Available in PDF, EPUB and Kindle. Book excerpt: From its inception, the Conference on Security and Cooperation in Europe (CSCE) provoked controversy. Today it is widely regarded as having contributed to the end of the Cold War. Bringing together new and innovative research on the CSCE, this volume explores questions key to understanding the Cold War: What role did diplomats play in shaping the 1975 Helsinki Final Act? How did that agreement and the CSCE more broadly shape societies in Europe and North America? And how did the CSCE and activists inspired by the Helsinki Final Act influence the end of the Cold War?

Book excerpt: The Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief, as proclaimed by the United Nations General Assembly in 1981, is the only universal human rights instrument specifically focusing on religious intolerance and discrimination. However, recent years have seen increasing controversy surrounding this right, in both political and legal contexts. The European Court of Human Rights has experienced a vast expansion in the number of cases it has had brought before it concerning religious freedom, and politically the boundaries of the right have been much disputed. This book provides a systematic analysis of the different approaches to religious rights which exist in public international law. The book explores how particular institutional perspectives emerge in the context of these differing approaches. It examines, and challenges, these institutional perspectives. It identifies new directions for approaching religious rights through international law by examining existing legal tools, and assesses their achievements and shortcomings. It studies religious organisations' support for international human rights protection, as well as religious critique of international human rights and the development of an alternative religious 'Bills of Rights'. It investigates whether expressions of members belonging to religious minorities can be considered under the minority right to culture, rather than the right to religion, and discusses the benefits and shortcomings of such a route. It analyses the reach and limits of the provisions in the 1981 Declaration, identifies ways in which the right is being eroded as a concept, and suggests new ways in which the right can be reinforced and protected.

Book excerpt: A broad network of bilateral treaties for the protection of national minorities has been set up during the past fifteen years. They complement and further develop the Framework Convention for the Protection of National Minorities and other multilateral instruments. Some texts are genuine international treaties, while others are non-binding political documents. The present book brings all these texts together in a reliable English translation, which offers practitioners and researchers easy access to and supplies knowledge on the present state of development of the conventional and customary sources of law in this field. The introductory study helps further understanding of the legal character of the texts and explains how to work with these often complex and interrelated sources of law.

Book excerpt: Divided between two military alliances, Europe has maintained stability based on political status quo and military power balance. However, European states—including neutral and nonaligned countries—have felt a need for a common policy to guarantee their security, and the Conference on Security and Cooperation in Europe (CSCE) was convened to address this concern. Ten years later, the authors of this study find that the outlines of a European security regime are indeed discernible. The conference in Helsinki initiated efforts for negotiated and controlled change in Europe. Contributors to this volume analyze the achievements of CSCE, consider more recent models of collective or common security systems, and deal with political and military processes at work in Europe as well as relationships with great powers and the Third World. The role of Western Europe, and particularly Finland's role as an initiator of the CSCE process, receives special attention. Documentation of the tenth anniversary meeting and the CSCE process in general are also included.

Available in PDF, EPUB and Kindle. Book excerpt: This edited volume presents a comprehensive analysis of the ‘Baltic question’, which arose within the context of the Cold War, and which has previously received little attention. This volume brings together a group of international specialists on the international history of northern Europe. It combines country-based chapters with more thematic approaches, highlighting above all the political dimension of the Baltic question, locating it firmly in the context of international politics. It explores the policy decision-making mechanisms which sustained the Western non-recognition of Soviet sovereignty over the Baltic States after 1940 and which eventually led to the legal restoration of the three countries’ statehood in 1991. The wider international ramifications of this doctrine of legal continuity are also examined, within the context both of the Cold War and of relations between post-soviet Russia and the enlarging ‘Euro-Atlantic area’. The book ends with an examination of how this Cold War legacy continues to shape relations between Russia and the West.

Book excerpt: The human dimension of the Conference on Security and Co-operation in Europe (CSCE) implies an alternative vision of security and co-operation in Europe, based on respect for human rights, democracy, the rule of law, minority rights and human contacts. Until recently the human dimension has been the main claim to perpetuity of the CSCE. It has been through the years the main point of controversy among its participating states, and has played an important role in the revolutionary events of 1989 which transformed Europe.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Convention on the Rights of the Child is the most extensive and widely ratified international human rights treaty. This Commentary offers a comprehensive analysis of each of the substantive provisions in the Convention and its Optional Protocols on Children and Armed Conflict, and the Sale of Children, Child Prostitution and Pornography. It provides a detailed insight into the drafting history of these instruments, the scope and nature of the rights accorded to children, and the obligations imposed on states to secure the implementation of these rights. In doing so, it draws on the work of the Committee on the Rights of the Child, international, regional, and domestic courts, academic and interdisciplinary scholarly analyses. It is of relevance to anyone working on matters affecting children including government officials, policy makers, judicial officers, lawyers, educators, social workers, health professionals, academics, aid and humanitarian workers, and members of civil society.
