Book excerpt: "An Epoch in the Law" The first systematic work on the subject and an indisputable legal classic, Story's Commentaries on the Conflict of Laws synthesized the standard sources of the day, both Anglo-American and Continental, analyzed them with great skill and arranged them in an accessible manner. It was held in high respect in North America, Great Britain and Europe and went through eight editions. Joseph Story [1779-1845] became the youngest Associate Justice of the Supreme Court of the United States in 1811 and in 1829 was appointed the first Dane Professor of Law at Harvard Law School. An important educator who played a key role in the law school's development, he wrote several influential treatises, such as the landmark Commentaries on the Constitution (1833). ..". [i]t is not too much to say that its publication constituted an epoch in the law; for it became at once the standard and almost the sole authority...[it also] received the honor of being practically the first American law book to be cited as authority in English courts."--Charles Warren, A History of the American Bar 545 CONTENTS List of Authors cited List of Cases cited I. Excerpt: ... wholly immaterial, that the law to be administered in cases of foreigners is often very distinct from the mere municipal code of a state, and dependent upon the law merchant, or the more enlarged consideration of international rights and duties, in a case of conflict of the foreign and domestic laws.1 And it may fairly be presumed, that the national tribunals will, from the nature of their ordinary functions, become better acquainted with the general principles, which regulate subjects of this nature, than other courts, however enlightened, which are rarely required to discuss them. 1693. In regard to controversies between an American and a foreign state, it is obvious, that the suit must, on one side at least, be wholly voluntary. No foreign state can be compelled to become a party, plaintiff or defendant, in any of our tribunals.* If, therefore, it chooses to consent to the institution of any suit, it is its consent alone, which can give effect to the jurisdiction of the court. It is certainly desirable to furnish some peaceable mode of appeal in cases, where any controversy may exist between an American and a foreign state, sufficiently important to require the grievance to be redressed by any other mode, than through the instrumentality of negotiations.3 DEGREES 1694. The inquiry may here be made, who are to be deemed aliens entitled to sue in the courts of the United States. The general answer is, any person, who is not a citizen of the United States. A foreigner, who is naturalized, is no longer entitled to the character tion of the constitution, by suits brought in the national courts. See Ware v. Hyllon, 3 Dall. R. 199. i See 1 Tucker's Black. Available in PDF, EPUB and Kindle. Book excerpt: More than 150 years after their first publication, Story's 1833 commentaries continue to be cited by both courts and commentators. Originally published in two forms -- a three-volume treatise and a one-volume abridgement -- the one-volume work reprinted here contains all of Story's mature thoughts on the nature of constitutional adjudication, the role of the courts, and his theories on judicial review and constitutional interpretation. This book is part of the Legal History Series, edited by H. Jefferson Powell, Duke University School of Law. "...it would not perhaps be amiss to suggest that the most important publishing event of the [Constitution's] bicentennial year was the reappearance in print of Justice Story's own one-volume abridgement of Commentaries." -- The American Journal of Legal History
