Book excerpt: When conducting parenting plan evaluations, mental health professionals need to be aware of a myriad of different factors. More so than in any other form of forensic evaluation, they must have an understanding of the most current findings in developmental research, behavioral psychology, attachment theory, and legal issues to substantiate their opinions. With a number of publications on child custody available, there is an essential need for a text focused on translating the research associated with the most important topics within the family court. This book addresses this gap in the literature by presenting an organized and in-depth analysis of the current research and offering specific recommendations for applying these findings to the evaluation process. Written by experts in the child custody arena, chapters cover issues associated with the most important and complex issues that arise in family court, such as attachment and overnight timesharing with very young children, dynamics between divorced parents and children's potential for resiliency, co-parenting children with chronic medical conditions and developmental disorders, domestic violence during separation and divorce, gay and lesbian co-parents, and relocation, among others. The scientific information provided in these chapters assists forensic mental health professionals to proffer empirically-based opinions, conclusions and recommendations. Parenting Plan Evaluations is a must-read for legal practitioners, family law judges and attorneys, and other professionals seeking to understand more about the science behind child custody evaluations.

It is an important educational tool for judges, lawyers, social workers, therapists, politicians, and the general public so that people realize what still occurs today. A National Health Crisis, Maralee’s story reveals the last taboo and a crime that needs the public's attention, and emphasizes the need for training in the dynamics of maltreatment so that no more mothers have to suffer what happened to Maralee and her daughter.

This book is a guide for therapists, child protective workers, family and juvenile court personnel, and other human service providers in addressing the complex impact that batterers -- specifically, male batterers of a domestic partner when there are children in the household -- have on family functioning.

Available in PDF, EPUB and Kindle. Book excerpt: What is the best way to work with fathers who have a history of abusive behavior? This question is among the thorniest that social service and criminal justice professionals must deal with in their careers, and in this essential new work Jeffrey L. Edleson, Oliver J. Williams, and a group of international colleagues examine the host of equally difficult issues that surround it.Beginning with the voices of mothers and fathers who speak about men's contact with and parenting of their children, the authors then examine court and mental health services perspectives on how much involvement violent men should have in their children's lives. The second half of the book showcases programs such as the Boston-based Fathering After Violence initiative and the Caring Dads program in Canada, which introduce non-abusive parenting concepts and skills to batterers and have developed useful guidelines for intervention with these fathers.Visionary but also practical, Parenting by Men Who Batter distills the most relevant policy issues, research findings, and practice considerations for those who coordinate batterer programs or work with families, the courts, and the child welfare system. It guides professionals in understanding men who batter, assessing their parenting skills, making decisions about custody and visitation, and modeling treatment programs that engage fathers in their children's lives while maximizing safety.

Available in PDF, EPUB and Kindle. Book excerpt: Find out how evaluators, mediators, and judges deal with the issues of relocation in divorced families In the past, the relocation of a parent or child in custody cases was rarely a problem for divorced families—there was little conflict and little need for court intervention. But with the growth of shared custody, more fathers involved in parenting after divorce, and an increase in litigation between conflicted parents, relocation has become a complex issue that’s difficult for evaluators, judges, and public policymakers to resolve. Relocation Issues in Child Custody Cases offers a firsthand look at how evaluators investigate, predict, and make recommendations; how judges reach decisions based on those recommendations; and how individual states deal with relocation cases. Relocation Issues in Child Custody Cases examines how evaluators, mediators, and judges can best facilitate an environment where a child has an ongoing relationship with two parents, regardless of where each parent lives. This unique book looks at how the landscape in relocation cases has changed since the California Supreme Court’s landmark 2004 ruling in the LaMusga move-away case, examining relevant topics, including individual state statutes on relocation; a survey of courts in the United States; the functions of an evaluator; how a judge analyzes data before reaching a decision; parental conflict; domestic violence; change of circumstances; primary residence; and the process of developing parenting plans. Relocation Issues in Child Custody Cases examines: whether negative outcomes of parental relocation after divorce were a result of pre-existing conflict and domestic violence whether the “best interests of the child” is an acceptable standard in relocation cases investigative models for evaluators “for the move” and “against the move” biases—and how to reduce them a format for analyzing evidence in relocation cases the risks and benefits of presumptions in family law matters and much more Relocation Issues in Child Custody Cases is an essential resource for evaluators, mediators, judges, caseworkers, child psychologists, family therapists, and child advocates.

Book excerpt: What are the social and cultural features that have the most impact on the interpretation of the legal standard, “best interest of the child”? One method for answering this question is through a comparison of two societies, Sweden and the United States, both of which apply the same legal standard to similar contested custody and visitation cases. This study views love, law, and knowledge as separate discourses. Love encompasses the interpretations of the actors whose claims arise from the emotions associated with care, concern, and relationships, namely parents, the children who are the subject of a case, and other family members. Justice encompasses the interpretations and claims which are made by judges, but its discourse includes the legal process and legal policies. Knowledge is encompassed by the concerns and claims of professionals and/or experts including social science discussions of care, welfare, and psychology and the interpretations and descriptions given by the professionals and experts regarding the actors in the cases. This book hypothesizes that a comparison of two societies that focuses on the interaction between the discourses of love, justice, and knowledge, in the process of decision-making in best interests of the child disputed custody cases, reveals features of decision-making that would be unavailable to researchers studying custody disputes in only one society.

Available in PDF, EPUB and Kindle. Book excerpt: "High rates of domestic violence exist in families referred for child custody evaluations. These evaluations can produce potentially harmful outcomes, including the custody of children being awarded to a violent parent, unsupervised or poorly supervised visitation between violent parents and their children, and mediation sessions that increase danger to domestic violence victims. Past research shows that domestic violence is frequently undetected in custody cases or ignored as a significant factor in custody-visitation determinations. Previous research also indicates that violence - and its harmful effects on victims and children - often continues or increases after separation. Little is known, however, about child custody evaluators' beliefs, background, knowledge about domestic violence, and other factors that may shape their recommendations regarding custody and parent-child visitation arrangements. The purpose of this study was to further our understanding of what child custody evaluators and other professionals believe regarding allegations of domestic abuse made by parents going through a divorce ... We also conducted in-depth qualitative interviews with 24 domestic abuse survivors who experienced negative custody-visitation outcomes, such as losing custody of their children."--Page 4.
