Book excerpt: Excerpt from Canada and South Australia: A Commentary on That Part of the Earl of Durham's Report Which Relates to the Disposal of Waste Lands and Emigration; In Three Papers, Delivered at the South Australian Rooms, No; 5 Adam Street, Strand Mr dear Sir, I have not thought it worth while to ask your permission to address you, not only on account of the smallness of the occasion, but because, although I may be scarcely entitled to claim your attention, you are so completely identified with that admirable system of which you are the founder, that all those who labour in spreading the benefits of that system, however humbly, may consider your indulgence as a common right. It is true that I, who have derived from your writings (as many others have done) all the most valuable part of what I know on the subject of colonization, am, perhaps, too ready to claim my supposed right; but I seek, to pay what I owe you, by turning to its proper account the knowledge which I have borrowed; just as the acorn returns to the soil whence itself has sprung. Book excerpt: Excerpt from Canada and South Australia: A Commentary on That Part of the Earl of Durham's Report Which Relates to the Disposal of Waste Lands and Emigration; In Three Papers, Delivered at the South Australian Rooms, No; 5 Adam Street, Strand Lord Durham tells us, after a brief and mas terly introduction of his subject, developing the chief objects to be sought in the disposal of waste lands, that he was met, on his arrival in the colony, by innumerable complaints of abuse, and applications for justice or favour, (the word is pregnant with instruction, ) which had slumbered during previous years. During my residence in the Canadas, he continues, scarcely a -day passed without my receiving some petition or representation relating to the crown lands' department; and matte1s belonging to this branch of government necessarily occu pied a far larger proportion than any other of my correspondence with the Secretary of State. The noble lord then appointed a Commission of Inquiry, not without a reference to the new method pursued in the Australian colonies, the remarkable success of which, he says, gave him a hope that he should be able to recommend beneficial reforms in Canada. Book excerpt: This volume is the result of the Association for Canadian Studies in Australia and New Zealand (ACSANZ) 1995 conference held at La Trobe University in Melbourne, Australia. A special feature of the conference, though not its exclusive focus, was trade relations. But as with all ACSANZ conferences, the papers were wide-ranging and contributors were not limited to a single theme. This publication is a refereed collection from more than sixty papers that were presented and range from discussions of immigration policy in Canada and Australia to architectural practices in British Columbia; from Canadian influences on Australia's economic development to issues of identity politics in each nation's literature. In addition, the collection represents major research in the areas of globalization, migration, pluralism, and ethnic relations, with a strongly, though not exclusively, comparative orientation. This work is a co-publication with the International Council for Canadian Studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a comparison of the history and politics of two sister societies, comparing Canada with Australia, rather than, as is traditional, with the United Kingdom or the United States. It is representative of a particular interest in promoting more contact and exchange among Canadian and Australian scholars who were investigating various features of the two societies. Because some of them were individually involved in aspects of federalist studies, an examination of the early evolution of federalism in what once were the two sister dominions seemed quite an appropriate area in which to begin comparisons. The book discusses Canadian federalism from about 1864 to 1880 and Australian federalism from about 1897 to 1914. It examines the background and changes wrought on early Canadian federalism and early Australian federalism.

Available in PDF, EPUB and Kindle. Book excerpt: This edited collection explores how migrants played a major role in the creation and settlement of the British Empire, by focusing on a series of Australian case studies. Despite their shared experiences of migration and settlement, migrants nonetheless often exhibited distinctive cultural identities, which could be deployed for advantage. Migration established global mobility as a defining feature of the Empire. Ethnicity, class and gender were often powerful determinants of migrant attitudes and behaviour. This volume addresses these considerations, illuminating the complexity and diversity of the British Empire’s global immigration story. Since 1788, the propensity of the populations of Britain and Ireland to immigrate to Australia varied widely, but what this volume highlights is their remarkable diversity in character and impact. The book also presents the opportunities that existed for other immigrant groups to demonstrate their loyalty as members of the (white) Australian community, along with notable exceptions which demonstrated the limits of this inclusivity.

Book excerpt: It is commonly asserted that bills of rights have had a 'righting' effect on the principles of judicial review of administrative action and have been a key driver of the modern expansion in judicial oversight of the executive arm of government. A number of commentators have pointed to Australian administrative law as evidence for this 'righting' hypothesis. They have suggested that the fact that Australia is an outlier among common law jurisdictions in having neither a statutory nor a constitutional framework to expressly protect human rights explains why Australia alone continues to take an apparently 'formalist', 'legalist' and 'conservative' approach to administrative law. Other commentators and judges, including a number in Canada, have argued the opposite: that bills of rights have the effect of stifling the development of the common law. However, for the most part, all these claims remain just that – there has been limited detailed analysis of the issue, and no detailed comparative analysis of the veracity of the claims. This book analyses in detail the interaction between administrative and human rights law in Australia and Canada, arguing that both jurisdictions have reached remarkably similar positions regarding the balance between judicial and executive power, and between broader fundamental principles including the rule of law, parliamentary sovereignty and the separation of powers. It will provide valuable reading for all those researching judicial review and human rights.
