Book excerpt: Excerpt from Some Constitutional Aspects of Territorial Expansion Second: Such Territories, once annexed, it follows from the foregoing considerations that they can not be held in military subjection; that they can not be ruled arbitrarily, either by the President or by Congress, or by both combined; that the Philippine will have the same personal rights un der the Constitution as the citizen of Illinois; that the writ of habeas corpus must always be available to him; that trial byjury can not be abridged; that no separate scheme of imposts or excises can be enforced in such colonies different from that in the mother country, and that all the inhabit ants of such annexed territory, or at the very latest, their children born subsequent to the annexation, must have free access to all portions of the United States and the same political rights as other citizens in like situation. In view of this last proposition it is scarcely to be wondered at that the most strenuous opposition thus far developed to this scheme of annexation comes from the laborers of the country and their leaders. The author argues that annexation can be a useful tool for expanding and strengthening a nation's influence, but that it must be done carefully and with respect for the rights of the annexed territory's inhabitants. Available in PDF, EPUB and Kindle. Book excerpt: The Constitution of Empire offers a constitutional and historical survey of American territorial expansion from the founding era to the present day. The authors describe the Constitution’s design for territorial acquisition and governance and examine the ways in which practice over the past two hundred years has diverged from that original vision. Noting that most of America’s territorial acquisitions—including the Louisiana Purchase, the Alaska Purchase, and the territory acquired after the Mexican-American and Spanish-American Wars—resulted from treaties, the authors elaborate a Jeffersonian-based theory of the federal treaty power and assess American territorial acquisitions from this perspective. They find that at least one American acquisition of territory and many of the basic institutions of territorial governance have no constitutional foundation, and they explore the often-strange paths that constitutional law has traveled to permit such deviations from the Constitution’s original meaning.

Available in PDF, EPUB and Kindle. Book excerpt: Gerald Neuman discusses in historical and contemporary terms the repeated efforts of U.S. insiders to claim the Constitution as their exclusive property and to deny constitutional rights to aliens and immigrants--and even citizens if they are outside the nation's borders. Tracing such efforts from the debates over the Alien and Sedition Acts in 1798 to present-day controversies about illegal aliens and their children, the author argues that no human being subject to the governance of the United States should be a "stranger to the Constitution." Thus, whenever the government asserts its power to impose obligations on individuals, it brings them within the constitutional system and should afford them constitutional rights. In Neuman's view, this mutuality of obligation is the most persuasive approach to extending constitutional rights extraterritorially to all U.S. citizens and to those aliens on whom the United States seeks to impose legal responsibilities. Examining both mutuality and more flexible theories, Neuman defends some constitutional constraints on immigration and deportation policies and argues that the political rights of aliens need not exclude suffrage. Finally, in regard to whether children born in the United States to illegally present alien parents should be U.S. citizens, he concludes that the Constitution's traditional shield against the emergence of a hereditary caste of "illegals" should be vigilantly preserved.
