only give a partial view of the rich texture of their work. Rather, the authors were asked to make an original synthesis of their own contributions to the field of legal theory and legal philosophy. Brought together in this volume, they constitute a truly author-ised view of their work. This book is also new in that each essay is complemented with bibliographical information in order to encourage further research on the author's self-selected work. This will help the reader rapidly to become familiar with the whole of the published work of the contributors.
