Available in PDF, EPUB and Kindle. Book excerpt: The contract of employment is the legal instrument which regulates the conditions of employment of the vast majority of the working 1 people of the world. More than any other civil contract based on mutual rights and obligations, this contract is characterised by the importance of its human elements. Sir William Blackstone once under lined the human and legal significance ofthe relationship, by classifying it immediately after the two great human relationships of husband and 2 wife and of parent and child. The contract is thus nationally and internationally important. In 1927 the International Labour Conference adopted a resolution "requesting the governing body of the Office to consider the possibility of placing the question of the general principles of contracts of employment on the agenda of a future session of the Conference. "3 This question was regrettably not followed up. The reason though not the justification, lies in the difficult task of limiting the bounds of the contract and of reconciling the different legal systems in the various countries. The effort spent by the LL. O. during the last few years towards the adoption of an international recommendation on the termination of the contract, which is yet to bear fruit, illustrates the difficulties involved. In the Arab countries the importance of the contract of employment was more felt since the introduction of industry thirty years ago.

E. written by Susan Rayner and published by Springer. This book was released on 1991-11-25 with total page 488 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the discovery of oil in the Middle East an increasing number of important contracts must be framed in accordance with the Shari'a. Moreover various factors have helped to create among Muslims a more acute sense of an original Islamic identity & a collective feeling that Shari's should govern their lives not only with regard to personal & family matters but also as a valid & reasonable corpus of commercial & civil laws. The ban on taking interest (riba) & the rejection of chance contracts (gharar) are two features of an Islamic law of contract which contrast with the secular man-made legal systems of the West. This book is concerned with these two Islamic Prohibitory rules & with the interest-free banking system which has developed therefrom. This is a new enlarged edition where the comparative examination of the topics of the book is updated & furthermore extended to cover the Shi'a Ja'fari fiqh. As a result all aspects are examined in the light of the teachings of the four Sunni schools -which hold authority in the Arab states & in Pakistan -of the Ibadis strongly present in Oman & of the Shi'a Ja'faris prevalent in Iran & largely present in Iraq, Bahrein, Kuweit & Lebanon. The new edition will confirm the use of the initial one as a text book with a particular appeal to academics & practising lawyers. It also provides an insight into the religious & idealogical foundations claimed by Islamic banking.

This book was released on 2018-03-26 with total page 397 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although negotiation still lies at the heart of international commercial agreements, much of the detail has migrated to the Internet and has become part of electronic commerce. This incomparable one-volume work??now in its sixth edition??with its deeply informed emphasis on both the face-to-face and electronic components of setting up and performing an international commercial agreement, stands alone among contract drafting guides and has proven its enduring worth. Following its established highly practical format, the book’s much-appreciated precise information on a wide variety of issues??including those pertaining to intellectual property, alternative dispute resolution, and regional differences??is of course still here in this new edition. There is new and updated material on such matters as the following: • the need for contract drafters to understand and to use the concepts of “standardization” (i.e., the work of the International Organization for Standardization (ISO) as a contract drafting tool); • new developments and technical progress in e-commerce; • new developments in artificial intelligence in contract drafting; • the possible use of electronic currencies such as Bitcoin as a payment device; • foreign direct investment; • special considerations inherent in drafting licensing agreements; • online dispute resolution including the innovations referred to as the “robot” arbitrator; • changes in the arbitration rules of major international organizations; and • assessment of possible future trends in international commercial arrangements. Each chapter provides numerous references to additional sources, including a large number of websites. Materials from and citations to appropriate literature in languages other than English are also included. In its recognition that a business executive entering into an international commercial transaction is mainly interested in drafting an agreement that satisfies all of the parties and that will be performed as promised, this superb guide will immeasurably assist any lawyer or business executive to plan and carry out individual transactions even when that person is not interested in a full-blown understanding of the entire landscape of international contracts. Business executives who are not lawyers will find that this book gives them the understanding and perspective necessary to work effectively with the legal experts.
