Denn: Europa rückt zusammen. Immer öfter bekommt der Bürger den langen Arm Brüssels zu spüren. Bestes Beispiel: Die Einführung der einheitlichen Währung, des Euros. Rund 80 Prozent aller auf den Binnenmarkt bezogenen Entscheidungen sind einigen Schätzungen nach mittlerweile in EU bzw. EG-Recht übergegangen. Ein weiteres Exempel sind die Urteile des Europäischen Gerichtshofes: Sie sind für die Mitgliedsstaaten bindend und müssen national umgesetzt werden. Ein prominentes Beispiel etwa die Entscheidung zur Gleichstellung von Frauen und Männern beim Zugang zum Dienst in den Streitkräften. In einer Pressemitteilung des EUGH vom 7. Januar 2000 heißt es dazu wörtlich: „Die deutschen Rechtsvorschriften, die Frauen vollständig vom Dienst mit der Waffe ausschließen, verstoßen gegen den gemeinschaftsrechtlichen Grundsatz der Gleichheit von Männern und Frauen.“ (EU Homepage 2002) Europäisches Recht bricht nationales Recht, die Bundesrepublik Deutschland musste sich der europäischen Rechtsprechung fügen. In den Mitgliedstaaten steht das Parlament als ein Repräsentationsorgan des Volkes im Mittelpunkt des Legitimationsprozesses von Regierungsgewalt. Es läge also eigentlich nah, dem Europäischen Parlament als einzigem, unmittelbar durch Wahlen vom europäischen Volk direkt legitimierten Organ diese Rolle auf europäischer Ebene zu unterstellen. Anscheinend nicht, denn nicht nur in der politikwissenschaftlichen Fachliteratur wird zumindest mit Fragezeichen versehen über das sogenannte „Demokratiedefizit der Europäischen Union“ diskutiert (vgl. z.B. Pfetsch 1997, Lord 1998 oder Schmidt 2000). Doch auch in den Medien und nicht zuletzt im Hinblick auf die aktuelle Verfassungsdebatte wird dieses Thema immer wieder kontrovers diskutiert. Die Legitimation einer zunehmenden Anhäufung von Rechtsetzungsbefugnissen zu Gunsten der EU, (und damit gleichzeitig zu Lasten der nationalen Parlamenten), ist gemessen an den, in den Mitgliedstaaten üblichen demokratiepolitischen Standards, also zumindest streitbar. In dieser Hausarbeit werde ich mich daher mit folgenden Fragen beschäftigen: Gibt es ein Demokratiedefizit in der Europäischen Union? Und in diesem Zusammenhang: Welches Legitimationspotential bietet das Europäische Parlament?

Moreover, the elections were expected to raise public interest, engagement and support for the European project. Did these elections help to increase legitimacy and accountability? Did they increase interest in and support for the 'European project'? Or, did these elections have unintended (and perhaps undesirable) consequences? This volume focuses on the consequences of European elections for public debate and involvement, for party systems, and for public opinion. EP elections have caused a number of intended consequences: the salience of the elections in the media has gone up and over time electoral competition becomes more important, engaging in the campaign can help improve EU evaluations, and Europe as a topic has become more important for voting at EP elections, boosting the prevalence of so-called EU voting. A number of intended consequences have not materialized during the life of the EP so far: knowledge or turnout levels have not gone up and citizens have not become better at judging what political parties are offering. The EP elections have, however, also yielded a number of unintended consequences: EP elections dampen turnout for first time voters in subsequent elections, EP elections cause temporary decline in EU support, and the elections have become a strategic arena for political parties to position themselves on EU issues and for new movements and parties to boost or sustain their success.

Seine Aufgabe war es, Vorschläge für eine Verfassung und Reformen zu erarbeiten, damit die Union für zukünftige Herausforderungen, insbesondere in Hinblick auf die Osterweiterung, handlungsfähig bleibt und diese bewältigen kann. Und soll der fortdauernde vertiefende Integrationsprozess erfolgreich sein, sind Reformen dringend notwendig. All zu oft bleiben nämlich die 370 Millionen Bürger der Gemeinschaft außen vor und werden vor vollendete Tatsachen gestellt. Mehr denn je stehen sie dem EU-System und seinen Auswirkungen kritisch oder zum Teil sogar ablehnend gegenüber. Die Einführung des Euro oder die EU-Osterweiterung sind Entwicklungen, die die Menschen direkt betreffen, aber zumeist über ihre Köpfe hinweg entschieden werden und somit Skepsis und fehlende Akzeptanz hervorrufen. Dies weist auf ein grundlegendes Problem des EU-Apparates hin: Ihm fehlt es grundsätzlich an ausreichend demokratischer Legitimität. Hinzu kommt die mangelnde Transparenz der politischen Entscheidungsprozesse und die damit verbundene schwer nachzuvollziehende Verantwortlichkeit der Entscheidungsträger. Diesen Kritikpunkten wurde in der wissenschaftlichen Literatur stets immer mehr Aufmerksamkeit geschenkt. Mit dem Begriff „Demokratie-Defizit“ wird die unzureichend vorhandene parlamentarische Einbindung in europäische Rechtsakte und die damit verbundene fehlende Legitimation der Entscheidungen beschrieben. Im Mittelpunkt aller Betrachtungen steht das Europäische Parlament (EP), welches als einziges Organ von den Bürgern direkt gewählt ist. Dennoch ist es neben der Kommission und dem Ministerrat das schwächste Gremium im Gesetzgebungsprozess. Der Rat der Union hat die größten Vollmachten, ist aber über die Vertreter der Mitgliedstaaten nur indirekt legitimiert, während die Kommission gar keinem Votum der Wähler unterliegt. Obwohl das EP in seiner Entwicklung stets an Kompetenzen gewonnen hat und nun auch über Einfluss in der Gesetzgebung verfügt, so ist es jedoch oft kaum imstande die Aufmerksamkeit der Öffentlichkeit und somit das Interesse für seine Arbeit auf sich zu ziehen und die Einstellungen der Bürger widerzuspiegeln.
