Book excerpt: Dans le cadre du protocole de Kyoto (1997) qui complète la convention-cadre des Nations unies sur les changements climatiques de 1992, l'instauration de mécanismes de contrôle et de sanction du non-respect efficaces représente un enjeu majeur. Le contrôle de la loyauté des échanges et la sanction des fraudes constituent des conditions impératives pour le bon fonctionnement des mécanismes de flexibilité Institués par le protocole. Ils sont particulièrement justifiés pour des raisons de concurrence économique, au regard des risques de comportements de " passager clandestin ". De fait, la procédure de non-respect (dite de l'observance), dessinée à Marrakech en 2001 et adoptée lors de la première réunion des parties au protocole à Montréal en 2005, est originale à bien des égards. L'objectif est de faciliter, de favoriser et de garantir le respect des engagements découlant du protocole de Kyoto Il s'agit avant tout de prévenir les manquements, en identifiant les difficultés le plus en amont possible, plutôt que de régler de véritables différends. La procédure prévoit des réactions graduelles aux manquements identifiés, allant de l'accompagnement à la sanction. Lors d'un manquement avéré, le comité de contrôle peut notamment suspendre l'admissibilité aux mécanismes de flexibilité et, en cas d'excès d'émissions, réduire les quotas futurs de la partie concernée. Les sanctions peuvent donc être significatives. Sans équivalent dans d'autres conventions environnementales internationales, par sa complexité, son raffinement et ses conséquences potentielles, le mécanisme de l'observance représente l'une des avancées remarquables obtenues dans les négociations internationales sur les changements climatiques. Cet ouvrage en propose une analyse fouillée, sous l'angle principalement juridique, mais enrichie par l'éclairage de l'économie et de la science politique. Il en cerne les enjeux, en présente le contenu et le compare à d'autres procédures de contrôle en droit national, européen et international, dans et hors du champ de l'environnement. Rédigé aussi bien à l'intention des praticiens que des chercheurs, l'ouvrage s'inscrit dans une réflexion plus large sur l'effectivité, voire l'utilité, du droit international au début du XXIe siècle. Cet ouvrage est le fruit d'une recherche collective pluridisciplinaire menée durant deux ans au sein du CERIC. Cette recherche a bénéficié d'un financement de l'Agence de l'environnement et de la maîtrise de l'énergie (ADEME), dans le cadre d'un appel à propositions du Ministère de l'écologie et du développement durable (programme Gestion et impacts du changement climatique, Faculté de droit et de science politique).
