Book excerpt: Concerned about evidence distortion arising from litigants' strong incentive to misrepresent information to fact-finders, legal scholars and commentators have long suggested that the court appoint its own advisor for a neutral piece of information about the dispute. This paper studies the incentive problem faced by the litigants when the judge seeks advice from the court-appointed expert. Within a standard litigation game framework, we find a trade-off in utilizing the court-appointed expert: although it helps the judge obtain more information overall, thereby reducing the number of mistakes at trial, it hampers the litigants' incentive to supply expert information, which undermines the adversarial nature of the current American legal system.

Book excerpt: Faced with increasingly complex cases, the International Court of Justice has come under criticism for failing to appoint neutral experts to assist the Court under Article 50 of its Statute. After examining the limited use of court-appointed experts by the ICJ and its predecessor, the Permanent Court of International Justice, this article argues that increased recourse to expert knowledge under Article 50 would result in a delegation of the judicial function to unaccountable experts. Acknowledging the demands of technically complex cases, the article evaluates three different methods adopted by other international tribunals, under the auspices of the WTO, ECJ, UNCC, WIPO, UNCLOS and PRIME Finance. Considering the institutional specificities of the ICJ, the article concludes by advocating the adoption of a new form of pre-trial procedure involving co-operation with specialist international organisations: this could be accomplished under an amended version of the Rules, which would limit provision for expert consultation to that necessary to determine the facts pertinent to the selection and application of the rules of law necessary for the Court to perform its function in the case at hand.

The Panel on Statistical Assessments as Evi dence in the Courts was convened to help clarify these issues and provide some guidance in addressing the difficulties encountered in the use of quan titative assessments in legal proceedings. This report is the culmination of more than three years of research and deliberation. In it, we address a variety of issues that arise in federal and state court proceedings when statistical assessments such as quantitative descriptions, causal inferences, and predictions of events based on earlier occurrences are presented as evidence. We appraise the forms in which such assessments are presented, aspects of their admission into evidence, and the response to and evaluation of them by judges and juries.

Book excerpt: In this study, I investigated whether two modifications of the proposed safeguards, a court-appointed (non-adversarial) opposing expert and a jury instruction on how to evaluate scientific evidence, would sensitize jurors to variations in scientific evidence. I hypothesized that when the opposing expert is court-appointed and evaluates scientific method, jurors will be able to distinguish between valid and flawed evidence but will not make this distinction when the opposing expert is adversarial. Results of this study were consistent with a sensitivity effect. When the court-appointed expert evaluated the method of the initial expert's research, jurors rated the validity of the original expert's research to be higher when it was valid than when its method had a threat to internal validity. When juries instructed jurors on how to evaluate scientific evidence, jurors rated the invalid and valid science equally. Overall, these results suggest that court-appointed experts would be more likely to assist jurors evaluate scientific evidence than adversarial opposing experts.

However, it may be hard for a jury to determine at trial which expert economist is more credible, and it may be hard for the judge to determine at the Daubert hearing whether the methodology upon which a given expert economist relies is intellectually rigorous enough to produce results that constitute admissible testimony. One solution rarely employed is for the court to appoint its own neutral economic expert under Rule 706 of the Federal Rules of Evidence when a lawsuit contains a claim for damages that will require rigorous analysis of data. Based on my recent experience as Judge Richard Posner's court appointed economic expert on damages in patent infringement litigation, I explain how the wider use of Rule 706 would assist the judge and jury and would facilitate the prompt settlement of intellectual property, antitrust, securities, contract, business tort, and other complex disputes. The benefits to courts and litigants would surely exceed the costs.
