To address tribes¿ needs for cultural preservation, NCLBA allows tribal groups to waive all or part of BIE¿s definition of AYP and propose an alternative, if requested. This report provides information on the extent of: (1) BIE schools¿ adoption of BIE¿s definition of AYP; (2) tribal groups¿ pursuit of alternatives and their reasons as well as reasons other tribal groups have not done so; and (3) fed. assistance to tribal groups developing alternatives. Includes recommendations. Illustrations.

The Department of Defense Education Activity (DoDEA) and the BIE are the only two federally-operated school systems operating in the United States. While they have no schools in Indian Country, the Department of Defense has approximately the same number of schools as the BIE. Yet their proposed replacement school construction budget for next year is $315 million, compared to the BIE's request of $2 million. Many Indian children excel at school, grow up to become teachers, business owners, doctors, lawyers, and government leaders. The Federal Government has important responsibilities in educating Indian children. But what we do not see is consistent, successful academic achievement at the BIE schools. It is critical that we make sure BIE students are getting the support they need to succeed in the classroom.

BIE directly operates about a third of its schools, and tribes operate two-thirds. BIE, within Interior's office of Indian Affairs, oversees 185 schools, serving about 41,000 students on or near Indian reservations. BIE's mission is to provide students with a quality education. However, BIE student performance has been consistently below that of public school students, including other Indian students. This book examines how funding sources and expenditures of BIE schools compare to those of public schools; the extent to which BIE has the staff and expertise needed to oversee school expenditures; and the extent to which BIE's processes for oversight adequately ensure that school funds are spent appropriately.
