Book excerpt: The modern form of cohabitation started later and developed more slowly in Norway than in the other Scandinavian countries. Now the differences between the Scandinavian countries are much smaller, and cohabitation is more common than in any other parts of Europe. The percentage of Norwegian women aged twenty to thirty-nine who are cohabiting is more than twice that in Great Britain. Several responses to the changing family behaviour have been adopted since the late 1960s, but major amendments in the laws and regulations were not put into force until the 1990s. Today, cohabiting couples who have children together or have lived together for minimum two years will have many of the same rights and obligations to social security, pensions and taxation as their married counterparts. As regards the economic relationships between cohabiting partners no intervention is still the main principle. The Norwegian family policy reflects a relatively smooth and pragmatic adaption to the changing nuptiality pattern, but there is no wish to erase totally the differences between cohabiting and married couples.

At present the law in Britain retains important distinctions in the way it treats cohabiting and married families and this can have deleterious effects on the welfare of children and partners on cohabitation breakdown or death of a partner. Should the law be changed to reflect this changing social reality? Or should it - can it - be used to direct these changes? Using findings from their recent Nuffield Foundation funded study, which combines nationally representative data with in-depth qualitative work, the authors examine public attitudes about cohabitation and marriage, provide an analysis of who cohabits and who marries, and investigate the extent and nature of the 'common law marriage myth' (the false belief that cohabitants have similar legal rights to married couples). They then explore why people cohabit rather than marry, what the nature of their commitment is to one another and chart public attitudes to legal change. In the light of this evidence, the book then evaluates different options for legal reform.

In 1971, Shorter, Knodel and Van de Walle found that children born in rural Slavic communities in unlawful but stable, consensual unions were not recognised by civil law and the Church, and were registered as illegitimates, but in a cultural perspective were considered as legitimate.
