Book excerpt: In light of recent terrorist activity within our nation's borders, the United States has become increasingly aware of the need to be prepared to respond to emergencies, including those involving hazardous chemicals. To help protect communities from incidents involving hazardous chemicals, local emergency responders need information such as the types of chemicals used or stored at facilities in their communities. Two federal laws require chemicals facilities to provide such information: the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA) and the Clean Air Act Amendments of 1990. EPCRA, among other things, requires facilities to annually complete and submit chemical inventory forms to their state and local emergency response officials to help them prepare for and respond to chemical incidents. The Clean Air Act's risk management plan provisions, which focus on accident prevention and preparedness planning, require facilities that handle specified quantities of certain substances to develop and register risk management plans with the Environmental Protection Agency (EPA), at least every 5 years. The Clean Air Act also requires that these plans be submitted to state and local agencies responsible for preparing for or responding to accidental chemical releases. EPA oversees the implementation of both acts, but has delegated some authority for implementation of the Clean Air Act's risk management provisions to some state and local governments.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The goal of part 68 — the risk management program — is to prevent accidental releases of substances that can cause serious harm to the public and the environment from short-term exposures and to mitigate the severity of releases that do occur. The 1990 Amendments to the Clean Air Act (CAA) require EPA to issue a rule specifying the type of actions to be taken by facilities (referred to in the law as stationary sources) to prevent accidental releases of such hazardous chemicals into the atmosphere and reduce their potential impact on the public and the environment. If your warehouse is part of a larger facility that processes or uses chemicals or stores large quantities of chemicals for its own use, there will be information that is applicable to those other operations that is not presented in this document. For those operations, you should consult the General Guidance of Risk Management Programs or EPA's other industry-specific guidance documents, as appropriate.
