Book excerpt: In order to address housing needs of Fed. district courts and related agencies, the Fed. government's multibillion courthouse construction initiative includes plans to construct hundreds of new district judge trial courtrooms to replace existing ones and accommodate increases in Fed. judgeships. In response to increasing concerns that courtrooms may be underutilized and that more costly courtrooms than needed may have been and are continuing to be built, this report compiles data to determine how often and for what purposes courtrooms are used and examines steps the judiciary is taking to assess space and usage issues.

Book excerpt: "The federal judiciary and the General Services Administration (GSA) are in the midst of a multibillion-dollar courthouse construction initiative, which has since faced rising construction costs. As requested, for 33 federal courthouses completed since 2000, GAO examined (1) whether they contain extra space and any costs related to it; (2) how their actual size compares with the congressionally authorized size; (3) how their space based on the judiciary's 10-year estimates of judges compares with the actual number of judges; and (4) whether the level of courtroom sharing supported by the judiciary's data could have changed the amount of space needed in these courthouses. GAO analyzed courthouse planning and use data, visited courthouses, modeled courtroom sharing scenarios, and interviewed judges, GSA officials, and other experts. "

Book excerpt: The judiciary is in the midst of a multibillion-dollar courthouse construction initiative to accommodate new judgeships created because of increasing caseloads and to replace obsolete courthouses occupied by existing judges. This report reviews and comments on part of the May 2000 Ernst and Young study on the judiciary's space and facilities program. Specifically, it reviews the study as it relates to courtroom use and sharing. Certain key stakeholders outside the judiciary -- various subcommittees and Members of Congress as well as the Office of Management and Budget -- believe that courtroom sharing may be possible and could lead to cost savings.

Book excerpt: The federal judiciary and the General Services Administration (GSA) are in the midst of a multibillion-dollar courthouse construction initiative, which began in the early 1990s and has since faced rising construction costs. As requested, for 33 federal courthouses completed since 2000, GAO examined (1) whether they contain extra space and any costs related to it, (2) how their actual size compares with the congressionally authorized size, (3) how their space based on the judiciarys 10-year estimates of judges compares with the actual number of judges, and (4) whether the level of courtroom sharing supported by the judiciary's data could have changed the amount of space needed in these courthouses. GAO analyzed courthouse planning and use data, visited courthouses, modeled courtroom sharing scenarios, and interviewed judges, GSA officials, and other experts. The findings in this testimony are preliminary because the federal judiciary and GSA are still in the process of commenting on GAOs draft report and did not provide comments on this testimony.

In addition, the Committee tasked GAO with reviewing the Federal Judicial Center's (FJC) empirical study of courtroom use to determine the level of courtroom sharing supported by the FJC's data. The purpose of today's hearing is to examine the initial findings of the GAO draft report [Better planning, oversight, and courtroom sharing needed to address future costs] and give the Judiciary and GSA the opportunity to respond to the findings in the GAO draft report."--P. vii.

Book excerpt: " During the last 20 years, GSA built 79 new courthouses for the judiciary that replaced or supplemented 66 old courthouses. Retaining and re-using or disposing old courthouses can be challenging for GSA because many of them are more than 80 years old, do not meet current court security standards, and have historic features that must be preserved by federal agencies in accordance with historic preservation requirements. GAO was asked to review how GSA and the judiciary are planning and managing the reuse or disposal of old courthouses. GAO examined (1) how the government is re-using old courthouses that were retained and the challenges involved; (2) how GSA disposed of old courthouses, the process involved, and the results; and (3) the extent to which GSA's proposals for new courthouses considered the future use of old courthouses. As case studies, we selected 17 old courthouses to represent a mix of retained and disposed buildings located in geographically diverse areas. "
