Kahn shows that the American Constitution itself makes self-government impossible. Constitutional theory, he argues, has been a history of failed attempts to resolve this paradox.

Book excerpt: Published in 1948, this work provides a detailed account of the constitutional history of Georgia from the Charter of 1732 to the adoption of the Constitution of 1945 and includes an analysis of the 1948 Georgia Constitution. Albert B. Saye presents the major constitutional developments in chronological order. An index allows readers to compare different aspects of Georgia's eight constitutions, such as the composition of the General Assembly, the powers of the Governor, and the jurisdiction of the Courts. Based on extensive research of original sources, A Constitutional History of Georgia reveals the evolution of the Georgia constitution up to 1948 as a gradual expansion of political democracy.

Book excerpt: Excerpt from The Constitutional History and Government of the United States In this edition some of the chapters have been rewritten and the others have been carefully revised. The conditions and circumstances which favored the institution of self-government in the colonies have received more attention. Care has been taken, however, to limit the narrative portions of the work to the collocation of such facts as serve to show the course of our constitutional system in its beginnings, growth, and development Many notes have been added, a considerable number of them illustrative of the objections and spirit of opposition which the practical development of the system has encountered. The labors of the Supreme Court in giving a sensible and practicable construction to the Constitution are constant, and some account of the most important since the earlier edition has been added. Recent important events at home and abroad involving or promising to involve the scope of constitutional powers have received attention. It seems clear to the author, and he has tried to make it so to the reader, that our constitutional system has been brought about and developed in a very natural and sensible way. He has not attempted to exhaust the subject, but to make it easier for the general reader to become familiar with it. The publishers state that the original work seems to be gaining in public favor. The author will be gratified if the revised edition shall continue to enjoy it. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Designed for use in courses, this abridged edition of the four-volume Constitutional History of the American Revolution demonstrates how significant constitutional disputes were in instigating the American Revolution. John Phillip Reid addresses the central constitutional issues that divided the American colonists from their English legislators: the authority to tax, the authority to legislate, the security of rights, the nature of law, the foundation of constitutional government in custom and contractarian theory, and the search for a constitutional settlement. Reid's distinctive analysis discusses the irreconcilable nature of this conflict--irreconcilable not because leaders in politics on both sides did not desire a solution, but because the dynamics of constitutional law impeded a solution that permitted the colonies to remain part of the dominions of George III.

Book excerpt: When the first two volumes of William Crosskey's monumental study of the Constitution appeared in 1953, Arthur M. Schlesinger called it "perhaps the most fertile commentary on that document since The Federalist papers." It was highly controversial as well. The work was a comprehensive reassessment of the meaning of the Constitution, based on examination of eighteenth-century usages of key political and legal concepts and terms. Crosskey's basic thesis was that the Founding Fathers truly intended a government with plenary, nationwide powers, and not, as in the received views, a limited federalism. This third volume of Politics and the Constitution, which Crosskey began and William Jeffrey has finished, treats political activity in the period 1776-87, and is in many ways the heart of the work as Crosskey conceived it. In support of the lexicographic analysis of volumes 1 and 2, volume 3 shows that nationalist ideas and sentiments were a powerful force in American public opinion from the Revolution to the eve of the Constitutional Convention. The creation of a generally empowered national government in Philadelphia, it is argued, was the fruition of a long-active political movement, not the unintended or accidental result of a temporary conservative coalition. This view of the political background of the Constitutional Convention directly challenges the Madisonian-Jeffersonian orthodoxy on the subject. In support of his interpretation, Crosskey amassed a wealth of primary source materials, including heretofore unexplored pamphlets and newspapers. This exhaustive research makes this unique work invaluable for scholars of the period, both for the primary sources collected as well as for the provocative interpretation offered.

Book excerpt: Excerpt from A Short Constitutional History of the United States The basis of this book is the material consulted in the preparation of the author's larger works, - "A Constitutional History of the American People, 1776- 1850," and "The Constitutional History of the United States, 1765-1895," - the former a narrative of the civil development of the states; the latter, of the federal union. The present volume narrates the constitutional history both of the Union and of the states, showing the common basis of American local and general government. In a book of small compass, adapted to those who desire the essentials of our civil development, it has seemed sufficient if there were related, (1) the origin of our civil system; (2) the principles on which it is founded; (3) the adaptation of the plan of government to public needs, by amendment and construction; and, (4) the interpretation of the principles of the government by the supreme tribunal, - the courts. The chapters on the state constitutions treat of a subject too much neglected. A study of the subject quickly reveals its importance. Available in PDF, EPUB and Kindle. Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.
