Until recently, Europe has sought to carve out its model and role in global governance by mimicking many US policy approaches: shareholder capitalism, deregulation and unconstrained movement of capital. As the global community increasingly sees the rise of protectionist stances, and a growing inability to face emerging challenges such as sustainable development and the breath-taking rise of disruptive digital technologies, Europe should look at its best qualities to revamp and reclaim its position in the global order, to the benefit of all. The prospect of Brexit, while certainly not favourable for the Union, paradoxically opens up new opportunities to face emerging challenges with a greater degree of cohesion. This new book, a joint effort between Donald Kalff and a group of CEPS researchers led by Andrea Renda, aims at identifying and exploring Europe's 'hidden treasures', often neglected competitive advantages that could, if adequately nurtured, return the Old Continent to the forefront of the global order. 'Hidden treasures' are a feature of the EU economy, legal system or legal tradition that are being given insufficient attention in EU public policy, and which bear the potential to increase Europe's competitiveness and overall positioning in the global context. The authors find them in ten policy domains, from contract law to corporate governance, taxation, control of corruption, competition policy, trade, innovation and the EU's unique approach to governing the digital economy. Uncovering and promoting hidden treasures becomes, as of today, a timely and highly needed exercise, as the EU approaches its post-elections transition, and the global governance context seems to be rapidly changing, shaping a new playing field in which Europe has no obvious allies, and is increasingly challenged by superpowers with different, if not diverging, priorities.

Renowned in the United States for their discount centres, they have diversified into wholesaling to sustain the explosive growth of the seventies and eighties. Making use of acquired knowledge in distribution and inventory management technology, these new formulas proved to be profitable as well. However, the United States of America were not big enough to satisfy the needs of such a giant company, and international expansion was inevitable. After entry in South-America and Asia, Europe is the next market to be penetrated by Wal-Mart. The time seems right, as extensive liberalization has opened up the European Union and far-reaching economic integration between member states have created a huge common market, offering scale economies in purchasing and distribution similar to U.S. operations. Wal-Mart can use experience from previous foreign expansions to implement the correct strategy for Europe. This paper analyses Wal-Mart’s European strategy, the rational behind its move to Europe and implications for its European competitors. It explains the following problem statement: Wal-Mart’s entry into the European market was a strategic move rather than the pursuit of a growth opportunity. A brief review of Wal-Mart’s history will be followed by the factors explaining their success in the United States, coming together in a concept called “strategic fit”. After a short summary of their foreign expansion into South-America to stress the importance of the transferability of the concept of strategic fit, a description of the European retail industry will be given. Then the European retail industry is analysed with the help of the generic five forces model from Porter. The paper ends with a conclusion hinting at the future of the European retail market.

Can an understanding of this process lead to a more effective enforcement of competition law? That is the question approached in this compelling book. The author reviews the European Union’s (EU’s) Article 102 case law, comparing it with United States (US) provisions, demonstrating that new ways of looking at market power are needed – today’s tech giants differ from older monopolies. He clarifies the role of dominant firms in the competitive process, proposing that conduct should be scrutinized differently depending on the source of market power, rather than using the same approach for all dominant undertakings. Supporting his contention that the legal consequences that derive from holding a dominant position cannot be disassociated from the sources of that market power—that a dynamic understanding of dominance requires looking both forwards and backwards in time—the author examines such sources of dominance as the following: ‒ statutory dominance derived from explicit protectionist measures or subtler geoeconomic strategies; ‒ legacy firms such as the telecommunications or transport industries; ‒ natural monopolies, e.g., the exploitation of a mine; ‒ investment efforts undertaken in a competitive environment; ‒ intangible resources such as timing, reputation, experience, innovation capabilities, or managerial processes; ‒ lucky monopolies; and ‒ anticompetitive behavior on the road to dominance. Drawing insights from EU and US case law, industrial organization scholarship, and strategic management literature, the book resolves questions related to the role that the origins of market power have played and should play in the enforcement of EU competition rules against dominant firms. It concludes with a list of policy recommendations bringing the application of Article 102 TFEU against dominant firms more in line with the objective of protecting the competitive process. With its focus on how EU competition law enforcement should be fine-tuned to adequately incorporate the origins of firm dominance into the analysis of single-firm behavior, the book makes a major contribution to the analysis of anticompetitive effects. Practitioners, competition authorities, and academics in competition law will greatly appreciate the book’s combination of legal analysis and recommendations for policy reform.
