According to that plan, the third volume was to embrace the titles Carriers of Passengers, Negli gence of Municipal Corporations, and Negligence of Public Officers. It is found that the title Carriers of Passengers alone, exclusive of the analysis and index, embraces pages. This renders it im practicable to include in this volume the other two titles named, and they will be passed over to a subsequent volume. This volume embodies a complete revision of the author's previous work on Carriers of Passengers. That volume, it will be recalled, consisted of a number of leading or selected cases printed in full, and followed by extensive notes. Those notes were largely the work of Edwin G. Merrian, Esq., of the St. Louis bar, who was then the author's literary assistant, and who has been for many years an attache of the Law Department of the Missouri Pacific Railway Company. In making this revision the author has been impressed with the general care, accuracy, discrimination, and fidelity to truth, with which the portions of the original work assigned to Mr. Merrian were done; and he desires to renew his acknowledgments to that capable lawyer. Whether these are properly treated under the heading of Occupa tion of Property (at p. 438) may admit of reasonable dispute, but considerations of convenience led me to deal with them there. I' Many new cases too have had to be grouped under the Public Authorities Protection Act, 1893 (at p. And have required detailed attention. Then there were the topics which were so obviously imperfectly or confusedly dealt with in my last edition, that rewriting the portion relating to them was the only possible satisfactory way of treating them. This remedial process has been applied to the chapter on Corporations and Local Bodies, also to that on the Occupation of Property; while the chapters on Common Carriers by Water and on Collision on Water have been similarly transformed. The whole of Book VII. On Unclassified Relations has been rewritten. Of course, as the subject dealt with in the old and the new is the same, much of the difference that exists is only a difference of expression, and in many cases the old material has been used substantially unaltered where perhaps, even in my partial judgment, it is very capable of improve ment; but with all deductions in these cases, what is now presented in this group is set forth for the first time. There are other chapters, as for example that on Degrees of Negli gence (a subject on which most lawyers are dogmatists), or the following chapter, on Limitations of Liability, which are altered, not so far as to affect their identity, but sufficiently to include a modifying amount of novelty. Indeed the only chapter which is unaltered (except occasionally verbally) is that on the Duty to Answer for One's Own Acts, which is practically an examination of the grounds of the decision of Stanley v. Powell, that is introduced in a recent excellent and authoritative collection as a Leading Case. What a leading case means in this connection I cannot say but in my opinion Stanley v. Powell is not an authority for anything, but was decided on quite wrong grounds; so I have left this chapter untouched. The division of negligence into three classes: Neglect of duties requiring (1) ordinary, (2) more than ordinary, and (3) less than ordinary care appeared, upon the whole, to be a reasonable plan. This division is, no doubt, somewhat arbitrary; but it has the advantage of proceeding in some measure super antiquas vias, and it adapts itself to the increasing complexity of modern obligations. It cannot be doubted that in the progress of civilization a constantly increasing amount of care is required of men in proportion to the increased skill and intelligence which they are found to possess, to the increased difficulties of the duties which they undertake to perform, and to the keener sense of responsibility toward others which is characteristic of a more refined age. Thus it will be found, I think, that there is a tendency, both in the recent judgments of the judges and in the enactments of the Legislature, to widen the responsibilities of men in their conduct toward others. Upon the whole, then, I have thought such a division of my work to be desirable as giving a clearer view of what care the law requires in the performance of duties generally. Book excerpt: Excerpt from A Treatise on the Law of Contributory Negligence I have made this book upon the Law of Contributory Negli gence in the belief that such a work, even if only fairly well done, would be timely, and might possibly be, in some degree useful to the bench and bar. The libraries have furnished, hith erto, no separate treatise upon this subject; the latest editions of the standard Works upon the Law of Negligence, which consider Contributory Negligence only incidentally, were published sev eral years ago, and the subject is one of constant, and constantly increasing interest and importance to the profession. It is by far the most important and material branch of the Law of Negli gence, and although we already have at hand, aside from the sev eral English treatises, the three excellent American works of Messrs. Shearman Redfield, Dr. Wharton, and Judge Thomp son respectively - each in its way the best of the three - 1 have thought, because the subject is an interesting one and impinges so much upon so many other leading titles in the law, that this work of mine might supplement rather than supplant what has already been better done upon the more general subject of N egli gence, and that it might, in consequence, turn out not a wholly superfluous undertaking. I have collected and cited more than three thousand cases - not omitting, as I believe, a reference to any valuable adjudication in point, by the State and Federal courts of our own country, and have endeavored to give a due prominence to recent English authorities, and to include, par ticularly, citations from the latest volumes of the reports and from current periodical legal literature.
