Comment résoudre le paradoxe de la nécessité de préservation de la culture locale face à la mondialisation ? Le propose un édifice législatif lourd et complexe. L'essor des nouvelles technologies a bouleversé la logique du marché cinématographique en créant un vide juridique qui demande une nouvelle organisation qui prenne en compte la réalité transnationale. Le système juridique peut apporter une solution en proposant une harmonisation de la législation cinématographique afin que les échanges se fassent plus simplement. En renforçant l'arsenal juridique international, les Etats sont davantage en mesure de défendre leurs spécificités locales. L'harmonisation des marchés communs et les traités de coproduction cinématographique sont un début de réponse. Toutefois ils se heurtent souvent aux politiques supranationales de l'Organisation Mondiale du Commerce et de l'Unesco. Il est nécessaire une rupture du droit interne afin de déréglementer le secteur en faveur d'une internationalisation que fortifiera les cinématographies locales. Ceci peut se faire à travers l'harmonisation des règles nationales ou de l'hybridation de systèmes juridiques. Ainsi, la coopération cinématographique nationale se trouve renforcée.

Ces règles rendent compte de deux dimensions du cinéma, l’une industrielle, l’autre artistique. L’objet de cette thèse consiste à mettre en lumière la façon dont le droit appréhende le cinéma en tant qu’art et le dote d’une protection juridique adaptée à ce caractère. Un tel projet suppose l’analyse des différentes règles que comporte le droit du cinéma et qui relèvent elles-mêmes de diverses branches juridiques, qu’il s'agisse du droit privé ou du droit public, et du droit interne français ou du droit international. Plus précisément, cette étude a pour vocation d’interroger le droit d’auteur, le droit des aides publiques, le droit de la concurrence, les droits de la personnalité, ainsi que le droit communautaire, le droit du Conseil de l’Europe, le droit de l’OMC et le droit de l’UNESCO, pour ne citer que les disciplines principales composant le droit du cinéma. Il apparaît que la protection juridique du cinéma entendu comme art suppose l’identification préalable, par le droit, de l’identité artistique de l’œuvre cinématographique. Cette identité trouve sa source à la fois dans la culture à laquelle se rattache l’œuvre et dans l’auteur qui en assume la création. Par ailleurs, la protection juridique de l’art cinématographique suppose la protection de la liberté artistique de l’auteur qui consiste à préserver ce dernier des atteintes qui pourraient résulter de ses partenaires, lors de la création, ainsi que des exploitants de l’œuvre, lors de la diffusion de ladite œuvre.
