Book excerpt: Excerpt from Cases Illustrative of Oriental Life, and the Application of English Law to India, Decided in H. M. Supreme Court at Bombay During the last few months of holding office in India I employed some leisure hours in collecting and revising a few cases of general interest that had come before me in the Supreme Court of Bombay, and I now venture to lay them before the public. The insight into human life afforded by transactions in a Court of Justice had always appeared to me to give peculiar opportunities to an observer for studying national character; but it is especially to a class like the English in India that such opportunities are most valuable. For the chief administrators in our vast Indian empire are so completely severed from the bulk of the population by colour, race, language, religion, and material interests, that they are often, if not habitually, in complete ignorance of the most patent facts occurring around them (a). Book excerpt: This book explores the evolution of a Shia Ismaili identity and crucial aspects of the historical forces that conditioned the development of the Muslim modern in late colonial South Asia. It traces the legal process that, since the 1860s, recast a Shia Imami identity for the Ismailis, and explicates the public career of Imam Aga Khan III amid heightened religious internationalism since the late-nineteenth century, the age of 'religious internationals'. It sheds light and elaborates on the enduring legacies of questions such as the Aga's understanding of colonial modernity, his ideas of India, restructured modalities of community governance and the evolution of Imamate-sponsored institutions, key strands in scholarship that characterized the development of the Muslim and Shia Ismaili modern, and Muslim universality vis-à-vis denominational particularities that often transcended the remits of the modular nation and state structure.

Available in PDF, EPUB and Kindle. Book excerpt: The Jurisprudence of Emergency examines British rule in India from the late eighteenth to the early twentieth century, tracing tensions between the ideology of liberty and government by law used to justify the colonizing power's insistence on a regime of conquest. Nasser Hussain argues that the interaction of these competing ideologies exemplifies a conflict central to all Western legal systems—between the universal, rational operation of law on the one hand and the absolute sovereignty of the state on the other. The author uses an impressive array of historical evidence to demonstrate how questions of law and emergency shaped colonial rule, which in turn affected the development of Western legality. The pathbreaking insights developed in The Jurisprudence of Emergency reevaluate the place of colonialism in modern law by depicting the colonies as influential agents in the interpretation of Western ideas and practices. Hussain's interdisciplinary approach and subtly shaded revelations will be of interest to historians as well as scholars of legal and political theory.

Available in PDF, EPUB and Kindle. Book excerpt: Since the economic reforms of the 1990s, India’s economy has grown rapidly. To sustain growth and foreign investment over the long run requires a well-developed legal infrastructure for conducting business, including cheap and reliable contract enforcement and secure property rights. But it’s widely acknowledged that India’s legal infrastructure is in urgent need of reform, plagued by problems, including slow enforcement of contracts and land laws that differ from state to state. How has this situation arisen, and what can boost business confidence and encourage long-run economic growth? Tirthankar Roy and Anand V. Swamy trace the beginnings of the current Indian legal system to the years of British colonial rule. They show how India inherited an elaborate legal system from the British colonial administration, which incorporated elements from both British Common Law and indigenous institutions. In the case of property law, especially as it applied to agricultural land, indigenous laws and local political expediency were more influential in law-making than concepts borrowed from European legal theory. Conversely, with commercial law, there was considerable borrowing from Europe. In all cases, the British struggled with limited capacity to enforce their laws and an insufficient knowledge of the enormous diversity and differentiation within Indian society. A disorderly body of laws, not conducive to production and trade, evolved over time. Roy and Swamy’s careful analysis not only sheds new light on the development of legal institutions in India, but also offers insights for India and other emerging countries through a look at what fosters the types of institutions that are key to economic growth.
