An effective response is absolutely necessary; this response, however, cannot undermine democracy, human rights, the rule of law or the supreme values inherent to these principles.There is no universally agreed definition of "terrorism", nor is there an international Jurisdiction before which the perpetrators of terrorist crimes can be brought to account. The European Court of Human Rights is the first international Jurisdiction to deal with such a phenomenon. For many decades and through more than four hundred cases, it has elaborated a clear, integrated and articulated body of case law on responses to terrorism from a human rights and rule of law perspective. Thus, this is a handbook on counter-terrorism with a special focus on due respect for human rights and rule of law.This book compiles the doctrine laid down by the European Court of Human Rights in this field with a view to facilitating the task of adjudicators, legal officers, lawyers, international IGOs, NGOs, policy makers, researchers, victims and all those committed to fighting this scourge. This third report considers broader issues involved in making the Governments counter-terrorism strategy more compatible with human rights, focusing on possible adaptations of the criminal justice system to prosecute terrorist suspects without breaching human rights obligations; and possible alternatives to lengthy pre-charge detention. The report also examines whether there are any useful lessons to be learned from the investigating magistrates system in France and Spain or the use of investigative hearings in Canada. Findings include: i) the ban on the use of intercept evidence in court should be removed; ii) in order to increase the level of public confidence in the work of the intelligence gathering services, there should be protocols established to oversee the inter-agency arrangements for sharing intelligence which are subject to independent scrutiny; iii) there should be an enforceable right to compensation for those held in pre-charge detention but not charged, and provision made for counselling support to be given to those detained beyond 14 days; and iv) if should not be necessary to further extend the maximum period of pre-charge detention beyond 28 days. The Committee also raises concerns that the Head of the Security Service failed to appear before the Committee in relation to this inquiry, and highlights the urgent need for a new monitoring body to ensure independent oversight of the security and intelligence agencies and the Governments claims based on intelligence information.
