Based on in-depth studies of Norway, Sweden, Finland, Denmark, and Iceland, the authors compare these cases with legal aid in Europe and the US to examine whether a single, unique Nordic model exists. Contextualizing Nordic legal aid in relation to welfare ideology and human rights, Hammerslev and Halvorsen Rønning consider whether flaws in the welfare state exist, and how legal aid affects disadvantaged citizens. Book excerpt: Access to justice is a vital element in the democratic process and one of the basic principles of the rule of law. Access to legal aid – the provision of legal advice, assistance and/or representation at either no cost or subject to a financial contribution – is crucial to ensure access to justice. The guidelines on the efficiency and the effectiveness of legal aid schemes in the areas of civil and administrative law were adopted by the Committee of Ministers of the Council of Europe on 31 March 2021. The guidelines take into account existing international, European and national standards relating to legal aid, and are built on the expertise of the European Committee on Legal Co-operation (CDCJ) in legal aid policy and practice. They are designed to serve as a practical guide to support the implementation of existing standards, without necessarily changing organisational frameworks in place, in order to strengthen national legal aid schemes in the areas of civil and administrative law. The guidelines include generic solutions on issues such as early intervention with the help of legal aid systems (preliminary legal aid), quality assurance mechanisms in legal aid schemes, means and merits testing, organisation of legal aid system and availability of legal aid providers, and data collection. Further guidance is available in the accompanying explanatory memorandum of the guidelines. This publication is aimed at decision-makers and practitioners working to develop and improve the functioning of legal aid schemes at national level. It also aims to support member States’ efforts towards the implementation of the 2030 Agenda for Sustainable Development vision of a “just, equitable, tolerant, open and socially inclusive world in which the needs of the most vulnerable are met”, and notably SDG 16.3’s promises to ensure equal access to justice for all.

It examines particularly how such redress may be achieved through mechanisms such as multi-party actions (MPAs). In order to do this, an analytical framework is created against which to evaluate various multi-party procedures. This is illustrated through the experience of a selection of common law jurisdictions in dealing with mass harm – namely that of England and Wales, Canada, Australia and the United States, as well as that of EU collective redress. It examines multi-party action laws benchmarked against the objectives identified in the analytical framework. The phenomenon of environmental mass harm in particular is explored as a case study, as it illustrates some of the difficulties that may arise in mass harm litigation. Also, this work explores where the best solutions for mass harm redress may lie in the future – perhaps in collective actions or through alternatives such as regulation and alternative dispute resolution or a combination of these. Finally, the experience of mass harm litigation in Ireland is examined, as currently this jurisdiction does not have an effective mechanism for dealing with mass harm. Book excerpt: In this report, the Justice Committee examines the Government's proposed reform of legal aid. The proposals are intended to reduce by £350 million a year the cost of the system (which, with expenditure of more than £2 billion annually, is one of the most expensive in the world) at a time when the Ministry of Justice has to reduce its overall spending by almost a quarter. Certain areas of law will fall outside the scope of legal aid, with some being removed in their entirety, which includes family law, though not domestic violence. The Committee is unconvinced that using domestic violence as a proxy for the most serious cases is advisable and calls on Government to look at other ways legal aid can be focussed on the most serious family law cases. The Committee does welcome the Government's support for mediation services in family cases, but does not see this as a panacea. Further work needs to be done on how difficult and unresolved cases can be dealt with if legal aid is not available. The implementation of the proposals regarding family law should not happen before the Family Justice Review Panel has produced its full report. Cost reduction is achievable through public bodies, such as the Department for Work and Pensions, getting their decisions right first time and avoiding expensive court and tribunal cases. The Committee also thinks that the Government should reconsider whether legal aid should be available for certain types of judicial review. There is a degree of consensus amongst all political parties that the cost of legal aid needs to be reduced, but it is imperative that there is a careful assessment of the impact of the proposed changes on those people most dependent on legal aid. The Government needs to refine its proposals further before introducing a major change in the way the accessibility of the justice system has come to be viewed.
