By this act, and subsequent amendatory acts, the supervision of the institutions of secondary and superior education in the State was intrusted to the Regents of the University. They were thus constituted a State board of education which, in priority of establishment, antedates all others in the United States. The century which has since elapsed has witnessed the inception, organization and development of the present noble system of education in the State. Book excerpt: Excerpt from Quarto-Centennial Celebration: University of Colorado, November 13, 14 and 15, 1902, Boulder, Colo Prominent, if not foremost, among the legal reforms Of the century, which preceded the foundation Of this University, was the simplification of legal procedure. The archaic condition Of the law of procedure is illus trated by the fact that trial by battle was not formally abolished in Eng land until 1819, and it is only in comparatively recent times that the relation of procedure to substantive law has been clearly and definitely understood. The great leader in this reform in England was Mr. Bentham, in the early part of the century, and it was not until many years after his death that the reforms which he advocated were accepted and adopted both in England and America. The reform code pleading was adopted in New York in 1849, and nearly all the States have followed. Lawyers trained in the common lawx pleading naturally looked upon this innovation with suspicion and dis trust. But no State which has adopted this reform procedure has returned to the ancient common law pleading, and no State which has abolished any of the ancient exclusionary rules of evidence has restored them. We would be as much surprised now to hear of such a suggestion as we would of the return to trial by ordeal or wager Of battle. During the quarter century which has passed, the quarter centennial whereof you are now celebrating, this movement for the simplification of procedure has gone progressively forward. Investigations in historical jurisprudence have demonstrated that extreme technicality in procedure, such as we had until a comparatively recent period in our own law, and such as we find in the Twelve Tables Of the Roman Law, is the Sign of an undeveloped system of law, in which legal rights are subordinate to the procedure to enforce them, in which substance is secondary to form. Thus Sir Henry Maine says that technicality is a disease, not of the old age, but of the infancy of legal systems, and he adds. Book excerpt: Excerpt from Historical and Statistical Record of the University of the State of New York During the Century From 1784 to 1884: With an Introductory Sketch The compilation of this volume was undertaken in connection with the celebration, in 1884, of the centennial anniversary of the establishment of the University of the State of New York. It was designed to comprise a full record of the educational work of the Board of Regents, and of the several institutions and trusts which by law had been placed in its care. The execution of this task was intrusted to Dr. Franklin B. Hough, who by natural taste, by his long experience in such investigations, and his familiarity with the sources of information to be explored, was possessed of all the quali fications for its successful accomplishment. Amid the sorrow with which we make record of his death, * we must note it as a fortunate circumstance that his labors on this volume were substantially com pleted before he was attacked by the fatal illness which ended his life. The little that remained to be done, in the adjustment of per tions of the prepared material, and in the correction of the proofs, has been done by the hands of those whom he had trained to such tasks. And though there is little need for such apology, I am charged by those upon whom this work was SO sadly devolved to ask for it such consideration as may be due to the fact that a part of it lacked the critical revision Of him who had planned and written it. To those who desire to investigate the early history of education in this State, and trace the broad stream to its small beginnings, the present compilation, drawn from original and authentic sources, must always possess a special interest and value. Long tables were stretched out in the shade. And a dinner, seasoned for any palate, was served to all who came. Of the people who attended the celebration, none went hungry. At the close of the dinner hour, about 7 o'clock, a New England arbutus, brought from Plymouth Rock on the Council train from Boston, was planted by Miss Whitcomb, of Worcester, Mass, at the foot of the old bee tree, a rugged oak a dozen rods south of Marsh Memorial Hall, the tree having been preserved for yearsbecause of the special request of Mrs. Tabitha Brown, an early benefactor of the college. A score of addresses were made during the after noon and evening, most of then; extemporaneous, though a few were prepared with much care. All were listened to with close attention. A college song, com posed by a student of the institution, and other songs by a college choir, varied the programme agreeably.
