Loin d'être un obstacle à la recherche d'une notion européenne de contrat, l'ancrage national des notions de contrat a orienté la méthodologie retenue dans la démonstration. Afin de saisir l'originalité de la notion contemporaine de contrat en droit privé européen, encore fallait-il préalablement revenir sur la construction historique de la notion de contrat, du droit romain aux codifications nationales du droit civil `Code civil, Bürgerlirhes Gesetzburh). Les codifications doctrinales contemporaines offrent une notion renouvelée de contrat dont l'élaboration a nécessité une déconstruction des notions nationales de contrat. Quant au droit de l'Union européenne, celui-ci a forgé un concept autonome qui tend à faire de la notion de contrat un engagement créateur d'attentes légitimes. Cette contribution à l'étude de la notion de contrat en droit privé européen nécessitait un fondement théorique solide. Celui-ci a été recherché dans la théorie du contrat relationnel, de telle sorte qu'elle innerve l'ensemble de l'étude. Cette théorie a vocation à expliquer certaines évolutions de la notion décrite dans cette étude.

Telles sont les questions sur lesquelles porte la présente étude sur la justice contractuelle dont l'objectif est de procéder à une analyse critique des fondements de la protection de la partie vulnérable. Ces derniers ne révèlent pas nécessairement l'existence d'une logique d'ensemble. Dans une perspective idéaliste, la moralité contractuelle et l'utilité économique du contrat sont les bases sur lesquelles la protection de la partie vulnérable a été envisagée. Appréhendée sur un plan individuel, la vulnérabilité du contractant repose sur l'idée d'une justice essentiellement réparatrice. Celle-ci est axée sur le respect de la bonne foi contractuelle et sur le désir de donner à chacune des parties les moyens de défendre ses intérêts. C'est donc de manière exceptionnelle que la vulnérabilité sera prise en compte. En réaction aux limites d'une protection faisant de l'existence d'un comportement fautif la condition de l'octroi de la protection, une vision réaliste de la sauvegarde des intérêts légitimes du contractant vulnérable a été mise de l'avant. Elle prend appui sur la dimension collective de la vulnérabilité du contractant. Il en résulte un régime de protection fondé sur la notion de relation et sur une conception objective de la justice. Toute chose qui se traduit soit par une protection technico-formaliste, soit par l'idée de solidarité faisant du contrat le lieu d'une communauté d'intérêts. Cependant, cette approche du contrat n'intègre pas forcément l'importance du rôle réservé à la volonté, ni les diverses catégories de contrats.

Cette procédure de recherche et de développement du droit générique n'est pas nouvelle puisque le code civil et l'ordre juridique français ont été conçus sur ce principe. Il conviendra de cerner ce que sont exactement le temps et la durée. La durée désigne la succession d'évènements différents. La perception de la durée, qui est le propre de l'homme, peut-elle être intégrée à une construction, à une structure juridique du droit des contrats? La perception de l'homme sur la durée le conduit à fixer, dans les contrats, une durée de vie du contrat ou d'exécution des obligations. La notion de durée se retrouve à différents stades qui s'étendent des pourparlers à l'extinction de l'engagement contractuel. L'évolution actuelle du droit des contrats s'opposerait à ce que l'on a appelé "le coup de foudre contractuel", conception instantanéiste de la formation du contrat. Le recours à la notion de durée est en croissance, c'est une certaine vision dynamique du droit des contrats qui s'opposerait à une appréhension statique ou instantanéiste. Ce développement de la notion de durée pose le problème de son appréhension par notre droit. La référence à notre passé constitue une source de références et de réflexion pour embrasser notre droit et intégrer la notion de durée dans l'organisation juridique.
