The book offers authoritative guidance on the genesis and meaning of the Nairobi Wreck Removal Convention 2007, and the interpretation of its often-complex provisions as they apply both to States trying to use its powers and to shipowners and liability insurers faced by its obligations. The authors explain the increasingly complex inter-relationship between linked areas of maritime law, including salvage, intervention and the overlapping international regimes which deal with pollution from oil, bunkers or hazardous and noxious substances. The book examines how a salvage operation transitions to wreck removal and links the liability provisions with the standard form international commercial contracts actually used by the industry to remove wrecks, eg BIMCO’s Wreckstage 2010, Wreckhire 2010 and Wreckfixed 2010. It also covers the complex requirements concerning the disposal of wrecks, including the latest recycling regulations applicable in 2019. The Law of Wreck will be of value to shipping industry professionals, insurers and legal practitioners, as well as academics and students of maritime law.

A supplementary consultation on the ratification of the Nairobi Convention on the Removal of Wrecks, for which the draft Bill includes the necessary statutory provisions, was published at the same time by the Department for Transport. The Bill covers four main areas: (a) port safety, including measures relating to pilotage, National Occupational Standards for Harbour Masters and pilots, and extending powers of general direction to more harbour authorities; (b) the closure of harbours, and the subsequent relinquishing of the legal rights and duties of the harbour authority; (c) the role of the General Lighthouse Authorities, including their powers of enforcement, the territorial extent of their operations, their commercial work and their pension schemes; and (d) the ratification and implementation of the Nairobi Convention. The introduction of new powers to issue directions to port and harbour authorities and to specify minimum standards of competence for harbour masters and pilots is supported. The provisions relating to General Lighthouse Authorities are a sensible package intended to clarify their powers and put beyond doubt the legal validity of much of the essential work which they have been carrying out for centuries. The provision in the draft Bill to give statutory effect Nairobi International Convention on the Removal of Wrecks will remove from the UK taxpayer a significant potential liability in respect of wrecks in UK waters.

An accord has to be struck between policy makers and regulators on the one hand, anxious to direct research and business incentives in effective and efficient directions, and developers, investors and businesses on the other, anxious to reduce the risks of such potentially profitable but innovative investments.The EU H2020 MARIBE (Marine Investment for the Blue Economy) funded project was designed to identify the key technical and non-technical challenges facing maritime industries and to place them into the social and economic context of the coastal and ocean economy. MARIBE went on to examine with companies, real projects for the combination of marine industry sectors into multi-use platforms (MUPs). The purpose of this book is to publish the detailed analysis of each prospective and established maritime business sector. Sector experts working to a common template explain what these industries are, how they work, their prospects to create wealth and employment, and where they currently stand in terms of innovation, trends and their lifecycle.
