Book Synopsis The United Nations Principles to Combat Impunity: A Commentary by : Frank Haldemann
Download or read book The United Nations Principles to Combat Impunity: A Commentary written by Frank Haldemann and published by Oxford University Press. This book was released on 2018-03-21 with total page 592 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fight against impunity has become a growing concern of the international community. Updated in 2005, the UN Set of Principles for the Protection and Promotion of Human Rights Through Action to Combat Impunity is the fruit of several years of study, developed under the aegis of the UN Commission on Human Rights and then affirmed by the Human Rights Council. These Principles are today widely accepted as constituting an authoritative reference point for efforts in the fight against impunity for gross human rights abuses and serious violations of international humanitarian law. As a comprehensive attempt to codify universal accountability norms, the UN Set of Principles marks a significant step forward in the debate on the obligation of states to combat impunity in its various forms. Bringing together leading experts in the field, this volume provides comprehensive academic commentary of the 38 principles. The book is a perfect companion to the document, setting out the text of the Principles alongside detailed analysis, as well as a full introduction and a guide to the relevant literature and case law. The commentary advances debates and clarifies complex legal issues, making it an essential resource for legal academics, students, and practitioners working in fields such as human rights, international criminal law, and transitional justice.
Book Synopsis Uniform Impunity by : Human Rights Watch (Organization)
Download or read book Uniform Impunity written by Human Rights Watch (Organization) and published by Human Rights Watch. This book was released on 2009 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: It tolerates the military investigating itself through a system that lacks basic safeguards to ensure independence and impartiality. This report describes 17 cases involving egregious crimes by soldiers against more than 70 victims, including several cases from 2007 and 2008. None of the military investigations of army abuses analyzed here has led to a criminal conviction of even a single soldier for human rights violations. A civilian investigation was conducted in one of the cases and led to the conviction of four soldiers. The military invokes the Code of Military Justice and a strained constitutional interpretation to justify exerting jurisdiction over the cases. Civilian prosecutors have typically accepted the military's jurisdiction grab. But this outcome is not prescribed by Mexico's Constitution and is inconsistent with a recent binding Supreme Court decision.
Book Synopsis The International Criminal Court and National Courts by : Nidal Nabil Jurdi
Download or read book The International Criminal Court and National Courts written by Nidal Nabil Jurdi and published by Routledge. This book was released on 2016-03-03 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes the position of the ICC in relation to national court systems. The research illustrates that what seemed to be a straight forward relationship between the ICC and national courts under the complementarity mechanism, proves to be much more complex in practice. Using the referrals of Uganda and Darfur, the book demonstrates ways in which it might be possible to prosecute for crimes currently not prosecuted by the ICC and brings to light possible solutions to overcome the gaps in law and practice in the jurisdictional relation between the ICC and national systems. It will be of value to academics, students and policy-makers working in the area of international law, international organizations, and human rights.

Available in PDF, EPUB and Kindle. Book excerpt: The present edition of the Human Rights in Development Yearbook is the thirteenth edition in this series. With this volume, the yearbook’s formal structure has shifted from that of a journal to a thematic anthology. The theme of this year’s volume is “Reparations: Redressing Past Wrongs”. The articles contained in the publication primarily stem from contributions prepared for a conference entitled “The Right to Compensation and Related Remedies for Racial Discrimination” that was hosted by the Danish Centre for Human Rights in April 2001. The conference was organised in anticipation of the World Conference Against Racism, Racial Discrimination, Xenophobia and Related Intolerance, which was held in Durban in September 2001. The publication consists of 15 articles divided into four main parts addressing the subjects of “Reparations at the National and Regional Levels”, “Precedence and Standing of International Law”, “The Moral and Social Aspects of Reparation” and “Reflections”. Human Rights in Development is the result of a joint research project born out of longstanding co-operation between the following research institutes and centres for human rights: the Christian Michelsen Institute, Bergen; the Danish Centre for Human Rights, Copenhagen; the Icelandic Human Rights Centre, Reykjavik; the Ludwig Boltzmann Institute of Human Rights, Vienna; the International Centre for Human Rights and Democratic Development, Montreal; the Netherlands Institute of Human Rights, Utrecht; the Norwegian Institute of Human Rights, Oslo; the Raoul Wallenberg Institute of Human Rights and Humanitarian Law, Lund and Åbo Academy University, Åbo.

Book Synopsis The Old Bridge of Mostar and Increasing Respect for Cultural Property in Armed Conflict by : Jadranka Petrovic
Download or read book The Old Bridge of Mostar and Increasing Respect for Cultural Property in Armed Conflict written by Jadranka Petrovic and published by Martinus Nijhoff Publishers. This book was released on 2012-11-08 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although it is precious to all humanity, including future generations, cultural property is targeted wilfully during armed conflict. In the litany of other war crimes the wilful destruction of cultural property is pushed from centre stage. The deliberate destruction of the Old Bridge of Mostar is emblematic of tragedies wrought on priceless cultural objects internationally. Drawing on the relevant rules of international humanitarian law and the jurisprudence of the International Criminal Tribunal for the former Yugoslavia, this book analyses the normative implications of the deliberate targeting and destruction of the Old Bridge and also examines enforcement efforts in order to identify issues relating to international legal protection of cultural property arising from this incident.
Book Synopsis Overcoming Obstacles to Peace by : James Dobbins
Download or read book Overcoming Obstacles to Peace written by James Dobbins and published by Rand Corporation. This book was released on 2013 with total page 349 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This volume analyzes the impediments that local conditions pose to successful outcomes of nation-building interventions in conflict-affected areas. Previous RAND studies of nation-building focused on external interveners' activities. This volume shifts the focus to internal circumstances, first identifying the conditions that gave rise to conflicts or threatened to perpetuate them, and then determining how external and local actors were able to modify or work around them to promote enduring peace. It examines in depth six varied societies: Cambodia, El Salvador, Bosnia and Herzegovina, East Timor, Sierra Leone, and the Democratic Republic of the Congo. It then analyzes a larger set of 20 major post-Cold War nation-building interventions. The authors assess the risk of renewed conflict at the onset of the interventions and subsequent progress along five dimensions: security, democratization, government effectiveness, economic growth, and human development. They find that transformation of many of the specific conditions that gave rise to or fueled conflict often is not feasible in the time frame of nation-building operations but that such transformation has not proven essential to achieving the primary goal of nation-building -- establishing peace. Most interventions in the past 25 years have led to enduring peace, as well as some degree of improvement in the other dimensions assessed. The findings suggest the importance of setting realistic expectations -- neither expecting nation-building operations to quickly lift countries out of poverty and create liberal democracies, nor being swayed by a negative stereotype of nation-building that does not recognize its signal achievements in the great majority of cases."--Page 4 of cover.
