The same method has been here pursued that was followed in the writing of the first volume, and the same general aim has been kept in view. Nevertheless, the result is appreciably different. The former volume is, within its limits, a rounded treatise on the subject of torts; the present volume is more in the nature of a preliminary study of the law of contract than a rounded treatise on that subject. In the former volume we were able to preserve a very satisfactory balance between matter of pure legal history and matter expository of legal principles. In this volume we have been forced to lay more stress on matter of pure legal history than on matter expository of the existing state of the law. The reason for this is to be found in certain grave difficulties which were encountered at the very threshold of these inquiries into the law of contract. The existence of these made it nec essary that some preliminary work of a very searching nature should be done. The author accordingly set about the doing of this preliminary work, and the result is the book that is now before the reader. It was thought better to deal fully and exhaustively with the root principles in our law of contract rather than to attempt a systematic presentation of the whole subject. It is true that the forms of action are the vestments or trap pings of substantive rights of action. But they are more than this. Historically they are the vehicle in which substantive principle has been conveyed to the teachable mind, and such conceptions of fundamental liability as those actions were capable of conveying are the conceptions which have been accepted in our law. Under the system of common-law pleading, lawyers and judges were compelled to do exact thinking. In choosing the form of action in framing the pleadings, as well as in the instruction of Juries, and even in the rendition of the judg ment, it was necessary in each case to anatomize the cause of action in order to ascertain the exact nature of the legal liability upon which the suit was based. Each particular species of liability had, or was supposed to have, its peculiar and appropriate remedy. A mistake in the diagnosis of the nature of the liability would lead to the adoption of the wrong form of action, and this at a later stage would certainly lead to a wreck of that particular lawsuit and perhaps to a loss of the right of action itself. Every cause of action was therefore certain under the common-law system to be sub jected, at one stage or another, to the closest scrutiny to ascertain the exact nature of the liability involved. The dis cassions to which this gave rise tended vastly to elucidate the principles underlying our law, and they form one of the richest elements in our court decisions. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer does the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. Instruction by the means of text-books as a supplement or substitute for the formal lecture has made its formal entry into the educational world and obtains widely; but the system is faulty and must pass away as the exclusive means of studying and teaching law. It is an improvement on the formal lecture in that the student works, but if it cannot be said that he works to no purpose, it is a fact that he works from the wrong end. The rule is learned without the reason, or both rule and reason are stated in the abstract as the resultant rather than as the process. If we forget the rule we cannot solve the problem; if we have learned to solve the problem it is a simple matter to formulate a rule of our own. The text-book method may strengthen the memory; it may not train the mind, nor does it necessarily strengthen it. A text, if it be short, is at best a summary, and a summary presupposes previous knowledge. If, however, law be considered as a science rather than a collection of arbitrary rules and regulations, it follows that it should be studied as a science. Thus to state the problem is to solve it; the laboratory method has displaced the lecture, and the text yields to the actual experiment. The law reports are in more senses than one books of experiments, and, by studying the actual case, the student co-operates with the judge and works out the conclusion however complicated the facts or the principles involved. A study of cases arranged historically develops the knowledge of the law, and each case is seen to be not an isolated fact but a necessary link in the chain of development. The study of the case is clearly the most practical method, for the student already does in his undergraduate days what he must do all his life; it is curiously the most theoretical and the most practical. Book excerpt: Excerpt from The Law of Accident and Employer's Liability Insurance Accident insurance is of comparatively modern origin. In the seventeenth century the idea of insuring individuals against accidents seems to have been first contemplated in France. But not until the middle of the nineteenth century was the first English company formed for this purpose. The first American company was not organized until about 1860. In England the policies were framed for the purpose of paying definite indemnities for specific injuries, such as the loss of a limb, blindness, etc., The earliest American policies were based on their English prototypes. They were not adapted to the newer country, with its different customs and habits of life, its varied occupations and risks, and the companies which had embarked in the business met with disaster and failure. Shortly the pioneers in the industry undertook the scientific construction of a system of accident insurance, evolving new tables of rates, new classifications of risks, and new methods of business, based upon conditions in the United States. In a short time it was demonstrated that by a statistical and mathematical calculation a table of risks could be prepared on the same principle employed in the construction of mortality tables by life insurance companies, upon which could be based a reliable and equitable system of accident insurance. In the United States accident insurance was inaugurated with the sale of so-called "accident tickets" to travelers on railroads covering only risks of travel, and in most instances good only for periods of twenty-four hours or the duration of specific trips. These tickets were sold at railroad stations. It soon became manifest that only a small percentage, not above ten per cent., of accidents resulted from traveling. The Superior Court sustained the demurrer, and ordered judgment for the defendant; and the plaintiff appealed to this court. Devens, J. The alleged misrepresentations of the defendant, by which the plaintiff avers that he was induced to enter into a contract for building thirty miles of the Florida Midland Railway, are that the defendant had purchased a certain quantity of rails at a certain price, and that he would sell those rails to the plaintiff at the same price if he would make such contract. The plaintiff's declaration alleges that the defendant had not then purchased the rails, and did not sell, and did not intend to sell, any rails so purchased to the plaintiff and that by reason of the contract into which the plaintiff was induced to enter, he was obliged to purchase a large number of rails at a much higher price than that named by the defendant, to his great injury. If the formalities required by law in order that contracts for the sale and delivery of goods of the value here in ques tion had been complied with, that these facts would constitute a con tract upon a valuable consideration, will not be questioned. The plaintiff does not seek to recover upon this contract, but in an action of tort in the nature of deceit, because he was induced to enter into the contract with the Florida Railway Company by reason of the representations above set forth. A representation, in order that, if material and false, it may form the ground Of an action where one has been induced to act by reason thereof, should be one Of some existing fact. A statement promissory in its character that one will thereafter sell goods at a particular price or time, will pay money, or do any similar thing, or any assur ance as to what shall thereafter be done, or as to any further event, is not properly a representation, but a contract, for the violation Of which a remedy is to be sought by action thereon. The statement by the defendant that he would thereafter sell rails at a particular price if the plaintiff would contract with the railway company was a promise, the breach Of which has occasioned the injury to the plaintiff.
