This book was released on 2013-04-01 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: Terrorism has become one of the major threats facing both states and the international community, in particular after the terrorist attacks in the United States, Madrid and London, which revealed a whole new scale and dimension of the phenomenon. An effective response is absolutely necessary; this response, however, cannot undermine democracy, human rights, the rule of law or the supreme values inherent to these principles. There is no universally agreed definition of "terrorism", nor is there an international Jurisdiction before which the perpetrators of terrorist crimes can be brought to account. The European Court of Human Rights is the first international Jurisdiction to deal with such a phenomenon. For many decades and through more than four hundred cases, it has elaborated a clear, integrated and articulated body of case law on responses to terrorism from a human rights and rule of law perspective. Thus, this is a handbook on counter-terrorism with a special focus on due respect for human rights and rule of law. This book compiles the doctrine laid down by the European Court of Human Rights in this field with a view to facilitating the task of adjudicators, legal officers, lawyers, international IGOs, NGOs, policy makers, researchers, victims and all those committed to fighting this scourge. The book presents a careful analysis of this body of case law and the general principles applicable to the fight against terrorism resulting from each particular case. It also includes a compendium of the main cases dealt with by the Strasbourg Court in this field and will prove to be a most useful guiding tool in the sensitive area of counter-terrorism and human rights.

Book excerpt: This is a Government reply to the Joint HLP/HCP paper on counter-terrorism policy and human rights (HLP 157/HCP 394 06/07 ISBN 9780104011317). The Government accepts a number of the Committee's recommendations, including: that the issue of sufficient Parliamentary oversight of the 28 day pre-charge detention period, will now form part of the Government's consultation process on the Counter Terrorism Bill and there will be consideration of whether there is a need for an independent body to review the operation of pre-charge detention, as well as a review of the availability of statistics and information on this matter; the Government agrees that the upper limit to the period of pre-charge detention should be set by Parliament; the Government does not accept the Committee's argument that transferring suspects out of police custody to prison is undesirable, but that prison provides the detainee access to facilities beyond that available at a police station; the Government is reviewing with the police the issue of making video-recording interviews with terrorism suspects compulsory under the Terrorism Act 2000; the Government does not accept the Committee's recommendations on the level of medical record keeping, and believes the current system is sufficient. The reply covers other areas, including: intercept as evidence; pre-charge questioning and other alternatives to pre-charge detention and special advocates.

Book excerpt: The ever-present threat of terrorism and the growing human-rights backlash against anti-terrorist policies are becoming ever more significant on the international stage. Constant media-coverage and public concern have characterised the debate over the last ten years. This book is a fair and objective assessment of counter-terrorist policy and human rights worldwide, and covers a wide breadth of international material. While raising key questions for reader consideration, this book aims for straight-forward consideration, leaving polemic to the reader.

This book was released on 2006-08-01 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the third in a series of reports by the Committee in its ongoing inquiry into counter-terrorism policy and human rights issues. Previous reports examined the impact of the July 2005 terrorist attacks in London and counter-terrorism measures taken, including the Terrorism Bill (HLP 75-I/HCP 561-I, session 2005-06; ISBN 0104007672) and the operation of the control orders regime (HLP 122/HCP 915, session 2005-06; ISBN 0104008199). This third report considers broader issues involved in making the Governments counter-terrorism strategy more compatible with human rights, focusing on possible adaptations of the criminal justice system to prosecute terrorist suspects without breaching human rights obligations; and possible alternatives to lengthy pre-charge detention. The report also examines whether there are any useful lessons to be learned from the investigating magistrates system in France and Spain or the use of investigative hearings in Canada. Findings include: i) the ban on the use of intercept evidence in court should be removed; ii) in order to increase the level of public confidence in the work of the intelligence gathering services, there should be protocols established to oversee the inter-agency arrangements for sharing intelligence which are subject to independent scrutiny; iii) there should be an enforceable right to compensation for those held in pre-charge detention but not charged, and provision made for counselling support to be given to those detained beyond 14 days; and iv) if should not be necessary to further extend the maximum period of pre-charge detention beyond 28 days. The Committee also raises concerns that the Head of the Security Service failed to appear before the Committee in relation to this inquiry, and highlights the urgent need for a new monitoring body to ensure independent oversight of the security and intelligence agencies and the Governments claims based on intelligence information.

Book excerpt: The Committee's first report in its ongoing inquiry into counter-terrorism policy and human rights issues (HLP 75-I /HCP 561-I, session 2005-06; ISBN 0104007672) focused on the London terrorist attacks in July 2005 and the Government's counter-terrorism measures taken in response. This publication, the Committee's second report in its inquiry, focuses on the human rights implications of the control orders regime established under the Prevention of Terrorism Act 2005, in relation to issues of deprivation of liberty, right to a fair trial, inhuman and degrading treatment, impact on human rights of family members, and discrimination. The control orders regime will be extended for a further year from March 2006 if a draft Order is approved by both Houses of Parliament. The Committee finds that the case for consolidating counter-terrorism legislation is potentially strong. However it is noted with regret that the Government has decided to seek the renewal of the control orders regime through a draft Order rather than a Bill, therefore significantly reducing the scope for parliamentary scrutiny and debate.

As defined by this report, it is based on a range of violent ideological motivations, including racial bigotry and anti-government feeling, and it can take several forms, from lone actors and small groups to violent militias.
