Book excerpt: Research Paper (postgraduate) from the year 2018 in the subject Law - Comparative Legal Systems, Comparative Law, University of Prishtina (Universität Prishtina), language: English, abstract: Public administration, as a particular form of state activity practice, respectively as a particular form of practicing state executive power, represents a very important segment, both for the state that through the administration exercises its executive activity as well as for the subjects (primarily citizens) who through the administration realize their rights in relation to the state. Each state aims to practice its state activity (executive power) in such a way that its citizens can be offered the public services in the most qualitative manner possible. As a result, a qualitative public administration, consistent towards any impact and transparent with its citizens, is a necessity that each state must realize. In this context, the development and evolution of the form of practicing the state activity, namely the development and evolution of its own public administration at the current level is a result of the citizens’ needs that their rights in relation to the state (receiving public services) to be implemented in the most advanced way, on the one hand and as a result of the state's obligation to respond to these needs (public service delivery), on the other. The structural organization of the public administration in general, as well as the legal framework governing and defining this structure, are amongst the main factors influencing the advancement and reformation of public administration. In the Republic of Kosovo there is no specific law on organization of public administration, which would regulate the organization and activity of public administration, thus the structure of the organization of this administration is partially regulated by other laws that regulate the field of public administration generally. Apart from regulating the organization of state administration as a very important segment of public administration, via a special law, the rest of the organization of public administration in Kosovo cannot be stated that is not regulated however, it is partially regulated by laws and various acts, but not a special law. In this paper will be presented a reflection of the organization of public administration according to the Constitution of the Republic of Kosovo, the Law on General Administrative Procedure and other laws that regulate issues from the field of public administration, but with particular emphasis on the organization of administration state according to the Law on State Administration in the Republic of Kosovo.

Book excerpt: Kosovo has gone through several negotiations processes with Serbia during the last two decades. The failed 1999 peace talks in Rambouillet, resulted in armed conflict, the 2006/2007 negotiations on the future status/political settlement of Kosovo in Vienna resulted in a path for supervised independence, disputed by Serbia. Today, the EU facilitated negotiations in Brussels between Pristina and Belgrade that began in 2011 are about negotiating issues, in line with its goal to "...improve the lives of citizens". National minorities throughout these dialogues were subject to vulnerabilities and affirmative actions in legal and practical terms. Compromise solutions for integration of the Serb national minority in Kosovo society are being negotiated within the realm of national interests of both Kosovo and Serbia while confronted by oppositions in both countries. Brussels Agreements produced the deal for establishing the Association of Serb Majority Municipalities. The intention of this thesis is to present chronological developments through comparative and analytical methods of the legal and institutional framework since 1999. The community rights and the connotation with the on-going political dialogue, with the overall aim of providing an answer as to whether there is any added value, in legal terms, in adding another Agreement with additional guarantees to the rights already enshrined in the Constitution. Actually, due to questioned legality of the latter agreement, the Kosovo Constitutional Court has rendered a Judgment but did not present a clear view on the matter, and due to its 'ambiguity' it was also disputed and the objectivity of the Court was attributed to the current political situation. Moreover, the effects the First Agreement has had on the both parties will be presented. There is no doubt that the First Agreement on principles governing the normalization of relations between Pristina and Belgrade expands beyond the 2008 Constitution of Republic of Kosovo. Although the community rights and freedoms are guaranteed by the Constitution in addition to directly applicable international human rights instruments, including the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols and Council of Europe Framework Convention for the Protection of National Minorities.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutional politics has become a major terrain of contemporary struggles. Contestation around designing, replacing, revising, and dramatically re-interpreting constitutions is proliferating worldwide. Starting with Southern Europe in post-Franco Spain, then in the ex-Communist countries in Central Europe, post-apartheid South Africa, and now in the Arab world, constitution making has become a project not only of radical political movements, but of liberals and conservatives as well. Wherever new states or new regimes will emerge in the future, whether through negotiations, revolutionary process, federation, secession, or partition, the making of new constitutions will be a key item on the political agenda. Combining historical comparison, constitutional theory, and political analysis, this volume links together theory and comparative analysis in order to orient actors engaged in constitution making processes all over the world. The book examines two core phenomena: the development of a new, democratic paradigm of constitution making, and the resulting change in the normative discussions of constitutions, their creation, and the source of their legitimacy. After setting out a theoretical framework for understanding these developments, Andrew Arato examines recent constitutional politics in South Africa, Hungary, Turkey, and Latin America and discusses the political stakes in constitution-making. The book concludes by offering a systematic critique of the alternative to the new paradigm, populism and populist constituent politics.

Available in PDF, EPUB and Kindle. Book excerpt: Judicial control of public power ensures a guarantee of the rule of law. This book addresses the scope and limits of judicial control at the national level, i.e. the control of public authorities, and at the supranational level, i.e. the control of States. It explores the risk of judicial review leading to judicial activism that can threaten the principle of the separation of powers or the legitimate exercise of state powers. It analyzes how national and supranational legal systems have embodied certain mechanisms, such as the principles of reasonableness, proportionality, deference and margin of appreciation, as well as the horizontal effects of human rights that help to determine how far a judge can go. Taking a theoretical and comparative view, the book first examines the conceptual bases of the various control systems and then studies the models, structural elements, and functions of the control instruments in selected countries and regions. It uses country and regional reports as the basis for the comparison of the convergences and divergences of the implementation of control in certain countries of Europe, Latin America, and Africa. The book’s theoretical reflections and comparative investigations provide answers to important questions, such as whether or not there are nascent universal principles concerning the control of public power, how strong the impact of particular legal traditions is, and to what extent international law concepts have had harmonizing and strengthening effects on internal public-power control.

Available in PDF, EPUB and Kindle. Book excerpt: In a remarkably innovative reconstruction of constitutional history, Robert Burt traces the controversy over judicial supremacy back to the founding fathers. Also drawing extensively on Lincoln's conception of political equality, Burt argues convincingly that judicial supremacy and majority rule are both inconsistent with the egalitarian democratic ideal. The first fully articulated presentation of the Constitution as a communally interpreted document in which the Supreme Court plays an important but not predominant role, The Constitution in Conflict has dramatic implications for both the theory and the practice of constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: The use of referendums around the world has grown remarkably in the past thirty years and, in particular, referendums are today deployed more than ever in the settlement of constitutional questions, even in countries with little or no tradition of direct democracy. This is the first book by a constitutional theorist to address the implications of this development for constitutional democracy in a globalizing age, when many of the older certainties surrounding sovereignty and constitutional authority are coming under scrutiny. The book identifies four substantive constitutional processes where the referendum is regularly used today: the founding of new states; the creation or amendment of constitutions; the establishment of complex new models of sub-state autonomy, particularly in multinational states; and the transfer of sovereign powers from European states to the European Union. The book, as a study in constitutional theory, addresses the challenges this phenomenon poses not only for particular constitutional orders, which are typically structured around a representative model of democracy, but for constitutional theory more broadly. The main theoretical focus of the book is the relationship between the referendum and democracy. It addresses the standard criticisms which the referendum is subjected to by democratic theorists and deploys both civic republican theory and the recent turn in deliberative democracy to ask whether by good process-design the constitutional referendum is capable of facilitating the engagement of citizens in deliberative acts of constitution-making. With the referendum firmly established as a fixture of contemporary constitutionalism, the book addresses the key question for constitutional theorists and practitioners of how might its operation be made more democratic in age of constitutional transformation.
