Available in PDF, EPUB and Kindle. Book excerpt: Over the past decade, DR Congo and South Africa have attracted global attention for high rates of sexual and gender-based violence. Why is it that courts in eastern DR Congo have offered a robust judicial response, prioritizing gender crimes despite considerable logistical challenges, whilst courts in South Africa, home to a far stronger legal infrastructure and human rights record, have failed to provide justice to victims of similar crimes? Lake shows that state fragility in DR Congo has created openings for human rights NGOs to influence legal processes in ways that have proved impossible in countries like South Africa, where the state is stronger. Yet exploiting opportunities presented by state fragility to pursue narrow human rights goals invites a host of new challenges. Strong NGOs and Weak States documents the promises and pitfalls of human rights and rule of law advocacy undertaken by NGOs in strong and weak states alike.

Available in PDF, EPUB and Kindle. Book excerpt: Uwe Kischel's comprehensive treatise on comparative law offers a critical introduction to the central tenets of comparative legal scholarship. The first part of the book is dedicated to general aspects of comparative law. The controversial question of methods, in particular, is addressed by explaining and discussing different approaches, and by developing a contextual approach that seeks to engage with real-world issues and takes a practical perspective on contemporary comparative legal scholarship. The second part of the book offers a detailed treatment of the major legal contexts across the globe, including common law, civil law systems (based on Germany and France, and extended to Eastern Europe, Scandinavia, and Latin America, among others), the African context (with an emphasis on customary law), different contexts in Asia, Islamic law and law in Islamic countries (plus a brief treatment of Jewish law and canon law), and transnational contexts (public international law, European Union law, and lex mercatoria). The book offers a coherent treatment of global legal systems that aims not only to describe their varying norms and legal institutions but to propose a better way of seeking to understand how the overall context of legal systems influences legal thinking and legal practice.

Book excerpt: This book provides a comparative analysis of the potential of restorative justice approaches to dealing with mass victimization in the context of large-scale violent conflicts focusing on case studies from Kosovo, Israel-Palestine and Congo, incorporating contributions from leading authorities in these areas. One of the main objectives of the book is to examine if, how and to what extent restorative justice is applicable in various different cultural, social and historical contexts, and what common themes can be identified within the different regions under analysis. The book will also provide a critical analysis of the UN Basic Principles on the use of restorative justice programmes in criminal matters as applied to the context of large scale violence.

Book excerpt: How has Pope Francis’s groundbreaking document on marriage and family, Amoris Laetitia, been implemented in Africa? In Asia? In Latin America? In this volume, scholars from across these regions reflect on their experiences, correcting the overly western focus of most reactions to AL. The contributions look at local issues like polygamy in Africa, as well as more global issues in a local context, like feminism in Indonesia and synodality in Colombia. The reader will find that concerns about marriage and family can be similar throughout the world or specific to different contexts. As a whole, the book contributes to a more diverse and revisited catholic understanding of marriage and family.

Book excerpt: When, why and how can religion and culture be both sources, and places of expression for fundamentalisms, particularly in relation to politics? Those are the central questions asked throughout this book alongside a discussion on the result when religion, strenthened by culture, is used as a political tool to access moral and social power. Cultural and religious messages often form the basis of decisions, laws and programs made in politics, and have a direct effect on society in general, and on women and gender relations in particular. The various forms taken by fundamentalisms in some African countries and the contexts under which they have emerged, the ways in which they (re)shape identities and relationships between men and women are also analysed in this book. These fundamentalisms are frequently sources of concern in social debates, in feminist and feminine organizations as well as in academia and politics. The manipulation of cultures and religions are becoming progressively political, and consequently can cause social discrimination, or even physical, moral, and symbolic violence.

Available in PDF, EPUB and Kindle. Book excerpt: In August 2008, Heads of State of the Southern African Development Community adopted the ground-breaking SADC Protocol on Gender and Development. This followed a concerted campaign by NGOs under the umbrella of the Southern Africa Gender Protocol Alliance. By the 2013 Heads of State summit, 13 countries had signed and 12 countries had ratified the SADC Gender Protocol. The Protocol is now in force. With two years to go, time is ticking to 2015, when governments need to have achieved 28 targets for the attainment of gender equality. In keeping with the Alliance slogan: "Yes we must", this 2013 Barometer provides a wealth of updated data against which progress will be measured by all those who cherish democracy in the region. The SADC Gender and Development Index (SGDI), introduced in 2011, complements the Citizen Score Card (CSC) that has been running for five years to benchmark progress.

This book was released on 2003-11-10 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Twa, as an indigenous people in the Great Lakes region of Africa, are shunned by many other ethnic groups. If Twa communities as a whole suffer from discrimination, marginalization and extreme poverty, then Twa women suffer this and more. This situation has been exacerbated by violent conflict in the region. Dorothy Jackson has many years experience of working with the region’s Twa communities and Twa women. Twa women’s voices can be heard clearly in this report, calling for change and for recognition of their rights – as indigenous people and as women. Despite the day-to-day discrimination and poverty, Twa women are resourceful and resilient, as this report shows. Central to the issues facing Twa women, and their communities, is land. Twa have traditionally been dependent on their forests and land but today most Twa are landless. Their culture – and even their existence – is under threat. Added to this, the changes that are happening within Twa societies are overturning the relatively equal relationship between women and men. This report considers government policies and international human rights law that could be used by Twa organizations and support agencies in Burundi, Democratic Republic of Congo, Rwanda and Uganda. The report concludes with a set of recommendations aimed at these states’ governments and at development organizations.
