The party autonomy rule is the cornerstone of any modern system of choice of law; embodying as it does the freedom enjoyed by parties to a cross-border legal relationship to agree on the law applicable to it. However, as this study shows, the rule has a major shortcoming because it fails to give due regard to the contractual function of the choice of law agreement. The study examines the existing law on choice of law agreements, by reference to the law of both common and civil law jurisdictions and international instruments. Moreover, it suggests a new coherent approach to party autonomy that integrates both the law of contract and choice of law. This important new study should be read with interest by private international law scholars.

Book excerpt: First published in 1999, this book applies formal economic measures to the passenger and taxpayer benefits of public transit service in the United States under a public choice analytical framework. Approximately 400 local transit budgets have been renewed annually for more than 25 years. These budgets epitomize Braybrooke and Linblom’s concept of 'disjointed incrementalism' and Buchanan’s concept of 'Public Choice' since local legislators funded transit despite constant academic criticism of transit performance. On the other hand, Braybrooke and Lindblom and Buchanan show that local budgets capture benefits that traditional planning analysis does not grasp. This is borne out in analysis in the book. Indeed, far from draining society, transit returns five dollars in benefits for each one dollar of public subsidy. After explaining the analytical framework in Chapter 1, four chapters are devoted to measuring the value of transit benefits. The concluding chapter draws out the implications of this approach and of benefit measurement for policy and planning.

The accepted view is that efforts to protect the environment will detract from economic growth, jobs, and global competitiveness. Conversely, much advocacy on behalf of the environment focuses on the need to control growth and avoid its more damaging effects. This offers a stark choice between prosperity and growth, on the one hand, and ecological degradation on the other. Stopping or reversing growth in most countries is unrealistic, economically risky, politically difficult, and is likely to harm the very groups that should be protected. At the same time, a strategy of unguided "growth above all" would cause ecological catastrophe. Over the last decade, the concept of green growth -- the idea that the right mix of policies, investments, and technologies will lead to beneficial growth within ecological limits -- has become central to global and national debates and policy due to the financial crisis and climate change. As Daniel J. Fiorino argues, in order for green growth to occur, ecological goals must be incorporated into the structure of the economic and political systems. In this book, he looks at green growth, a vast topic that has heretofore not been systematically covered in the literature on environmental policy and politics. This paper assesses ways in which the government could coherently pursue the objectives of reducing the cost of the least cost healthy diet for Ethiopians and achieving faster inclusive agricultural transformation (IAT), for example by increasing agrifood output, creating rural off-farm employment and reducing rural poverty. The main finding is that pursuing IAT objectives also allows reducing the cost of the least-cost healthy diet. Ethiopian policymakers may consider repurposing the budget for agriculture to pursue IAT objectives as suggested in this paper in order to increase value for public money, not only in terms of agrifood output growth, job creation and poverty reduction, but also in terms of increasing the affordability of healthy diets.
