Available in PDF, EPUB and Kindle. Book excerpt: The "rags to riches" story of Karol Jakubowicz's involvement in the work of the Council of Europe took him from the role of an awestruck newcomer from Poland in 1990 to that of the Chairman of the Steering Committee on the Media and New Communication Services (2005-06). Along the way, he was elected, delegated by the Steering Committee, and invited by the Council of Europe Secretariat to serve in a number of other capacities. In all of them, he contributed a wide variety of papers, reports and studies to assist the steering committee and other bodies in collecting information and formulating ideas in the general field of freedom of expression, creation of free and democratic media systems (including the issue of public service media), regulation of transfrontier television, the adjustment of Council of Europe human rights standards to the conditions of the information society, and the development of broadcasting legislation in Council of Europe member states. The present collection of these papers and reports is published in the conviction that they retain their value and relevance. It provides the additional benefit of offering a glimpse of the work preceding the formulation of Committee of Ministers recommendations and declarations, as well as resolutions of the Council of Europe Parliamentary Assembly.

Available in PDF, EPUB and Kindle. Book excerpt: Addresses a critical analysis of major media policies in the European Union and Council of Europe at the period of profound changes affecting both media environments and use, as well as the logic of media policy-making and reconfiguration of traditional regulatory models. The analytical problem-related approach seems to better reflect a media policy process as an interrelated part of European integration, formation of European citizenship, and exercise of communication rights within the European communicative space. The question of normative expectations is to be compared in this case with media policy rationales, mechanisms of implementation (transposing rules from EU to national levels), and outcomes.

Available in PDF, EPUB and Kindle. Book excerpt: Satellites enable European broadcasters to televise programs to vast transnational audiences. This activity is supported by a regime of freedom of transborder broadcasting under EC law, European human rights law and other areas of public international law. The program contents of broadcasts will on occasion give rise to claims of injury to private law interests, including the interest in reputation. The defamation laws of Europe's nations are however by no means uniform: the same transmission may give rise to liability under one national system but to no liability under another. The material outcome of a given claim will thus rest on the existing regime of private international law applied by Europe's national courts, including rules governing forum, choice of law and foreign judgments. It is against the above background of private international law that Defamation via Satellite examines Europe's prospects of realizing the public international law regime of free transborder broadcasting.

Available in PDF, EPUB and Kindle. Book excerpt: Press freedom plays a significant role in creating public awareness via accurately informing the society. It performs this duty within the framework of respect to diversity of opinions and individual right to self-governance, which is particularly indispensable to liberal democracies. Press freedom is a different form of freedom of expression, which is included in the most fundamental human rights documents such as the UN Universal Declaration of Human Rights, the UN Universal Covenant on Civil and Political Rights, and the European Convention on Human Rights (ECHR). Freedom of expression has been protected under Article 10 of the ECHR. This article draws the boundaries of this right as freedom to hold opinions and impart information and ideas without interference by public authority and regardless of frontiers. The article then instructs the acceptable limits of this freedom. In order for a restriction of freedom of expression be valid, it must be prescribed by law first, and secondly, it must be necessary in a democratic society, and finally it must be only aimed for the listed legitimate causes as specified in this article. Despite the protection of the ECHR Article 10, Turkey has seen frequent interventions on the press due to political pressure and the ownership structure of the media in the country. And consequently, numerous violation judgments have been delivered by the European Court of Human Rights (ECtHR), which will be analyzed in terms the reasons for violations and the cases of legitimate restrictions on press freedom. Additionally, this book will give a detailed trajectory of press freedom in Turkey in the light of court decisions, European Union Progress Reports and statements of press unions.

Available in PDF, EPUB and Kindle. Book excerpt: The areas of media and cultural policy offer a unique prism through which to understand wider processes of European integration. Questions of European identity, citizenship and community or polity-building clearly resolve themselves as questions of the (non-)emergence of a European ‘communicative space’. At the same time, as a more specific area of policy study, the role which has or may be played by the European institutions themselves in the fostering of such a ‘communicative space’ raises questions as to both the effectiveness and the legitimacy of their interventions. This volume in the European Studies series brings fresh, interdisciplinary insight into this relatively understudied area, making the case for a renewed look at the trajectory of cultural and media policies in the EU. Distinctively, the collection offers a historical and socio-political analysis of major media policies in the European Union, allowing for the contextualisation of recent developments; turns its attention to areas largely neglected by scholarly publishing, such as the press, the culture of the newsroom, and the role of media in an enlarged Europe; and addresses media and cultural policies as an interrelated part of EU construction, through questions of identity and political representation. Media and Cultural Policy in the European Union will be of interest to scholars and students of Cultural and Media Studies, European Studies, and European Integration, as well as appealing to broader Social Science audiences concerned with the politics and policy of cultural diversity.
