Book excerpt: "A Practical Guide to Constitution Building provides an essential foundation for understanding constitutions and constitution building. Full of world examples of ground-breaking agreements and innovative provisions adopted during processes of constitutional change, the Guide offers a wide range of examples of how constitutions develop and how their development can establish and entrench democratic values. Beyond comparative examples, the Guide contains in-depth analysis of key components of constitutions and the forces of change that shape them. The Guide analyzes the adoption of the substantive elements of a new constitution by looking at forces for the aggregation or dissemination of governmental power, and forces for greater legalization or politicization of governmental power, and examining how these forces influence the content of the constitution. It urges practitioners to look carefully at the forces at play within their individual contexts in order to better understand constitutional dynamics and play a role in shaping a constitution that will put into place a functioning democratic government and foster lasting peace."--

Book excerpt: This new Liberty Fund edition of James McClellan's classic work on the quest for liberty, order, and justice in England and America includes the author's revisions to the original edition published in 1989 by the Center for Judicial Studies. Unlike most textbooks in American Government, Liberty, Order, and Justice seeks to familiarize the student with the basic principles of the Constitution, and to explain their origin, meaning, and purpose. Particular emphasis is placed on federalism and the separation of powers. These features of the book, together with its extensive and unique historical illustrations, make this new edition of Liberty, Order, and Justice especially suitable for introductory classes in American Government and for high school students in advanced placement courses.

Observations on the tendency in government to dissolution, from a corruption of its principles.--Plan of reformation incorporated in the constitution.--Its probable effects in perpetuating its duration..Montesquieu, speaking of that kind of government, which was established through Europe try the conquerors of the Roman Empire, says--" It was a good government that had in itself a capacity of growing better." This capacity of growing better was not the effect of any direct intention of the founders, nor, if perceived, was its cultivation, generally, an object of pursuit. Accordingly, we have seen this kind of government almost universally, degenerating into a species of despotism, under an absolute monarchy, or an aristocracy equally absolute. If any of those governments have admitted improvements, these improvements never have been deliberately made, in consequence of any plan of reformation adopted in the constitution. They have been constantly introduced by violence, or, in a concurrence of circumstances, little, if at all intended or foreseen. Notwithstanding the foregoing observation of Montesquieu, he appears to join in the opinion, which has very generally prevailed, that governments, like men, carry in themselves from their very origin, the seeds of dissolution; that man is fatally incapable of forming any which shall endure without degenerating. I am, however, apprehensive, that on enquiry, we may, so far as it relates to government, find reason to doubt the correctness of this opinion. A more general development of the laws of social nature, and the principles resulting from those laws, may discover, that although in the infancy of mankind, from which, perhaps, those nations who have made the greatest advances, have hardly emerged, ...

Available in PDF, EPUB and Kindle. Book excerpt: During the Summer of 1787, a brilliant assembly of American Patriots created the Constitution of the United States. After a tumultuous start, the elder statesman, Benjamin Franklin, reminded the delegates in attendance of the need to seek a firm reliance on divine Providence. The stormy convention birthed dramatic debate, unexpected compromises, and incredible changes of minds. Ideas clashed, and tempers flared. And during it all, James Madison took painstaking notes as the conciliatory Benjamin Franklin added his wisdom here and there, and George Washington often sat silent while James Wilson argued that liberty can only survive if the government of the United States is limited in its scope and power. Despite the heat and the political clashes, what emerged was a masterpiece - the greatest document ever conceived in history, save for the Holy Bible. They created a working government that would be a powerful lion to external issues, yet caged and restrained regarding the internal issues... creating a federal government given the task of promoting, preserving, and protecting the union of States, and the autonomous sovereignty of the individual States. The Basic Constitution is written like a textbook, but in a manner that is comprehensible to every person who journeys through its pages. The book includes a glossary of terms, index, bibliography listing the resources used, The Declaration of Independence, and The Constitution of the United States. Be sure to buy the companion workbook to help in your Constitution Education! The workbook includes a list of terms for each chapter, questions for discussion, and quizzes to help you in your effort to learn the original intent of the United States Constitution. You can find the workbook under the title: The Basic Constitution - Workbook.

Book excerpt: Originally published in 1960, The Constitution of Liberty delineates and defends the principles of a free society and traces the origin, rise, and decline of the rule of law. Casting a skeptical eye on the growth of the welfare state, Hayek examines the challenges to freedom posed by an ever expanding government as well as its corrosive effect on the creation, preservation, and utilization of knowledge. In distinction to those who confidently call for the state to play a greater role in society, Hayek puts forward a nuanced argument for prudence. Guided by this quality, he elegantly demonstrates that a free market system in a democratic polity—under the rule of law and with strong constitutional protections of individual rights—represents the best chance for the continuing existence of liberty. Striking a balance between skepticism and hope, Hayek’s profound insights remain strikingly vital half a century on. This definitive edition of The Constitution of Liberty will give a new generation the opportunity to learn from Hayek’s enduring wisdom.
