Book excerpt: The fourth edition of this best-selling book has been thoroughly revised to take into account recent developments in the law in criminal practice and procedure across the region. The only textbook that explores criminal practice and procedure as it relates to the Commonwealth Caribbean, the book clarifies the state law in each of 11 jurisdictions, at the same time making it clear when laws are the same or similar and highlighting where differences among jurisdictions occur. Both statute law and common law are examined in the relevant jurisdictions, which include Trinidad and Tobago, Guyana, Barbados, Jamaica and Grenada amongst others. The impact of statutory changes in the laws are analysed, as well as recent developments in the common law. Throughout the text the statutory law in the Commonwealth Caribbean is compared to similar English legislation, in the light of the analysis of such legislation in English case law. Commonwealth Caribbean Criminal Practice and Procedure is the recommended textbook for all profes- sional law schools in the Commonwealth Caribbean and is used at regional universities as a reference book for criminal justice students. In addition, as the only book that deals specifically with criminal practice and procedure in the regions, it has proved a valuable reference tool for legal practitioners, judicial officers and police officers.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first book of its kind in the Commonwealth Caribbean on Criminal Procedure. Furthermore it is written by someone who has over twenty years experience in the field: as a prosecutor for over a dozen years, as a magistrate, as a criminologist, a criminal justice consultant and finally as a law school lecturer. This book fills a lacuna in Commonwealth Caribbean jurisprudence in that there is currently no local or regional text on criminal practice and procedure. For too long students and practitioners have had to waste time to wade through English and other text in areas that are not even relevant in order to determine their application to these jurisdictions. The book provides a useful reference to clarify what the state of the statutory law is in the Caribbean when compared to similar areas in English law and to discuss the relevant statute and common law in specific areas. It is a text useful not only for law school students but criminal justice professionals such as lawyers and police officers as well.; The content of the book includes both the statute law and common law on criminal practice and procedure in most of the relevant jurisdictions, which include Trinidad Tobago, Guyana, Barbados, Jamaica and Grenada among others. Where the law is the same or similar in some jurisdictions this is emphasised in the text so as to avoid unnecessary repetition in discussion. Attempts will be made to identify specific differences in the laws of different jurisdictions despite their being many commonalities. Recent developments in these areas are also discussed and the impact of the statutory changes in some countries is assessed

Available in PDF, EPUB and Kindle. Book excerpt: The establishment of the Caribbean Court of Justice sees the countries of the Commonwealth Caribbean at an important and exciting judicial crossroads. Debate, often acrimonious, continues over the abolishment of ties to the Judicial Committee of the Privy Council and, increasingly those influencing the debate are a more educated and articulate Caribbean people, insisting on proper governance of the area's public bodies. This new book analyzes judicial review, a mechanism for achieving public justice, through emerging case law in the hope that it will cast light on the jurisprudential evolution of Caribbean society in the twenty-first century. Bringing together cases and materials on judicial review in the Caribbean for the first time, this book examines what judicial review is, before going on to discuss the grounds, obstacles and conduct within the judicial review process. It concludes by examining the future of judicial review and justice more generally in the Caribbean. Legal professionals in the Caribbean will find it a useful and comprehensive reference tool.

Available in PDF, EPUB and Kindle. Book excerpt: Commonwealth Caribbean Business Law breaks away from the traditional English approach of treating business law primarily as the law of contract and agency. The book takes a panoramic view of the foundation of various legal systems with a subsequent examination of different areas of legal liability that may affect business activities. These areas include contract law, agency, tort law, criminal law, and internet law as significant challenges confronting the business sector. The book primarily targets the development of business law in several Caribbean Commonwealth jurisdictions but also, where appropriate, embraces the jurisprudence of other Commonwealth nations such as the United Kingdom, Canada and Australia. With respect to internet law, the proliferation of judicial pronouncements emerging from the United States provided the platform for the only non-Commonwealth treatment of a topic. The approach of the book is to use excerpts from judgments so as to allow students, particularly the non-legal student, to understand legal principles as espoused by the judiciary without the filtering bias of authors.

In Europe and North America, Sports Law has been very much a part of the legal landscape for about four decades, while in more recent times, it has blossomed in other geographic regions, including the Commonwealth Caribbean. This book recognizes the rapid evolution of Sports Law and seeks to embrace its relevance to the region. This book offers guidance, instruction and legal perspectives to students, athletes, those responsible for the administration of sport, the adjudication of sports-related disputes and the representation of athletes in the Caribbean. It addresses numerous important themes from a doctrinal, socio-legal and comparative perspective, including sports governance, sports contracts, intellectual property rights and doping in sport, among other thought-provoking issues which touch and concern sport in the Commonwealth Caribbean. As part of the well-established Routledge Commonwealth Caribbean Law Series, this book adds to the Caribbean-centric jurisprudence that has been a welcome development across the region. With this new book, the authors assimilate the applicable case law and legislation into one location in order to facilitate an easier consumption of the legal scholarship in this increasingly important area of law.

