Book excerpt: The French Republic does not discriminate or differentiate between individuals in terms of gender, difference or ethnicity. However recent legislation has enshrined the rights of gays and lesbians and it is this legislation that has inspired the author to examine the unique relationship between the Republic and its citizens - in this case gay and lesbian citizens. The author assesses the impact the new legislation has had on France as a democratic, multicultural republic founded on equality of citizenship, and on the lesbian and gay community, caught between inclusion and exclusion. The book combines approaches from sociology, political science, legal studies, cultural studies and the study of gender and sexuality, and will appeal to academics and postgraduates in these fields.

Book excerpt: The concept of “Waithood” was developed by political scientist Diane Singerman to describe the expanding period of time between adolescence and full adulthood as young people wait to secure steady employment and marry. The contributors to this volume employ the waithood concept as a frame for richly detailed ethnographic studies of “youth in waiting” from a variety of world areas, including the Middle East Africa, Asia, Europe, Latin America and the U.S, revealing that whether voluntary or involuntary, the phenomenon of youth waithood necessitates a recognition of new gender and family roles.

Available in PDF, EPUB and Kindle. Book excerpt: With marriage in decline, divorce on the rise, the demise of the nuclear family, and the increase in marriages and adoptions among same-sex partners, it is clear that the structures of kinship in the modern West are in a state of flux. In The Metamorphoses of Kinship, the world-renowned anthropologist Maurice Godelier contextualizes these developments, surveying the accumulated experience of humanity with regard to such phenomena as the organization of lines of descent, sexuality and sexual prohibitions. In parallel, Godelier studies the evolution of Western conjugal and familial traditions from their roots in the nineteenth century to the present. The conclusion he draws is that it is never the case that a man and a woman are sufficient on their own to raise a child, and nowhere are relations of kinship or the family the keystone of society. Godelier argues that the changes of the last thirty years do not herald the disappearance or death agony of kinship, but rather its remarkable metamorphosis—one that, ironically, is bringing us closer to the “traditional” societies studied by ethnologists.

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

Book excerpt: There are few areas of public policy in the Western world where there is as much turbulence as in family law. Often the disputes are seen in terms of an endless war between the genders. Reviewing developments over the last 30 years in North America, Europe and Australasia, Patrick Parkinson argues that, rather than just being about gender, the conflicts in family law derive from the breakdown of the model on which divorce reform was predicated in the late 1960s and early 1970s. Experience has shown that although marriage may be freely dissoluble, parenthood is not. Dealing with the most difficult issues in family law, this book charts a path for law reform that recognizes that the family endures despite the separation of parents, while allowing room for people to make a fresh start and prioritizing the safety of all concerned when making decisions about parenting after separation.

Available in PDF, EPUB and Kindle. Book excerpt: Family justice requires not only a legal framework within which personal obligations are regulated over the life course, but also a justice system which can deliver legal information, advice and support at times of change of status or family stress, together with mechanisms for negotiation, dispute management and resolution, with adjudication as the last resort. The past few years have seen unparalleled turbulence in the way family justice systems function. These changes are associated with economic constraints in many countries, including England and Wales, where legal aid for private family matters has largely disappeared. But there is also a change in ideology in a number of jurisdictions, including Canada, towards what is sometimes called neo-liberalism, whereby the state seeks to reduce its area of activity while at the same time maintaining strong views on family values. Legal services may become fragmented and marketised, and the role of law and lawyers reduced, while self-help web based services expand. The contributors to this volume share their anxieties about the impact on the ability of individuals to achieve fair and informed resolution in family matters.

Available in PDF, EPUB and Kindle. Book excerpt: It is often asserted that ‘A family that prays together, stays together’. But what if a child no longer wishes to pray? This book analyses the law in relation to situations where parents force their children to manifest the parental religion. From thorough examination of international law it argues that, unlike what is generally believed, the human rights regime does not grant parents a right to impose manifestations of their religion on their children. Instead, the author proposes to regard coerced manifestations as a limitation on children’s right to freedom of manifestation, based on national laws that give parents rights at the domestic level under principles such as parental responsibility. The book focuses on two aspects of States’ positive obligations in this regard. First, the obligation to provide a regulatory framework that can protect children’s right to freedom of manifestation, and restricts limitations to those that are proportionate or 'necessary in a democratic society'. Second, to provide access to remedies, which it is argued should consist of access to a family-friendly infrastructure for dispute resolution available to parents and children in conflict over religious manifestation. Both depend heavily on the way States balance power between parents and children at the national level. The book includes three case studies and social research of jurisdictions that offer different perspectives under the principles of parental authority (France), parental responsibility (England) and parental rights (Hong Kong).

Book excerpt: Trauma and Motherhood in Contemporary Literature and Culture repositions motherhood studies through the lens of trauma theory by exploring new challenges surrounding conception, pregnancy, and postpartum experiences. Chapters investigate nine case studies of motherhood trauma and recovery in literature and culture from the last twenty years by exploring their emotional consequences through the lens of trauma, resilience, and “working through” theories. Contributions engage with a transnational corpus drawn from the five continents and span topics as rarely discussed as pregnancy denial, surrogacy, voluntary or involuntary childlessness, racism and motherhood, carceral mothering practices, surrogacy, IVF, artificial wombs, and mothering through war, genocide, and migration. Accompanied by an online creative supplement, this volume deals with silenced aspects of embodied motherhood while enhancing a better understanding of the cathartic effects of storytelling.

Book excerpt: This volume highlights important classic and contemporary works by law and society scholars who analyze the complex and often highly political relationship between law and families. Featuring authors from Australia, Canada, England and the United States, the volume looks at how socio-legal scholars think about families and the law, how law shapes family practices, the capacity of family law to deliver social justice and how family disputes are resolved. Topics such as law's role in recognizing spousal and parental relationships or promoting responsible behaviour or equality norms are covered and the relationship between law's assumptions and the lived realities of families is problematized.
