They claim that diversity is linked to insecurity because, from one country to another, the sanction for the same crime varies considerably. Several years' experience has shown in cases of transborder crimes, that the development of mutual assistance pacts improves the efficiency of the national systems. Beyond that, it seems inevitable that at least in the area of frauds against Community financial interests, we will arrive at a system of Community penal and administrative sanctions to meet the demand of the European Parliament, on the condition that the sanctions respect the democratic principles of legality and an independent judiciary. Starting from the plurality of European legal sources (Community law, the Conventions of the Council of Europe, the Schengen Accords, the Conference on Security and Cooperation) and their underlying logic (national interests European interests, security/protection of the fundamental rights), this volume examines their impact on the subjects of the Maastricht Treaty. This mildness, which has been reflected for example in a strikingly low prison rate has both impressed and shocked foreign criminal law scholars and criminal justice officials. This traditional mildness is now at stake. Crime has increased considerably and so has the prison rate. Major changes have taken place in Dutch society, and these require a new criminal justice policy. In 1985 the Minister of Justice submitted to the Parliament a new policy plan called Society and Crime, and a policy plan called Law in Motion was published in 1990. These new criminal policy plans propose a step-by-step approach in order to raise the level of criminal law enforcement and to intensify crime prevention. The statutory powers of the police to investigate organized crime will be expanded, the efficiency of the prosecution service will be improved, the capacity of prisons will be increased, and crime prevention programmes will be intensified. Whether the relative mildness of the Dutch criminal justice system will be maintained in the future or not, is a difficult question to answer. However, since the mildness is built into the system itself (as is demonstrated in this criminal justice profile) it is most probable that this mildness will be at least partly preserved in the future as well.

Currently, organised crime reports primarily generate descriptive analyses of a past situation based on law enforcement data and do not always provide the necessary information for proactive and preventive policy strategies. Therefore an EU Action Plan has been issued to develop a more future oriented and risk based methodology for the measurement of organised crime and to convert the traditional organised crime situation reports into strategic reports for planning purposes. This book is the outcome of two studies undertaken by a team composed of Belgian, Italian and Swedish researchers for the European Commission. It presents an overview of current practices in the measurement of organised crime in Europe and includes a discussion about the concept and the assessment of the impact of the phenomenon. Further the feasibility of the implementation of the existing EU Action Plan was studied and evaluated. As a result of applied research Measuring Organised Crime in Europe provides an in depth and comparative analysis of current practice in drafting organised crime reports across and by the EU and offers new ideas to improve their quality.
