Available in PDF, EPUB and Kindle.

Book excerpt: Presenting the foundations of an integrated theory of organizations, Jensen argues that the cost of transferring information necessitates decentralization of some decision rights in organizations and economies. This in turn requires organizations to solve the control problem that results when self-interested persons do not behave as perfect agents.

In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the nature of the challenges that have confronted European democracies in recent years. In the past decade, the rule of law in Europe has been put under strain by both external and internal factors. The term “illiberal democracies” is sometimes used to describe the rise of a phenomenon in which the fundamental values of the European legal order, as enshrined in the European Convention of Human Rights and in the Charter of Fundamental Rights of the European Union, are called into question. The preservation of the independence of the judiciary, of the freedom of expression and the protection of journalists are among the values under threat. But these challenges are also present within the older democracies in which emergency regimes have become more common. As the European Union’s sanctions regime shows, striking a balance between security and the rule of law, of which fundamental rights are an intrinsic part, is a constant challenge. Focusing on the European courts’ responses to these threats, the book discusses how courts could provide the ultimate line of defense. The acid test of the rule of law might indeed be how it safeguards the judicial guarantees designed to protect core European values beyond the discretion of government.

Book excerpt: Over the past two decades theorists and researchers have given increasing attention to the effects, both beneficial and harmful, of various control related motivations and beliefs. People's notions of how much personal control they have or desire to have over important events in their lives have been used to explain a host of performance and adaptational outcomes, including motivational and performance deficits associated with learned helplessness (Abramson, Seligman, & Teasdale, 1978) and depression (Abramson, Metalsky, & Alloy, 1989), adaptation to aging (Baltes & Baltes, 1986; Rodin, 1986), cardiovascular disease (Matthews, 1982), cancer (Sklar & Anisman, 1979), increased reports of physical symptoms (Pennebaker, 1982), enhanced learning (Savage, Perlmutter, & Monty, 1979), achievement-related behaviors (Dweck & Licht, 1980; Ryckman, 1979), and post abortion adjustment (Mueller & Major, 1989). The notion that control motivation plays a fundamental role in a variety of basic, social psychological processes also has a long historical tradition. A number of theorists (Heider, 1958; Jones & Davis, 1965; Kelley, 1967), for example, have suggested that causal inferences arise from a desire to render the social world predictable and controllable. Similarly, control has been implicated as an important mediator of cognitive dissonance (Wicklund & Brehm, 1976) and attitude phenomena (Brehm & Brehm, 1981; Kiesler, Collins, & Miller, 1969). Despite the apparent centrality of control motivation to a variety of social psychological phenomena, until recently there has been relatively little research explicitly concerned with the effects of control motivation on the cognitive processes underlying such phenomena (cf.

Book excerpt: The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

Book excerpt: In The Bureaucratic Phenomenon Michel Crozier demonstrates that bureaucratic institutions need to be understood in terms of the cultural context in which they operate. The originality of the study lies in its association of two widely different approaches: the theory of decision-making in large organizations and the cultural analysis of social patterns of action. The book opens with a detailed examination of two forms of French public service. These studies show that professional training and distortions alone cannot ex plain the rise of routine behavior and dysfunctional vicious circles. The role of various bureaucratic systems appears to depend on the pattern of power relation ships between groups and individuals. Crozier's findings lead him to the view that bureaucratic structures form a necessary protection against the risks inherent in collective action.Since systems of protection are built around basic cultural traits, the author presents a French bureaucratic model based on centralization, strata isolation, and individual sparkle-one that that can be contrasted with an American, Russian, or Japanese model. He points out how the same patterns can be found in several areas of French life: education, industrial relations, politics, business, and the colonial policy. Bureaucracy, Crozier concludes, is not a modern disease resulting from organizational progress but rather a bulwark against development. The breakdown of the traditional bureaucratic system in modern France offers hope for new and fruitful forms of action.
