This book explores its development and analyses the penological and human rights foundations on which it is based. It examines the findings of the European Committee for the Prevention of Torture, the recommendations of the Council of Europe, and the judgments of the European Court of Human Rights. From these sources it makes the general principles that underlie European prison law and policy explicit, emphasising the principle of using imprisonment as a last resort and the recognition of prisoners' rights. The book then moves on to apply these principles to conditions of imprisonment, regimes in prison, contacts between prisoners and the outside world, and the maintenance of good order in prisons. The final chapter of the book considers how European prison law and policy could best be advanced in future. The authors argue that the European Court of Human Rights should adopt a more proactive approach to ensuring that imprisonment is used only as a last resort, and that a more radical interpretation of the existing provisions of the European Convention on Human Rights will allow it to do so. It concludes that the growing cooperation on prison matters within Europe bodes well for the increased recognition of prisoners' rights across Europe. In spite of some countervailing voices, Europe should increasingly be able to give an international lead in a human rights approach to prison law and policy in the same way it has done with the abolition of the death penalty.

Book excerpt: The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. Part One contains information on ratifications and other such issues in the authentic English and French texts. Part Two has details in English and French of the membership and activities of the Convention. Part Three reprints the twenty-first annual General Report of the ECPT in the official English and French texts. Book excerpt: Conflicted Commitments analyzes a form of non-violent, direct transnational solidarity in which activists from the global North travel to support and protect people in the global South. Gada Mahrouse contends that this brand of activism is a compelling site of racialized power relations and is highly instructive for a nuanced understanding of systems of race. Mahrouse argues that the individuals who partake in this form of activism consciously deploy their white, western privilege to offer support and protection to those facing threats of violence. Moreover, given that this type of activism asserts itself as an exemplary form of anti-racist commitment, it illustrates that well-meaning practices can inadvertently reproduce racialized power structures that are embedded in imperial and colonial legacies. Mahrouse focuses on Palestine and Iraq in the post-9/11 era to contemplate the contemporary challenges that these regions pose for solidarity activism. By exploring how individual activists manage and negotiate their dominant positioning in these encounters, Mahrouse reflects more broadly on the ethics of social justice strategies in an increasingly transnational world. A detailed study of the racialized complexities and contradictions inherent in transnational solidarity activism, Conflicted Commitments makes a significant contribution to critical race and feminist studies.

It summarises progress on initiatives including the development of public-private partnerships in TB control, human resource development, the management of drug-resistant TB, and collaborations in TB and HIV/AIDS control. Findings include that in 2005, there were 8.8 million new cases of TB, and an estimated 1.6 million deaths from TB including those co-infected with HIV. The TB incidence rate was stable or falling in all six WHO regions and had reached a peak worldwide. However, the total number of new TB cases was still rising slowly, because the case-load continued to grow in the African, Eastern Mediterranean and South-east Asia regions.

Since its inception in 1989, specialist members of the CPT (lawyers, prosecutors, prison experts, doctors, psychiatrists, etc.) have visited thousands of police stations, prisons, immigration detention centres, psychiatric hospitals and other places of detention all over Europe, to monitor the living conditions (hygiene, provision of food and drink, health care, etc.) of those being detained. Following these visits, the CPT issues reports suggesting improvements and laying down standards. The purpose of this book is twofold. In the first part, the authors explain the background and origins of the CPT, its membership and modus operandi, as well as how it interacts with other bodies, such as the UN’s Subcommittee on Prevention of Torture (SPT) and the national preventive mechanisms (NPMs). In the second part, the authors describe the CPT’s key findings and standards in the main situations of deprivation of liberty (police, prison, immigration detention, mental health and social care). In a detailed appendix, the authors provide summaries of the key CPT findings for the 47 states visited by the CPT.
