Available in PDF, EPUB and Kindle. Book excerpt: In practice, most education systems have both centralized and decentralized elements. Planners involved in a decentralizing reform must identify which components of the system are more appropriately managed at the central level and which at the local level. This book is intended to inform education policymakers, planners, and practitioners about international experience in the legal aspects of decentralizing basic education. It also provides a basic understanding of how laws and regulations can be used for education reform. For purposes of the discussion, decentralization is used to describe efforts to transfer decision making power in basic education from the administrative center of a country to authorities closer to users. The term is also used in a more technical sense to describe one of the many forms this type of reform can take, and in this sense it is contrasted with deconcentration and devolution as educational reforms. The first section examines the general legal aspects of decentralization, and the second looks more closely at decentralization laws and regulations. The third section is, in effect, a checklist of items that should be included in decentralization laws, and the fourth section provides a road map to help the planner prepare and implement the laws required for reform. Although an effort has been made to keep the discussion general enough for use in many countries, the analysis is based on the legal systems of the Western world or those that they inspired. Book excerpt: This timely book examines the ever-increasing prevalence of Central Purchasing Bodies (CPBs), analysing their use and structure across different EU Member States. It argues that since CPBs are only partially regulated at EU level, their operations will depend on the legislation of the individual Member States and more importantly on the States’ distinct practices and traditions. Comparative contributions consider the legal nature and structures of CPBs across 12 Member States and the UK.

Book excerpt: The proper functioning of the EU financial market is protected by public actors - both national and supranational - responsible for rulemaking and supervision of investment firms and other private actors. At the same time the effectiveness of the EU legal system requires vigilance from private actors such as investment firms but also their clients, invoking their rights before national authorities and courts. This means that investment firms have a dual role within the system, turning them into subjects of control and enforcement but also agents in the maintenance of the rule of law. Legal Accountability in EU Markets for Financial Instruments brings together a group of scholars with expertise from different legal disciplines but a shared interest for the EU internal market and the way it develops. It integrates a modern study of the form and function of EU rulemaking in the internal market after the financial crisis. The book includes an evaluation of core aspects of rulemaking in the financial market and that way provides a cross-cutting treatment of EU law. The focus of the book is set on the regulatory framework in MiFIDII and MiFIR and thematic questions around legal mechanisms for accountability and the role of investment firms in the operation of those mechanisms. It further discusses the implications for EU law and the EU legal system and gives readers a thorough understanding of the concept of accountability through its own findings.

Book excerpt: The Future of European Union Environmental Politics and Policy investigates the trajectory of European Union (EU) environmental policy and reflects on how this hugely vital policy area of the EU has evolved over the decades. Gathering together a selection of the leading scholars working on European environmental policy, the volume assesses the extent to which change has occurred in important dimensions of EU environmental policy research. These dimensions include the EU’s values and approaches; the provision of leadership; the possibilities of Brexit and the dismantling of policies; policy instruments and climate change; policy implementation and enforcement; and policy evaluation. The contributors situate their research in the context of current developments and conditions, including the global economic challenges and the rise of political challenges to both European governance and integration. Each chapter reviews the EU environmental policy over the long term and assesses the implications of current developments for the future health of European environmental policy, European integration and the environment itself. The Future of European Union Environmental Politics and Policy will be of great interest to scholars of environmental politics, environmental governance and EU policy. The chapters were originally published as a special issue of Environmental Politics.

This book was released on 2017-07-06 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty-five years into transformation, Central and Eastern European regions have undergone substantial socio-economic restructuring, integrating into European and global networks and producing new patterns of regional differentiation and development. Yet post-socialist modernisation has not been without its contradictions, manifesting in increasing social and territorial inequalities. Recent studies also suggest there are apparent limits to post-socialist growth models, accompanying a new set of challenges within an increasingly uncertain world. Aiming to deliver a new synthesis of regional development issues at the crossroads between ‘post-socialism’ and ‘post-transition’, this book identifies the main driving forces of spatial restructuring in Central and Eastern Europe, and charts the different regional development paths which take shape against the backdrop of post-crisis Europe. A comparative approach is used to highlight common development challenges and the underlying patterns of socio-economic differentiation alike. The issues investigated within the Handbook extend to a discussion of the varied economic consequences of transition, the social structures and institutional systems which underpin development processes, and the broadly understood sustainability of Central and Eastern Europe’s current development model. This book will be of interest to academics and policymakers working in the fields of regional studies, economic geography, development studies and policy.

This book was released on 2022-07-29 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book considers Australian First Nations constitutionalism by drawing on the chthonic constitutional traditions of three distinct Australian First Nations legal orders: the Warlpiri, Yolngu, and Pintupi legal orders, in the endeavour of identifying, via a comparative analysis, a core of similarities to be drawn upon and articulate an emergent legal theory common to the three legal orders. The comparative analysis is undertaken at the most foundational levels of their legal traditions, via the prism of a legal paradigm elaborated with reference to an Australian Indigenous cosmological, ontological, and epistemological standpoint. The proposed legal theory comprises a broad overview, general concepts, normative principles, and general working principles. In so doing, the book expounds how Australian First Nations constitutionalism unfolds into holistic orders of spiritual, political, and legal authority that are explainable in terms of legal theory. At the most foundational level, such elaboration may help delineate normative and legal constitutional patterns throughout Indigenous Australia.
