Book excerpt: Le 1er avril 2003, l'entrée en vigueur de la Loi sur le système de justice pénale pour les adolescents (LSJPA) a fourni aux policiers canadiens de nouveaux outils pour procéder à des interventions non-judiciaires auprès d'adolescents contrevenants. Dorénavant, les policiers détiennent le pouvoir officiel d'imposer des mesures extrajudiciaires aux adolescents interpellés pour avoir commis des infractions plutôt que de procéder à leur arrestation formelle. La présente étude vise à déterminer quelles caractéristiques des adolescents et circonstances des infractions ont un impact significatif sur les décisions des policiers d'imposer ces mesures plutôt que de procéder à des arrestations. Les résultats sont basés sur trois échantillons de participations criminelles juvéniles enregistrées par un corps policier canadien entre 2003 et 2010: le premier composé d'infractions contre la personne (n= 3 482), le second, d'infractions contre la propriété (n= 8 230) et le troisième, d'autres crimes (n= 1 974). L'analyse de régression logistique multiniveaux a été utilisée pour déterminer les facteurs - tels que le sexe, l'âge et les contacts antérieurs avec la justice des adolescents ainsi que la localisation dans le temps et l'espace de l'infraction - ont un impact significatif sur le pouvoir discrétionnaire des policiers. Certains facteurs ont une influence universelle d'une catégorie de crime à l'autre, tandis que d'autres ont un impact spécifique selon le type d'infraction commise.

And I warmly congratulate the ASSER International Sports Law Centre and the Editors, Ian Blackshaw, Rob Siekmann and Janwillem Soek – in cooperation with Andrew Gibson, Griffith University, Brisbane, Australia, and Steve Cornelius, University of Johannesburg, South Africa –, on their joint initiative in putting together and publishing this Book. The CAS has come a long way since the idea of establishing it was first mentioned by Juan Antonio Samaranch, the former IOC President. His vision and confidence in its future have been truly vindicated. Since its creation and up to 31 December 2003, 576 cases have been submitted, of which 550 were requests for arbitration and 26 for an advisory opinion. In 2004, there was a sharp rise in the number of cases handled by the CAS and this trend continues apace. Thus, the CAS goes from strength to strength and has a great future, having, in the words of the Swiss Federal Tribunal in its landmark judgement of 27 May 2003, “built up the trust of the sporting world [and] . . . now widely recognised . . . Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.
