Available in PDF, EPUB and Kindle. Book excerpt: Drawing on groundbreaking and overwhelmingly extensive research into local court records, The Common Law in Colonial America proposes a "new beginning" in the study of colonial legal history, as it charts the course of the common law in Early America, to reveal how the models of law that emerged differed drastically from that of the English common law. In this first volume, Nelson explores how the law of the Chesapeake colonies--Virginia and Maryland--differed from the New England colonies--Massachusetts Bay, Connecticut, New Haven, Plymouth, and Rhode Island--and looks at the differences between the colonial legal systems within the two regions, from their initial settlement until approximately 1660.

Book excerpt: In 1663, an indentured servant, Anne Orthwood, was impregnated in a tavern in Northampton County, Virginia, an illegitimate pregnancy that sparked four related cases that came before the Northampton magistrates between 1664 and 1686. These cases illuminate the ways in which the Virginia colonists modified English common law traditions and began to create their own, and they also shed light on cultural and economic values in this community. Through these cases, the very reasons legal systems are created are revealed, namely, the maintenance of social order, the protection of property interests, the protection of personal reputation, and personal liberty.

Book excerpt: How the repeated social tropes and paradigms of the City comedies give us an in-depth look into everyday London society in the early 17th-century. Although literature is often assumed to belong to the sphere of representation rather than constituting an accurate reflection of social reality, early-modern English drama can tell us much about social attitudes in the early seventeenth century. The City comedies were, in particular, composed by authors who were embedded in the mundane social existence of London, in its quotidian transactions and exchanges, in its less salubrious contexts of debt, drinking, death and incarceration. To elucidate the complex social attitudes of the City urban elite, five particular themes are explored: the symbolism of attire; matrimonial talk; the use of money (coin) as metaphor and metonymy; “over-exuberance” towards the opportunity of the “New World”; and continuing differences of speech and customary language use. Although the dramatists had slightly differing allegiances, their commentaries all illuminate “middling” society in the City of London. “This new work by David Postles raises important questions in an innovative manner. It will certainly be welcomed by the historical community.” —Bernard Capp, FBA, Dept of History, University of Warwick “David Postles is one of the most innovative social historians writing today.” —Nigel Goose, Professor of Social and Economic History, University of Hertfordshire “This book will be significant reading for all those working in the field. It will be warmly received by readers and reviewers, and will remain a work of reference for scholars and students for the future.” —Greg Walker, Regius Professor of Rhetoric and English Literature, University of Edinburgh

Book excerpt: This is an engaging and comprehensive study of property-owning women in the colony of Tidewater, VA during the 17th & 18th centuries. It examines the social restrictions on women's behaviour and speech, opportunities and difficulties these women encountered in the legal system, the economic and discretionary authority they enjoyed, the roles they played in the family business, their roles in the later, trans-Atlantic trading framework, and the imperial context within which these colonial women lived, making this a welcome addition to both colonial and women's history.

Available in PDF, EPUB and Kindle. Book excerpt: This collection of seventeen original essays reshapes the field of early American legal history not by focusing simply on law, or even on the relationship between law and society, but by using the concept of "legality" to explore the myriad ways in which the people of early America ordered their relationships with one another, whether as individuals, groups, classes, communities, or states. Addressing issues of gender, ethnicity, family, patriarchy, culture, and dependence, contributors explore the transatlantic context of early American law, the negotiation between European and indigenous legal cultures, the multiple social contexts of the rule of law, and the transformation of many legalities into an increasingly uniform legal culture. Taken together, these essays reveal the extraordinary diversity and complexity of the roots of early America's legal culture. Contributors are Mary Sarah Bilder, Holly Brewer, James F. Brooks, Richard Lyman Bushman, Christine Daniels, Cornelia Hughes Dayton, David Barry Gaspar, Katherine Hermes, John G. Kolp, David Thomas Konig, James Muldoon, William M. Offutt Jr., Ann Marie Plane, A. G. Roeber, Terri L. Snyder, and Linda L. Sturtz.

Available in PDF, EPUB and Kindle. Book excerpt: From 1625, when Charles I announed his intention to make settlements part of his royal empire, to 1689, when a colonial clergyman told William III that he might, if he pleased, be emperor of America, metropolitan power and colonial dependence shaped the politics of empire. Bliss (history, U. of Lancaster) extends the terms of debate over the origins of English imperialism by placing West Indian and North American colonization squarely in the context of 17th century English political history.
