Book excerpt: At least since the publication of Isaiah Berlin's famous essay "Two Concepts of Liberty" nearly half a century ago, political philosophers have argued vigorously over the relative merits of "positive" and "negative" accounts of freedom. Matthew Kramer writes squarely within the negative-liberty tradition, but he incorporates a number of ideas that are quite often associated with theories of positive liberty. Much of The Quality of Freedom is devoted to elaborating the necessary and sufficient conditions for the existence of particular freedoms and unfreedoms; however, the book's cardinal objective is to establish the measurability of each person's overall freedom and of each society's aggregate freedom. On the one hand, Kramer contends that the existence of any particular instance of liberty or unfreedom is a matter of fact that can be confirmed or disconfirmed without any reliance on evaluative or normative considerations. On the other hand, he argues that the extent of each person's overall freedom or unfreedom cannot be ascertained entirely in the absence of evaluative assumptions. By combining those two positions and developing them in detail, Kramer pits himself against all positive accounts of liberty and most negative accounts. In the course of so doing, he aims to demonstrate the rigorous measurability of overall liberty - something that many writers on freedom have casually dismissed as impossible. Although Kramer concentrates principally on constructing a systematic analysis of sociopolitical freedom, he engages critically with the work of many of the leading contemporary writers on the topic.

Book excerpt: Against jurisprudential reductions of Spinoza’s thinking to a kind of eccentric version of Hobbes, this book argues that Spinoza’s theory of natural right contains an important idea of absolute freedom, which would be inconceivable within Hobbes’ own schema. Spinoza famously thought that the universe and all of the beings and events within it are fully determined by their causes. This has led jurisprudential commentators to believe that Spinoza has no room for natural right – in the sense that whatever happens by definition has a ‘right’ to happen. But, although this book demonstrates how Spinoza constructs a system in which right is understood as the work of machines, by fixing right as determinate and invariable, Stephen Connolly argues that Spinoza is not limiting his theory. The universe as a whole is capable of acting only in determinate ways but, he argues, for Spinoza these exist within a field of infinite possibilities. In an analysis that offers much to ongoing attempts to conceive of justice post-foundationally, the argument of this book is that Spinoza opens up right to a future of determinate interventions –as when an engineer, working with already-existing materials, improves a machine. As such, an idea of freedom emerges in Spinoza: as the artful rearrangement of the given into new possibilities. An exciting and original contribution, this book is an invaluable addition, both to the new wave of interest in Spinoza’s philosophy, and to contemporary legal and political theory.

During the ensuing century, black leaders built on this foundation and constructed a distinctive and vibrant tradition through their celebrations of the end of slavery in New York State, the British West Indies, and eventually the United States as a whole. In this revealing study, Mitch Kachun explores the multiple functions and contested meanings surrounding African American emancipation celebrations from the abolition of the slave trade to the fiftieth anniversary of U.S. emancipation. Excluded from July Fourth and other American nationalist rituals for most of this period, black activists used these festivals of freedom to encourage community building and race uplift. Kachun demonstrates that, even as these annual rituals helped define African Americans as a people by fostering a sense of shared history, heritage, and identity, they were also sites of ambiguity and conflict. Freedom celebrations served as occasions for debate over black representations in the public sphere, struggles for group leadership, and contests over collective memory and its meaning. Based on extensive research in African American newspapers and oration texts, this book retraces a vital if often overlooked tradition in African American political culture and addresses important issues about black participation in the public sphere.