It is the first and only legal text that comprehensively covers all the main substantive areas of spousal family law, including marriage, divorce, financial support, property rights and domestic violence. The rights of the statutory spouse in the jurisdictions of Barbados, Belize, Guyana, Jamaica, and Trinidad and Tobago are examined, thus addressing, on a jurisdictional basis, an important area of spousal family that is seldom covered in English family law texts. The book also covers the number and variations of divorce regimes applicable to the region – the matrimonial offence divorce model of Guyana and Montserrat, the English five fact model of Trinidad and Tobago, Dominica, Grenada, Anguilla, and St Vincent and the Grenadines, the hybrid model of Antigua and Barbuda, Belize and St Kitts and Nevis, and the no fault model of Jamaica and Barbados. This book will prove an indispensable resource for law students and legal academics, as well as for family law practitioners across the English-speaking Caribbean. Other professionals, including sociologists and social workers, will also find the book useful and informative.

Book excerpt: If your desire is to attain a greater understanding of theoretical frameworks, methodologies, and pragmatic discussions on criminology and criminal justice in the Caribbean, then this is the book for you. This book is a direct response to the call for a Caribbean Criminology as espoused by Ken Pryce (1976) who pointed to the "need to examine the reality of crime from a critical standpoint in the context of the Region's history of capitalist repression and exploitation, and in terms of the Caribbean's structural heritage of black working-class styles of protest and modes of response to oppression through slavery down to the present stage of neo-colonialism" (p. 5). Caribbean Perspectives on Criminology and Criminal Justice is intended for academics, criminal justice professionals, students, practitioners, policymakers, and interested persons who are desirous of improving their understanding of the challenges that arise when issues related to criminology and criminal justice cross national boundaries in the Caribbean. Conceptualized and edited by the innovative, creative, and forward-thinking scholar and criminologist, Dr. Wendell C. Wallace, Caribbean Perspectives on Criminology and Criminal Justice is a MUST read for any serious practitioner with an interest in criminological and criminal justice issues that impact the Caribbean.

Available in PDF, EPUB and Kindle. Book excerpt: English colonial expansion in the Caribbean was more than a matter of migration and trade. It was also a source of social and cultural change within England. Finding evidence of cultural exchange between England and the Caribbean as early as the seventeenth century, Susan Dwyer Amussen uncovers the learned practice of slaveholding. As English colonists in the Caribbean quickly became large-scale slaveholders, they established new organizations of labor, new uses of authority, new laws, and new modes of violence, punishment, and repression in order to manage slaves. Concentrating on Barbados and Jamaica, England's two most important colonies, Amussen looks at cultural exports that affected the development of race, gender, labor, and class as categories of legal and social identity in England. Concepts of law and punishment in the Caribbean provided a model for expanded definitions of crime in England; the organization of sugar factories served as a model for early industrialization; and the construction of the "white woman" in the Caribbean contributed to changing notions of "ladyhood" in England. As Amussen demonstrates, the cultural changes necessary for settling the Caribbean became an important, though uncounted, colonial export.

Available in PDF, EPUB and Kindle. Book excerpt: Despite high crime rates among men in the Caribbean, rising rates of violence against women in the region, and a significant number of Caribbean nationals incarcerated abroad due to drug smuggling, existing research has yet to offer explanations that are tailored to the unique Caribbean societies and the individuals in them. This edited volume adds to the existing body of scientific, empirical and theoretical work on crime (victimization), and criminal justice in the Caribbean, with a specific focus on impacts of post-colonialism and gender. To investigate these impacts on a developing Caribbean criminology, the contributions in this volume focus on how impacts of post-colonialism, associated racial stereotypes, and/or gender throughout the Caribbean impact on (a) types of offending, (b) victimization, and (c) criminal justice system responses and policies. Bringing together a broad range of experts, this book sheds light on key criminological topics in the Caribbean, including victimization, risk factors for offending, subcultures of violence and particularly gendered violence, and the role of motherhood within matrifocal societies. It is essential reading for those engaged with Caribbean - or decolonial - Criminology and those engaged with comparative and international studies in crime and justice more generally.
