The distinction between the private callings - the rule - and the public, callings - the exception - is a striking feature of the law governing business relations as it is to-day. The causes of the division are economic rather than strictly legal. Free competition, the very basis of the modem social organization, superseded almost completely medieval restrictions, but it has just come to be recognized that the process of free competition fails in some cases to secure the public good, and it has been reluctantly admitted that some control is necessary over such lines of industry as are affected with a public interest. At this point the problem of public callings becomes a legal one. No one can carefully study the authorities on this subject without feeling that we are just entering upon a great and important development of the common law. What branches of industry will eventually be of such public importance as to be included in the category of public callings, and to what extent the control of the courts will be carried in the effort to solve by law the modem economic problems, it would be rash to predict. Enormous business combinations, virtual monopolization of the necessaries of life, the strife of labor and capital, now the concern of the economist and the statesman, may prove susceptible of legal control through the doctrines of the law of public callings. Valuation of Property. The Wisconsin law provides for a valna tion by the commission of the property of all public utilities. In de termining such value, the commission may avail itself Oi any information in the possession of the State board of assessment. A public hearing shall be held, and upon such hearing the commission shall fix the value and file'a Statement thereof with the utility and with the clerk of the municipality where it is Situated. A te-valuation may 'be made at any time on the initiative of the commission. Maryland adopted a similar provision and required a separate state ment of the property in each municipality. The other states give no such grants of power but in certain cases, at least in New York, there is an implied power in particular cases to value the property as a basis for rate making. The present edition, by condensation of authorities and omission of precedents in cases where printed forms can be readily obtained, as in summary proceedings and supplementary proceedings, and by reason of the largely increased size of the page, has with difficulty been kept within the limit of pages. It will be noted that in the consolidation many of the proceedings have been transferred from the Code to the Statutes. In such cases tabular statements are made indicating the former Code section and the statute and section where now found. The cyclopedic arrange ment will be found to facilitate the work of investigation in that each of the unconnected topics will be found in its alphabetical order. To this an exception is made in treating Special Proceedings Gren erally which is introductory in its nature and therefore precedes the specific topics ranged under that general title. Organized on July 1, 1907, per formed during the year 1916, more work than in any other one year since its creation. The largest part of this work was done in its capacity as a rapid transit board for The City of New York, and included the awarding of construction contracts of various sorts for the new lines of the Dual System, the super vision of construction work on contracts previously let and the preparation of the final plans for the construction of the Dual System. This work is performed under Chapter IV of the. Laws of 1891 and Amendments, known as the Rapid Transit Act. The regulation and supervision of common carriers. And other public service corporations placed under its jurisdiction by the Public Service Commissions Law were also continued by the Com mission during the year. It also performed certain duties under the Railroad Law, and other statutes. The work of the Commission in its function of a rapid transit board was more extensive in 1916 than in any previous. Year, although the sum total of contracts awarded on rapid transit work was slightly less in number and in value than in the year 1915. This is essential in order to determine the capitalization upon which rates are to'be estimated. With out such a basis the regulation of rates would be practically impossible. However, in view of the many theories advanced for determining capitalization no specific rule is prescribed bythe statute. The act merely commands the Commission to value all of the property of every public utility actually used and useful for the convenience of the public, and to make a sepa rate valuation of all the physical property of such utility so used and useful. Every element of value, both tangible and intang ible, is to be considered in reaching a result, excepting only franchise values, which are necessarily excluded 'by the general policy of the law. The object to be attained is the fair value of the property as a going concern. This, in the contemplation of the statute, is the proper capitalization upon which returns must be allowed.
