Book excerpt: The Law of Nations and the United States Constitution offers a new lens through which anyone interested in constitutional governance in the United States should analyze the role and status of customary international law in U.S. courts. The book explains that the law of nations has not interacted with the Constitution in any single overarching way. Rather, the Constitution was designed to interact in distinct ways with each of the three traditional branches of the law of nations that existed when it was adopted--namely, the law merchant, the law of state-state relations, and the law maritime. By disaggregating how different parts of the Constitution interacted with different kinds of international law, the book provides an account of historical understandings and judicial precedent that will help judges and scholars more readily identify and resolve the constitutional questions presented by judicial use of customary international law today. Part I describes the three traditional branches of the law of nations and examines their relationship with the Constitution. Part II describes the emergence of modern customary international law in the twentieth century, considers how it differs from the traditional branches of the law of nations, and explains why its role or status in U.S. courts requires an independent, context-specific analysis of its interaction with the Constitution. Part III assesses how both modern and traditional customary international law should be understood to interact with the Constitution today.

Available in PDF, EPUB and Kindle. Book excerpt: In an auditorium in Belcourt, North Dakota, on a chilly October day in 1932, Robert Bruce and his fellow tribal citizens held the political fate of the Turtle Mountain Band of Chippewa Indians in their hands. Bruce, and the others, had been asked to adopt a tribal constitution, but he was unhappy with the document, as it limited tribal governmental authority. However, white authorities told the tribal nation that the proposed constitution was a necessary step in bringing a lawsuit against the federal government over a long-standing land dispute. Bruce's choice, and the choice of his fellow citizens, has shaped tribal governance on the reservation ever since that fateful day. In this book, Keith Richotte Jr. offers a critical examination of one tribal nation's decision to adopt a constitution. By asking why the citizens of Turtle Mountain voted to adopt the document despite perceived flaws, he confronts assumptions about how tribal constitutions came to be, reexamines the status of tribal governments in the present, and offers a fresh set of questions as we look to the future of governance in Native America and beyond.

Book excerpt: The Iroquois, also known as the Haudenosaunee or the "People of the Longhouse," are an association of several tribes of Native Americans in North America. After the Iroquoian-speaking peoples coalesced as distinct tribes, based mostly in present-day central and upstate New York, in the 16th century or earlier they came together in an association known today as the Iroquois League, or the "League of Peace and Power". The original Iroquois League was often known as the Five Nations, as it was composed of the Mohawk, Oneida, Onondaga, Cayuga and Seneca nations. After the Tuscarora nation joined the League in 1722, the Iroquois became known as the Six Nations. Some 20th century historians have debated whether the Iroquois system of government had any influence on the United States' development of the Articles of Confederation and Constitution. In 1988, Congress passed a resolution to recognize the influence of the Iroquois League upon the Constitution and Bill of Rights.Indeed, it is easy to find similarities between the two constitutions. The Iroquois' constitution -- called the Great Law of Peace -- guaranteed freedom of religion and expression and other rights later embraced in the U.S. Constitution. According to the Iroquois constitution, states were first to solve disputes between them on their own. If resolution efforts failed then the national government would take authority. The Great Law even said the national government should have a commander-in-chief and that person should present a "state of the union" address to the nation,

Book excerpt: The United States Constitution records the structure of America's public life and society, distributing power and outlining citizens' rights and privileges. Historians Christopher Waldrep and Lynne Curry's compilation of leading interpretive documents traces English and American constitutional thinking from its earliest roots in 1215, to the U.S. Supreme Court under the great chief justice John Marshall. These documents reveal the constitution as an idea, growing and evolving but always reflecting particular moments in history. This book records the drama of the young American nation searching for its identity.

But what determines the visions, aspirations and compromises that go into a written constitution? In this unique volume, constitution makers from countries around the world come together to offer their insights. Using a collection of case studies from countries with recently written constitutions, Constitution Makers on Constitution Making provides a common framework to explain how constitutions are created. Scholars and practitioners very close to the process illuminate critical insights into how participants see constitutional options, how deadlocks are broken, and how changes are achieved. This vital volume also draws lessons concerning the role of courts in policing the process, on international involvement, and on public participation.

Book excerpt: Due to a combination of heightened frustration, moves to skirt the constitutional process, and a widespread disconnect between the people and their constitutional "conscience," Lane and Oreskes warn us our longstanding Democracy is at risk. Together, they examine the Constitution's history relative to this current crisis, from its framing to its centuries-long success, including during some of the country's most turbulent and contentious times, and challenge us to let this great document work as it was designed-valuing political process over product. They hold our leaders accountable, calling on them to stop fanning the flames of division and to respect their institutional roles. In the final assessment, The Genius of America asks us to lean on the framers and their experience to secure our country's wellbeing.
