As part of the process of making an appointment to an advice and consent position, the President usually submits a nomination to the Senate. The Senate's executive clerk refers the nomination to the appropriate committee or committees on the day it is received. Most nominations are referred to one committee. For some positions, a nomination or series of nominations to a position are referred to more than one committee, pursuant to a standing order, a UC agreement, or a statutory provision. This book identifies, by Senate committee, presidentially appointed positions requiring Senate confirmation based on referrals as of October 31, 2007. Where nominations have been referred to more than one committee, the organisations and titles are noted under each of the committees to which the nominations were referred. The lists also include the lengths of fixed terms, where applicable. Some required commissions, councils, and other multi-member entities are included by their enabling statutes, to maintain political balance in some way.

GAO noted that: (1) during the 1990s, Congress responded to long-standing shortcomings in the way federal agencies were managed by creating a framework for more results-oriented management; (2) the three major areas addressed by the reforms were results-oriented decisionmaking, financial management, and information technology management; (3) no consensus has yet emerged to address what some see as the major remaining gap in that framework--strategic human capital management; (4) the Senate can facilitate progress in these key management areas by confirming nominees who have the skills and abilities to help make these reforms a reality; (5) realistically, there may be too many questions to expect each nominee to answer them all, and some questions may not be appropriate for all nominees; (6) this does not detract from their usefulness because each Senate committee planning a confirmation hearing can decide which questions to include on the prehearing questionnaire, depending on the position to be confirmed and the amount of other information the committee may require the nominee to provide; (7) GAO believes that asking questions on selected leadership and management issues will send a strong message that the Senate considers such issues to be a priority for all nominees for senior agency positions; (8) the questions can also help ensure that nominees have the requisite skills to deal effectively with the broad array of complex management challenges facing the federal government in the 21st century; and (9) in addition, if the Senate asks these questions as part of the confirmation process, then future Presidents may place added importance on ensuring that nominees have the requisite leadership and management experience for their positions before submitting their names to the Senate for confirmation.

Book excerpt: In 1998, the Defense Science Board Task Force on Human Resources Strategy was established for the purpose of evaluating the Department of Defense's (DoD's) capacity to attract and retain both civilian and military personnel. As part of this evaluation, RAND was asked to study the growth of political appointment positions within the DoD as well as to examine the appointment and confirmation process that potential political appointees face. Tasked with reviewing relevant DoD data, the National Defense Research Institute (NDRI), acting in support of the Defense Science Board Task Force, found that the number of DoD positions requiring Senate confirmation has grown significantly over the past two decades. The study also revealed that the functional responsibilities of such positions have narrowed while their vacancy rates have increased. In assessing the literature, the NDRI found that disincentives exist in the political appointment and confirmation process -- namely, requirements that candidates disclose a range of personal and financial information; requirements to comply with conflict-of-interest regulations that may require divestiture of stock holdings; and requirements to comply with extensive post employment restrictions. Additionally, the length of the appointment and confirmation process itself may serve as a disincentive to potential appointees.

The report asserted that delays in filling top executive branch leadership positions, such as those experienced during the 2000-2001 transition, could compromise national security policymaking in the early months of a new Administration. Although the unique circumstances of the 2000 presidential race truncated the ensuing transition period, the commission's observations could be applied to other recent transitions; lengthy appointment processes during presidential transitions, particularly between those of different political parties, have been of concern to observers for more than 20 years. The process is likely to develop a bottleneck during this time, even under the best of circumstances, due to the large number of candidates who must be selected, vetted, and, in the case of positions filled through appointment by the President with the advice and consent of the Senate (PAS positions), considered by that body. The appointment process has three stages: selection and vetting, Senate consideration, and presidential appointment. Congress has taken steps to accelerate appointments during presidential transitions. This book describes and analyses the processes, during a presidential transition, by which top-level executive branch PAS positions are filled. It also discusses nominations to cabinet positions during inter-term transitions; temporarily filling Presidentially appointed, Senate-confirmed positions; senate consideration of Presidential nominations; and Presidential appointee positions requiring Senate confirmations and committees handling nominations.
